The troubles of the takeaway "single king".

How to balance the convenience of residents, the work efficiency of delivery workers and the safety and order of the community has become a difficult problem to be solved

Sun Ping, who was born in 2003, is 20 years old this year, and has become the "single king" of Ele.me (Vanke Station) in half a year after entering the industry, with more than 2,200 orders per month and a delivery punctuality rate of 9967%, with a monthly income of more than 20,000 yuan. Talking about his "achievements", Sun Ping is quite proud, but he also bluntly said that "Shan Wang" also has troubles at work.

Takeaway delivery is like "upgrading and fighting monsters", you have to grab orders, wait for meals, climb the stairs, can't sprinkle, can't be cold, can't overtime ......The reporter recently interviewed some delivery workers and talked about the "troubles" they encountered at work, and they invariably mentioned the situation that "the community prohibits delivery workers from riding bicycles".

A delivery man parked his electric car outside the community and waited for the property to be released. Photo by Jiang Anqi.

Turn on the "rampage mode" at any time and often eat "closed-door soup".

After delivering this order, you can go to breakfast. At 9 o'clock in the morning, Sun Ping had already delivered 8 takeaways. According to the habit, he would send 8 to 10 orders a day to "warm up" before going to breakfast. After the body has taken in enough calories, Sun Ping is also ready for a busy day.

Sun Ping has to run around the island city for 13 hours a day, starting at 7 a.m. and continuing until 8 p.m. In order to make the best use of his time, he did not dare to take an extra sip of water during the delivery of the order and tried to minimize the frequency of going to the toilet.

This order of takeaway in hand will be delivered to Zhonghai Qingjiang Huafu Community in Shibei District. Standing in front of the community and receiving the signal of the property that "the car should be parked outside", Sun Ping quickly parked the vehicle on the sidewalk at the entrance of the community. At the suggestion of the property, he walked quickly into the community.

There are only 6 minutes left in the delivery time, and it must be delivered in time, and overtime is equivalent to 'doing it in vain'. Sun Ping said as he quickened his pace. In winter, he wears a simple windproof jacket, thin wool pants, and sneakers, which are convenient for him to turn on the "rampage mode" at any time. Following the guidance of the mobile phone software, Sun Ping found the corresponding distribution building among the 18 buildings with similar appearances in the community, and spent two minutes waiting for the elevator, which was very thrilling to arrive before the timeout.

Nowadays, many communities in Qingdao do not allow takeaway vehicles to enter, and we often eat 'closed-door soup'. Sun Ping told reporters, "Without an incubator, the food is easy to chill out."It is easy to lose food when the car is left outside, and it is not safe. ”

The reporter visited Mingdu City, Huanhai Garden, Xutai Garden Community in Shinan District, Jinling Shijia and Jinling Garden Community in Laoshan District, Guoxin Ziyuntai and Xiangying Garden Community in Shibei District, Zhongnan Century City Phase 3 in Licang District, Yuexiu Xinghui Blue Bay and other communities, and found that these communities are prohibited from entering by takeaway vehicles.

Almost half of the city's neighborhoods prohibit takeaway vehicles. Wang Junhui, the stationmaster of Ele.me (Vanke Station), said that in the case of not being able to ride into the community, skilled riders can better grasp the delivery time, while inexperienced novice delivery workers are easy to be fined for overtime.

The neighborhood where delivery vehicles are prohibited from entering is a headache for delivery workers. At the entrance of Yuexiu Xinghui Lanwan Community in Licang District, Ma Hao, a delivery man wearing a yellow Meituan delivery suit, had just finished delivering orders and sat on an electric car parked at the entrance of the community to check the next order information. Ma Hao told reporters: "We know which communities are not allowed to enter by bicycle, and no one wants to grab the list in those communities." The reporter learned that the "freelancers" in the delivery team crowdsourcing riders are unwilling to deliver the list, which will be forced by the system to be distributed to the delivery riders - delivery workers who have signed employment agreements with delivery companies.

Takeaway vehicles are prohibited from entering, and takeaway workers, property owners, and owners have their own opinions

Couriers, water delivery workers, broadband installers, postal workers and other life service personnel can ride in and out of the community, and owners can also ride electric vehicles in the community, but the property only prohibits delivery people from riding bicycles, which we feel is unfair. Sun Ping said.

During the visit, the reporter saw that many communities set up "takeaway vehicles are prohibited from entering" signs at the main entrances and exits, but also set up non-motorized carports at the entrance of the unit building, and there are also people riding electric vehicles in the community.

Properties have different voices about this. "Delivery people often ride too fast, which is a big safety hazard. Compared with other service staff, the number of delivery workers is large, and it is difficult to see 'familiar faces'. A property officer said.

The views of the owners are mainly divided into two categories: some owners believe that the delivery staff can ride in to deliver the food faster, and it is also convenient for the delivery staff to deliver the food; Some owners believe that there are many elderly people and children in the community, and the delivery man rides "on a rampage", which has a lot of potential safety hazards.

Some communities require takeaways and couriers to register real and valid identity documents when entering the community, and they can only enter after verification. At the entrance of the first Xiyue Tianhai Community in Licang District, the security personnel have an information registration form in their hands, and the takeaway personnel entering the community need to register their names, mobile phone numbers, delivery addresses and other information.

In October this year, when Zhang Chao, a delivery person, was "turned away" by the mini program when he delivered food in the first phase of Vanke Blue Mountain Community in Shibei District, and the takeaway was delivered overtime. "To register on the applet, the process is very cumbersome, you need to fill in the mobile phone number, get the verification code, enter the reason for registration, name, and take a picture of your own front**and takeaway**, a set of processes takes several minutes. Zhang Chao said. Recently, the reporter saw at the entrance and exit of the community that the above situation still exists, and outsiders still need to scan the code to log in to the applet to fill in the information, and obtain *** access after the audit is passed.

In the interview, the delivery workers said: "Some communities need to register information such as face** and ID number, which makes me feel uncomfortable", "These community properties may have over-collected our personal information, and I am worried that it will cause personal privacy leakage" ......

A property officer told reporters that the reason why the delivery staff was required to register their information was because they were worried that some criminals would disguise themselves as delivery workers to enter the community. The reporter saw on a number of e-commerce platforms that many stores were selling takeaway work clothes from Meituan and Ele.me, ranging from 20 yuan to 80 yuan.

Does the utility company have the right to prohibit takeaway vehicles from entering? The reporter learned from the Municipal Urban Administration Bureau that the "Qingdao Property Management Regulations" does not stipulate whether the delivery person can ride into the community, and the community can be implemented in accordance with the property service contract or adjusted according to the needs of the owner.

Liu Xiaohan, a lawyer from Shandong Deheng Law Firm, said that according to Articles 285, 937 and 942 of the Civil Code of the People's Republic of China, property service enterprises or other managers provide environmental sanitation and related order management and maintenance services for owners in accordance with the provisions of the property service contract according to the entrustment of the owners. If there is no relevant provision in the property service contract, the property has no right to make its own rules and regulations to prohibit takeaway vehicles from entering the community.

The interests of the community are fundamentally the interests of the owners, and the takeaway into the community is for the interests of the owners, and at the same time, the owners have the authority to evaluate the delivery staff. Takeaways should be allowed into the community, and the responsibility of food owners to supervise the delivery workers and the obligation to maintain the safety and order of the community should be strengthened. * Shen Jianfeng, a professor at the School of Law of the University of Finance and Economics, said.

Getting through the "last few hundred meters" requires the joint efforts of all parties

In recent years, the new industry dominated by food delivery has flourished, and the number of takeaway employees has increased significantly. At present, there are 84 million new employment workers in the country, of which 13 million are food delivery riders, accounting for 15% of the total number of new employment workers.

Recently, the State Administration for Market Regulation said in response to the proposal of the National People's Congress on strengthening the protection of the rights and interests of food delivery riders: it is necessary to improve the legal system for the protection of the rights and interests of workers in new forms of employment, and cooperate with relevant departments to accelerate the introduction of labor security laws and regulations applicable to workers in new forms of employment.

In order to make food delivery more convenient, some cities have launched useful explorations.

Some cities work "hardware". In a community in Lu'an, Anhui Province, the property of the community specially purchased 3 bicycles and placed them at the main entrance and exit of the community to provide delivery workers with "transfer", which not only alleviated the contradiction, but also ensured the safety of the community, which can be described as "killing two birds with one stone".

Some cities have broken the "identity registration barrier". Shandong Zoucheng Federation of Trade Unions assisted Meituan, Ele.me and other relevant outlet platforms to handle "one person, one permit" for takeaway delivery workers, and issued the first batch of 1,000 work permits for entering and leaving the community. For communities that require identity registration, delivery workers can enter without registration with a certificate, which effectively improves the efficiency of traffic.

Some cities have also adopted technical means to provide "all-round assistance" for delivery workers. In July this year, Tianjin Binhai New Area launched the self-developed "Riding Code Entry" APP, which can standardize rider behavior from identity authentication, speed reminders, track monitoring, illegal parking and other aspects. Riders can apply for a pass with their ID card and occupation certificate, and enter the delivery after scanning the community venue code. Riders must ride at a speed of less than 15 kilometers per hour in the community and ride according to the planned route. If the rider is speeding instantaneously, the rider will receive a reminder from the app, and behaviors such as continuous speeding, riding not according to the prescribed route, and evading monitoring will be suspended.

Delivery time is related to the safety and rights of every delivery person, and delivery platforms need to continuously optimize the delivery experience of riders. The reporter learned from Meituan that when riders encounter some abnormal scenes, such as: elevator difficulties during peak hours, and the community does not allow electric vehicles to enter, the platform will identify and predict the occurrence of such abnormal scenes from the perspective of orders, and make riders more comfortable to deliver meals through the method of "single stoppage time + system correction".At the same time, the platform will identify the delivery difficulty of the delivery address based on historical data, and provide time supplement for scenarios such as the rider contacting users, walking, detouring and other elevators, and giving a more reasonable delivery time.

Workers in new forms of employment need more care. According to the characteristics of workers in the new employment form, the Shibei District Federation of Trade Unions has established the Federation of Trade Unions in the logistics express delivery and takeaway industry to provide business skills training, free legal aid, mental health guidance and other services, so that the new employment workers have a stronger backing.

Opening up the distance of hundreds of meters from the entrance of the community to the hands of consumers not only involves the delivery interests of the delivery staff, but also the convenience interests of the owners, as well as the order and safety interests of the community, and it is necessary to design solutions on the basis of taking into account and balancing these interests. Shen Jianfeng suggested.

The focus of the controversy is how to balance the convenience of residents, the efficiency of delivery workers, and the safety and order of the community. At present, the introduction of intelligent security systems and the negotiation of reasonable delivery specifications with delivery workers are effective solutions to solve this problem. "Timely delivery" requires the joint efforts of all parties, and only by balancing the common interests can we make takeaway delivery "speed" and "temperature".
