1 Purpose.
In order to standardize the reporting, investigation and handling of accidents, grasp the accident situation, find out the cause of the accident, distinguish the responsibility for the accident and seriously investigate the responsibility, according to the provisions on the investigation of administrative responsibility for major safety accidents, and the implementation measures for the reporting and investigation and handling of accidents by employees, these provisions are formulated.
2 Scope. This regulation applies to the reporting of all kinds of accidents within the purview of our school and the accidents investigated and handled by our school.
The reporting, investigation, and handling of accidents must adhere to the principles of seeking truth from facts, respecting science, and proceeding in accordance with the law.
3 Contents. 3.1. The responsibilities of relevant units (departments) are as follows:
1) The safety work leading group is fully responsible for accident reporting, investigation and handling
2) The safety work leading group is responsible for the investigation and handling of the accident, the collection and storage of accident-related data, and the supervision, supervision and verification of accident prevention measures
3)**Take the lead in accident reporting and rescue coordination;
4) Each business department is responsible for the investigation of the accident within the scope of the business, and timely report to the superior counterpart business office, cooperate with the completion of the investigation and handling of the accident, and formulate accident prevention measures in conjunction with the accident responsible unit
5) The hospital is responsible for the rescue work after the accident
6) Coordinate the rescue work of safety accidents by ***;
7) **Responsible for the implementation of the administrative punishment of the person responsible for the accident (administrative personnel);
8) **Responsible for the implementation of the administrative punishment of the person responsible for the accident (ordinary employee);
9) Each unit (department) responsible for the accident cooperates with the accident to complete the investigation and is responsible for formulating accident prevention measures.
3.2. The accident reporting procedure is:
1) The parties involved in the accident or the first to discover should report to the leader of the unit or the duty room in the fastest way in addition to immediate treatment. After receiving the accident report, the leader of the unit or the duty room shall report to the relevant functional departments according to the type of accident, and the relevant functional departments shall report the accident to their own business department in a timely manner according to the accident level after receiving the accident report.
2) For all kinds of major accidents, the school should immediately report the accident overview (time, place, cause, development of the situation and economic losses, etc.) to the higher authorities and relevant departments. If the situation continues to develop, report it at any time.
3) Procedures for reporting and disposing of personal injury accidents.
1) Fatal accidents.
After a fatal accident occurs, the parties or relevant personnel at the scene of the accident shall promptly take self-rescue and mutual rescue measures to protect the scene of the accident, and immediately report directly or level by level to the principal responsible person of the school;
After receiving the accident report, the main person in charge of the school shall quickly take effective measures to organize rescue, prevent the expansion of the accident, and reduce personnel and property losses
In accordance with the relevant provisions of the state, the main person in charge of the school shall truthfully report to the district (county) education department, the safety supervision bureau, the local ** and other higher-level departments within 1 hour;
The principal responsible person of the school must not conceal, falsely report, or delay in reporting, and must not intentionally destroy the scene of the accident or destroy relevant evidence;
The principal responsible person and relevant personnel of the school shall not leave their duties without permission during the investigation of the accident, and shall accept inquiries from the accident investigation team at any time and truthfully provide relevant information.
2) Minor injuries and serious injuries.
After a teacher or student of the school is injured on the job, the unit where the accident occurs shall report to the main responsible person of the school immediately (within 1 hour) in addition to treating the injured in time (dialing 120 immediately).
The school immediately contacted the competent department of education, human resources and other regulatory departments, and carried out the work in accordance with the relevant provisions of the regulations on work-related injury insurance.
Within three days from the date of the accident, the unit that has a personal injury accident shall investigate and collect evidence for the accident, convene an accident analysis meeting, prepare an "Accident Analysis Report Form", and submit it to the school for verification. Within 15 days, fill in the "** Accident Registration Form", "Accident Injury Report" and "Application for Work-related Injury Identification" and submit them to the Human Resources Department of the school.
After reviewing and sorting out all the materials and materials, the school will report to the local ** Labor and Social Security Bureau for work-related injury identification within 30 days, and handle the "Work-related Injury Determination Decision" to be issued to the injured.
If the injured employee who is identified as a work-related injury is required to undergo the appraisal of his or her working ability and disability, he or she shall apply for the appraisal of his or her working ability and disability with the "Decision on Determination of Work-related Injury" and a copy of his ID card.
Employees who need to return to work must undergo safety training and education before resuming work before they can arrange their work.
* According to the "Accident Analysis Report Form" of each department, the "Accident Investigation and Handling Notice" will be prepared and completed within 5 days. (If necessary, you can go to the workshop for accident review).
4) In the event of an accident, it shall be implemented in accordance with the Order No. 13 issued by the State Administration of Supervision and Administration on July 12, 2007 "Interim Provisions on Fines and Penalties (Regulations on the Reporting and Investigation and Handling of Production Safety Accidents)" and Order No. 493 "Regulations on the Reporting, Investigation and Handling of Production Safety Accidents".
5) The unit where the accident occurred should fill in the accident report and send it to the competent department of the school according to the regulations. Reporting time: within three days for general accidents and seven days for major accidents.
6) If a person is injured on the job, if the injury changes from minor injury to serious injury or from serious injury to death after one month from the date of injury in the accident, it will no longer be reported as a serious injury or death accident.
7) For general accidents, within three days after the accident, the unit where the accident occurred shall organize an investigation and convene an accident analysis meeting, and the personnel of the relevant departments of the school shall participate in the investigation to find out the cause, learn lessons, put forward preventive measures, put forward handling opinions to those responsible for the accident, etc., and report to the relevant departments. For major near-miss accidents, the relevant departments of the school shall organize and convene an accident analysis meeting in a timely manner. Accident analysis should include sorting out and analyzing relevant evidence and data, determining the time, place, and process of the accident, determining the direct and indirect causes of the accident, and analyzing the responsibility for the accident.
8) Other accidents in various departments should be reported according to the division of accident management responsibilities.
3.3. In order to facilitate the investigation, analysis and handling of accidents, our school divides ** accidents into special major accidents, major accidents, major accidents, general accidents, serious injury accidents, and minor injury accidents with reference to the relevant regulations of the superiors, and the specific classification standards are as follows.
1) Particularly serious accidents refer to accidents that cause more than 30 deaths, or more than 100 serious injuries (including acute industrial poisoning, the same below), or direct economic losses of more than 100 million yuan;
2) Major accident refers to an accident that causes the death of more than 10 people and less than 30 people, or the serious injury of more than 50 people and less than 100 people, or the direct economic loss of between 50 million yuan and 100 million yuan;
3) Relatively large accidents refer to accidents that cause the death of more than 3 people and less than 10 people, or the serious injury of more than 10 people and less than 50 people, or the direct economic loss of between 10 million yuan and 50 million yuan
4) General accidents refer to accidents that cause the death of less than 3 people, or the serious injury of less than 10 people, or the direct economic loss of less than 10 million yuan;
5) Serious injury accidents: refer to the national standards for the identification of serious injuries and work-related injuries;
6) Minor injury accident: refers to an accident with only minor injuries.
The term "above" includes this number, and the term "below" does not include this number.
3.4. Accident investigation.
1) Conditions that accident investigators should meet:
1) Have the safety knowledge and expertise required for accident investigation;
2) Have no direct interest in the accident and have no direct family relationship with the parties involved in the accident;
3) Seek truth from facts, be conscientious and responsible, and adhere to principles.
2) Responsibilities of the Accident Investigation Team:
1) Find out the process, causes, personnel and direct economic losses of the accident;
2) Determine the nature of the accident and the responsibility for the accident;
3) Put forward suggestions for dealing with the person responsible for the accident;
4) Summarize the lessons of the accident and put forward preventive and corrective measures;
5) Submit an accident investigation report.
3) The rights of the accident investigation team.
1) The accident investigation team has the right to learn about the accident from the relevant units and individuals, and require them to provide relevant documents and materials, and the relevant units and individuals shall not refuse;
2) No unit or individual shall obstruct or interfere with the normal work of the accident investigation team.
4) Investigation and handling of personal accidents.
1) General, large, major, and particularly major accidents shall be investigated and handled by the superior department;
2) In the case of serious injury accidents, the safety leader in charge of the school or his designated personnel shall organize personnel from the production department, equipment department and other relevant departments to participate in the accident investigation. When necessary, the competent department at a higher level shall organize the investigation and handling of the accident;
3) For minor injury accidents, personnel from relevant departments such as production department and equipment department shall be organized to participate in the accident investigation.
3.5. The time limit for accident investigation and handling is as follows:
1) In the case of minor injury accidents, the investigation and handling shall generally be completed within 3 days, and the longest shall not exceed 5 days;
2) In the case of a serious injury accident, the investigation and handling shall be completed within 4 days, and the maximum shall not exceed 6 days.
3.6. Strictly implement the principle of "four don't let go" when handling the accident, find out the accident process, analyze the cause of the accident, find out the person responsible for the accident, according to the severity of the accident and the size of the person responsible for the accident, in accordance with the provisions and the relevant provisions of the superiors, the accident investigation team puts forward the handling opinions and accident prevention measures for the person responsible for the accident.
1) Accident liability analysis:
Based on the facts confirmed by the accident investigation, the direct and indirect responsibilities of the accident are determined through the analysis of the direct and indirect causes.
Direct Liability: Any responsibility for the direct cause of the accident is direct liability.
Indirect liability: Responsibility for indirect causes of unsafe behavior of people and unsafe state of things is indirect liability.
2) When determining the responsibility of the person responsible for the accident, the principle of "one accurate and two corresponding" should be followed, that is, the violation and illegal accident of the person responsible for the accident should be clearly and accuratelyThe violations and violations of the law of the person responsible for the accident correspond to the identified responsibility, and the identified responsibility corresponds to the suggestions for handling it.
There are four categories of persons who are directly responsible and indirectly responsible: those who are directly responsible, those who are primarily responsible, those who are important responsible, and those who are generally responsible.
Direct responsibility: mainly refers to on-site operations and command personnel. It can be divided into those who are directly responsible, those who are primarily responsible, those who are important and those who are generally responsible.
Indirect liability: mainly refers to managers at all levels. It can be divided into on-site management responsibility, department management responsibility, and leadership responsibility.
The management responsibilities of the department can be divided into: those who are directly responsible for management, those who are responsible for important management, and those who are responsible for general management.
3) The principle of separation of accident responsibility:
1) If the accident is caused by one of the following circumstances, the relevant personnel at the scene shall be held directly responsible or mainly responsible:
The hidden danger investigation is not in place, and the rectification is not in place;
Dereliction of duty, violation of laws and regulations, safety responsibility system;
Critical situations are neither reported nor measures taken;
Unauthorized alteration, demolition, destruction, or misappropriation of safety warning signs and safety protection equipment.
2) If an accident is caused by one of the following circumstances, the relevant management personnel or leaders shall be held responsible
Failure to carry out safety education and technical training and assessment for employees in accordance with the regulations, employees who have not passed the examination or do not know how to operate, and do not understand safety responsibilities;
Safety management is chaotic, safety rules and regulations are lacking or unsound, and employees have no rules to follow
Equipment and facilities are not overhauled or overloaded in accordance with regulations, and operate with illness;
Ignore the warnings of the *** department and do not eliminate potential safety hazards in a timely manner;
The school environment is unsafe or the safety protection devices are incomplete and defective, and corrective measures are not taken;
New construction, reconstruction, expansion projects and technical transformation projects are not subject to the "three simultaneous" provisions;
There are no safety responsibility requirements and corresponding measures in the implementation of various economic contracting responsibility systems;
Failure to withdraw, use or divert security fees in accordance with regulations;
Failure to take corrective measures for the hidden dangers that have been discovered, or failure to take effective safety measures after the accident has occurred, resulting in the recurrence of the accident
The safety organization is not sound, and the school is not equipped with full-time and part-time safety management personnel according to the regulations
11. Poor on-site management and inspection, or work errors
12. Violation of the relevant provisions of safety duties;
13. There are design errors or design regulations are violated during construction, and safety and health facilities are reduced
3.7. In the event of a minor injury accident, the person responsible for the accident shall be dealt with as follows (the school fine for personal accident shall be implemented according to the upper limit):
1) The on-site personnel shall be dealt with according to the following provisions:
1) For those directly responsible for the accident, the school will be fined 400-600 yuan according to the severity of the circumstances
2) The main person responsible for the accident shall be fined 300-500 yuan according to the severity of the circumstances
3) For those who are important responsible for the accident, the school will be fined 200-400 yuan according to the severity of the circumstances
4) For those who are generally responsible for the accident, the school will be fined 100-200 yuan according to the severity of the circumstances
5) In addition to the school fine, the first person responsible for the accident should also be inspected at the accident analysis meeting.
2) The leaders, technical and management personnel of the relevant departments who are responsible for management shall be fined 300-400 yuan according to the severity of the circumstances.
3.8. In the event of a serious injury, the person responsible for the accident shall be dealt with as follows according to the severity of the circumstances (the school fine for personal accidents shall be implemented according to the upper limit):
1) The on-site personnel shall be dealt with according to the following provisions:
1) Those directly responsible for the accident shall be fined 800-1000 yuan according to the severity of the circumstances;
2) The main person responsible for the accident shall be fined 600-800 yuan according to the severity of the circumstances;
3) For those who are important responsible for the accident, a fine of 400-600 yuan will be given according to the severity of the circumstances
4) For those who are generally responsible for the accident, a fine of 200-400 yuan will be given according to the severity of the circumstances
5) In addition to the school fine, the first person responsible for the accident should also be inspected at the staff meeting of the department.
2) The department leaders shall be dealt with according to the following provisions:
1) For those who are directly responsible for management (including those with technical responsibility), a fine of 400-600 yuan will be given according to the severity of the circumstances
2) For those with important management responsibilities (including technical responsibilities), a fine of 200-400 yuan will be imposed according to the severity of the circumstances
3) For those who are responsible for general management (including those with technical responsibility), a fine of 100-200 yuan will be given according to the severity of the circumstances
3) The personnel of the relevant departments who have direct business management responsibilities shall be fined 300-700 yuan according to the severity of the circumstances.
3.9. In any of the following circumstances, the relevant leaders and directly responsible personnel shall be fined an additional 1,000-5,000 yuan, or a higher level of punishment.
1) Concealing or failing to report accidents, making false reports, or deliberately delaying the reporting period;
2) After the accident, intentionally destroying the scene of the accident;
3) Obstructing or interfering with the normal conduct of the accident investigation;
4) Refusing to accept the accident investigation without justifiable reasons, or refusing to provide accident information or information;
5) After the accident, the rescue is not actively carried out or the rescue is not effective, so as to increase the loss of personnel and property;
6) In the investigation of the accident, deliberately shirk responsibility, conceal the truth of the accident, deceive, and even blame others;
7) Failure to conscientiously learn the lessons of the accident and take measures to cause similar accidents to recur.
3.10. The following provisions shall be implemented for the assessment of relevant personnel in the process of accident reporting, investigation and handling:
1) After the accident, the safety administrator and the personnel on duty who do not report according to the prescribed time and requirements shall be fined 200 yuan;
2) The person responsible for not participating in the accident analysis meeting without reason shall be fined 200 yuan, and the person who is late shall be fined 100 yuan;
3) The responsible personnel who fail to complete the accident handling work within the specified time shall be fined 100 yuan for each day of delay;
4) Those who do not cooperate with the accident investigation, or delay, evade, make things difficult, or even mess around, will be fined 200-1000 yuan.
3.11. Preparation of accident investigation report.
The accident investigation report shall include the following contents:
1) Overview of the unit where the accident occurred;
2) The accident occurred and the accident rescue situation;
3) Personnel and direct economic losses caused by the accident;
4) the cause of the accident and the nature of the accident;
5) Identification of accident responsibility and suggestions for dealing with the person responsible for the accident;
6) Accident prevention and corrective measures.
3.12. Establishment of accident management ledger.
1) Safety management office, academic affairs, office and other departments at all levels should establish accident files, and the safety department should organize and register and keep the accident data. All accident investigation and analysis materials, such as: on-site inspection and processing records, on-site photography (images), technical appraisal, analysis and testing, meeting records, instrument records, physical evidence, human witnesses and accident fact materials, comprehensive investigation materials and registration forms, reports, accident drawings, etc., should be properly kept.
2) The major accident registration form should indicate the name, location, cause, injury, operation summary, accident overview and accident analysis diagram of the accident unit.
