After review, the Legislative Affairs Commission held that national laws and administrative regulations did not completely prohibit the sale and discharge of fireworks. Instead, they allow county-level and above to demarcate time slots and areas where fireworks are restricted or prohibited. As a result, local regulations that prohibit blanket prohibitions are inconsistent with higher-level laws.

Considering that the comprehensive ban on sales and burning is difficult to implement in practice, and there are differences among people on this, the Legislative Affairs Commission suggested that the local government should revise it in accordance with the provisions of the higher-level law. At present, the relevant enacting authorities have agreed to revise these provisions as soon as possible.

In recent years, due to the problem of air pollution, many places have issued "fire bans". However, starting from the beginning of 2023, Guangdong, Shandong, Liaoning and other places have adjusted this policy, changing "prohibition" to "restriction", allowing people to set off fireworks at specific times and areas.

For example, Binzhou in Shandong Province clearly stipulates special areas where fireworks are prohibited, such as cultural relics units and transportation hubs, but other areas are from Chinese New Year's Eve to the beginning of the first month.
