OneParty ARightswithObligations
1. Party A contracts the kitchen to Party B for management and operation, and hires Party B as the head chef of the kitchen, and the employment period is one year, that is, from XX-XX-XX to YYYY-MM-DD, of which the probationary period is one month, that is, from YYYY-XX-DD to YYYY-MM-DD, and if you need to continue to hire after the expiration of the term, you must sign a separate agreement.
2. Party A shall ensure the quality of kitchen raw materials according to business needs.
3. Party A provides Party B with working meals and dormitories free of charge.
4. The total monthly salary of Party B is RMB, and the attendance salary of the previous month will be paid before the day of each month, and the total salary will be considered according to the business situation in the future.
5. After the probationary period, Party A and Party B shall set a reasonable business index according to the business situation, and if the business index is completed, Party B shall enjoy the existing salary, and the excess will be rewarded, and the salary shall be appropriately lowered if it is not completed.
6. Party A gives Party B a monthly off-duty, which is reasonably arranged by Party B without affecting the normal business, and Party B is not allowed to take a vacation when the work is busy.
7. Party A has the right to carry out daily management of Party B according to Party A's management system, and Party A has the right to punish Party B if Party B's personnel violate Party A's management system.
2. Party BRightswithObligations
1. Party B shall ensure that at least one person works in Party A's kitchen (including wok, chopping board, cold dish, pastry, and lotus), Party B's personnel need to be skilled to ensure the quality of the product, and require the head chef, the head pot and anvil to reach the national chef level, and other chefs must also reach the national level of the second chef.
2. Party B needs to do a good job in the cost control of the kitchen, and meet the requirements of Party A, and ensure that the gross profit margin is reached, if it does not reach or exceeds the specified gross profit margin, it will be deducted from the salary according to the difference (the difference in gross profit margin is greater than the total turnover of the vegetable gold).
3. Party B shall organize a weekly discussion meeting on dishes, and invite Party A's management personnel to participate, while ensuring the quality of dishes, constantly bring forth the new, launch Party A's brand dishes and signature dishes, and achieve new, strange, special and fresh (at least two new dishes will be launched every week).
4. Party B shall, in combination with holidays and Party A's special circumstances, launch seasonal dishes and festival dishes in a timely manner, and hold activities such as food festivals from time to time.
5. When the customer complains and returns the dish due to the quality problem of Party B's kitchen, the loss shall be borne by Party B.
6. Party B shall do a good job in food hygiene, if the guests are poisoned by food or punished by the epidemic prevention department due to Party B's management problems, Party B shall bear the loss; If Party A's kitchen fire is caused by Party B's management problems, Party B shall bear this responsibility and loss; Party B must strictly abide by the safety operation procedures to ensure safe production, if injured due to illegal operation, not only will not reimburse any expenses, but also will investigate Party B's responsibility.
7. Party B's personnel shall abide by Party A's management system, and if Party B's personnel are seriously derelict in their duties, engage in malpractice, cause significant damage to Party A's interests or seriously violate labor discipline and cause losses to Party A, Party A has the right to claim compensation from Party B and pursue legal responsibility according to law.
8. After Party B's personnel are employed by Party A, they are not allowed to work part-time.
9. Party B's personnel shall abide by Party A's work and rest time, take care of Party A's property, and keep Party A's business secrets.
10. Party B needs to pay ** and work deposit in RMB, the contract expires, and after Party B completes the resignation procedures, the deposit will be refunded together with the salary.
11. If both parties terminate this agreement, Party B can only leave after Party A finds a chef, otherwise all the consequences shall be borne by itself.
12. Party B must be in place before the month and day; Party B must cooperate with the purchasing staff to purchase raw materials in the market every day.
IIIMiscellaneous
1. Matters not covered in this agreement shall be settled through friendly negotiation between the two parties.
2. In the event of a labor dispute, Party A and Party B shall settle it through negotiation, and if they are unwilling to negotiate or fail to negotiate, either party may file a lawsuit with the people's court with jurisdiction in the place where Party A is located.
3. This agreement shall come into force on the date of signing.
4. This Agreement shall be executed in duplicate, one copy for each Party A and Party B, and shall have the same legal effect.
