Between February and July 2008, defendants Ning Mouxi and Zhang Mouzhu contracted Hou Moumou's iron ore mine (handled in a separate case) in Shimen Township, Wenxi County, Yuncheng City, and carried out destructive mining at two mine mouths, with a damage value of 27240,000 yuan, resulting in a large area of land and vegetation in the mining area was seriously damaged, and could not be reclaimed. After the Yuncheng City Land and Resources Department issued a notice to stop work, the defendants Ning Mouxi and Zhang Mouzhu continued to illegally mine ore.
Legal Terms
Paragraph 2 of Article 343 of the Criminal Law of the People's Republic of China is the crime of destructive mining. Whoever violates the provisions of the Mineral Resources Law by employing destructive mining methods to exploit mineral resources, causing serious damage to mineral resources, shall be sentenced to fixed-term imprisonment of not more than five years or short-term detention and shall also be fined.

Compared with illegal mining, destructive mining cases are relatively rare in practice, but for mining companies, they are easy to commit.
