Law of the People's Republic of China on the Administration of Exit and Entry
Article 6The State shall set up entry-exit border inspection organs at ports open to the outside world.
Chinese citizens, foreigners and means of transport shall exit and enter the country from ports open to the outside world, and under special circumstances, they may exit and enter the country from places approved by the authorized departments of *** or ***. Exit/entry personnel and means of transport shall be subject to exit/entry border inspection.
The exit/entry border inspection authorities are responsible for the management of the restricted areas of ports. According to the needs of maintaining the order of exit and entry administration, the exit/entry border inspection authorities may carry out border inspection on the items carried by the exit and entry personnel. When necessary, the exit/entry border inspection authorities may carry out border inspection on the goods carried by the exit/entry transport vehicles, but shall notify the customs.
Article 82In any of the following circumstances, a warning shall be given, and a fine of up to 2,000 yuan may be imposed:
(1) Disrupting the order of the management of the limited area of the port;
2) Foreign seafarers and their accompanying family members have not gone through the temporary entry formalities and landed;
3) Boarding and disembarking a foreign ship without applying for boarding certificates.
Where the provisions of item (1) of the preceding paragraph are violated, and the circumstances are serious, they may be detained concurrently for between 5 and 10 days.
