U.S. Power of Attorney, Declaration of the Same Person, Additional Certificate, Domestic Real Estate Transfer

Case Strike:Ms. Yu is a Chinese resident in the United States who owns a property in China with her spouse in China. Currently, this property is on the market. Since Ms. Yu is abroad and cannot return to China to handle the relevant procedures in person, she hopes to prepare all the documents that need to be handled in advance to avoid delaying the transfer time after the property**.

First of all, Ms. Yu learned that she needed to apply for a power of attorney and apply for an additional certificate. In addition, if Ms. Yu becomes a U.S. citizen, she will now need to apply for an additional certificate of the same person in the U.S. Ms. Yu did not understand the specific meaning and function of this additional certificate.

On March 8, 2023, China acceded to the Convention on the Abolition of the Requirement for the Legalization of Foreign Public Documents (hereinafter referred to as the "Convention"). On 7 November 2023, the Convention will enter into force between China and the United States. From November 7, public documents issued by the United States within the scope of the Convention can be sent to Chinese mainland for use without the need for consular legalization by the United States and Chinese embassies and consulates in the United States.
