Under the new EB-5 Act, a 32% quota, or approximately 3,200 visas, is set aside for certain types of EB-5 programs

Rural projects, 20% of the visa quota is reserved every year, about 2,000 visas;

High Unemployment Area Program: 10% of the visa quota is reserved every year, about 1,000 visa quotas;

National infrastructure projects: 2% of the visa quota is reserved every year, and about 200 visas are allocated

If the visa quota reserved for the current year is not fully utilized, the unused quota may be reserved for use in the same category of EB-5 program in the following fiscal year;

If the second year's visa reservation is not fully utilized, the unused quota will be released to all EB-5 applicants.

At the same time, the new law directs USCIS to prioritize EB-5 investor visa applications.

While the new policy is unfair to investors who filed their old EB-5 petitions before 2022, it is very beneficial to new applicants who are filing now.

Because of the new policy USCIS to be more humane and efficient, eligible applicants can make I-526 and I-485 "double delivery", and can also submit work authorization I-765 and travel document I-131 applications, after approval, they will get a COMBO card, which is equivalent to getting a "quasi-green card" in the United States, and can legally work in the United States and enter and exit the United States freely.

What is the "double delivery" favorable window period?

In the old EB-5 immigrant investor petition, the investor was required to file an I-526 immigrant petition and be approved before proceeding with a subsequent U.S. visa application, i.e., I-485.

The "double delivery" policy is a favorable policy that allows EB-5 applicants to obtain work authorization and re-entry permits in advance while their applications are being processed.

If the principal EB-5 applicant is in the U.S. at the time of filing the I-526, the applicant can file the I-485 petition at the same time as the I-526 petition and there is no backlog for the EB-5 program category, and the I-526 petition and the I-485 change of status petition can be filed at the same time, and the I-485 acknowledgment receipt can be legally present in the U.S.;

After filing the I-765 (Application for Employment Authorization) and I-131 (Travel Document) to obtain a COMBO card, you can legally work in the U.S. and travel freely in and out of the U.S.

This means that EB-5 applicants are allowed to be eligible to work and live in the U.S. in advance while their petitions are being processed.
