In recent years, with the continuous prosperity and development of the economy, private cars have entered thousands of households, and with the continuous growth of automobile penetration, the number of road traffic cases has increased year by year. In view of the characteristics of such cases, the People's Court of Dehui City has actively carried out professional trial reform, and through the empowerment of science and technology and the exertion of judicial initiative, the traditional element-based trial method has been innovated into an active extraction trial by judges, and it has been applied to the road traffic calculator independently made by judges, so as to realize the efficient trial of road traffic cases.
In the daily trial work, there are as many as a dozen individual and comprehensive calculations involved in road traffic cases, including medical expenses, lost work expenses, nursing expenses and other expenses. After the individual calculation is completed, it needs to be calculated into the medical, disability, property loss and other items of compulsory traffic insurance according to the category, and the excess and insufficient part shall be calculated under the commercial insurance. In the above calculation sequence, as long as one data is miscalculated, then all calculations have to be repeated, which is very complicated. In addition, the determination of liability and the circumstances of damage vary from case to case, requiring complex calculations and assessments. These tasks are not only time-consuming and labor-intensive, but also prone to problems such as calculation errors.
In order to solve this problem, Judge Zhu Liqi of the Dehui Court gave full play to the spirit of innovation, drew on the ideas of advanced regions and the trial practice in Changchun to make a special calculator for road traffic cases by using excel functions. This calculator can automatically perform individual and comprehensive calculations according to the different variable data of each case, which greatly improves the calculation efficiency and accuracy. At the same time, the calculator can also automatically adjust the calculation formula and parameters according to different liability determinations and damage situations to ensure the accuracy and fairness of the calculation.
This innovative measure significantly reduces the time and error of manual calculations, and provides strong scientific and technological support for judges. After using the calculator, the calculation and verification, which is usually time-consuming and laborious, can be quickly completed in 10 minutes. The calculator is suitable for the front-line trial work, and can directly input the calculation ** into the judgment, so that the calculation process in the judgment looks concise and clear at a glance, which greatly improves the work efficiency of judges.
At the same time as producing a special calculator for road traffic cases, the Dehui Court also reformed the traditional elemental trial method. In the traditional elemental trial, the element table is the core of the elemental trial, but the Dehui Court found in practice that there are many problems in the filling in of the element table by the parties. Due to the uneven level of legal knowledge of the parties and the first person, many parties are unable to accurately fill in the element table, which leads to low efficiency in the trial and fails to achieve the expected results.
In order to solve this problem, Zhu Liqi gave full play to his judicial initiative, changed the previous practice of filling in the element table by the parties, and designed a "Extract Variable Element Table" covering all variable information, and the judge took the initiative to extract the element information, and after the plaintiff presented evidence and the defendant cross-examined the evidence in the trial, the judge quickly certified it according to this table, and determined and filled in the variable information of the whole case.
In this way, the judge can quickly and accurately extract the element information of the case and enter it into the calculator to get the final amount of compensation. At the same time, it also enables judges to grasp case information and evidence more efficiently in court hearings, which is conducive to improving the efficiency and fairness of court hearings. This reform measure has changed the passive way of filling in the element form in the traditional elemental trial, and improved the efficiency and accuracy of the judge's trial certification.
