On December 19, Mr. Jiang Ping, a Chinese jurist, legal educator, former president and tenured professor of China University of Political Science and Law, passed away in Beijing at the age of 94. Jiang Ping, born in December 1930 in Ningbo, Zhejiang, is a famous Chinese jurist and legal educator, known as the "conscience" of the legal profession and the "eternal president" of China University of Political Science and Law.

On December 19, China University of Political Science and Law released an obituary. The obituary reads that the death of Mr. Jiang Ping is a great loss to China University of Political Science and Law, as well as to China's legal and educational circlesWe mourn Mr. Jiang Ping and deeply cherish the memory of Mr. Jiang Ping!

Luo Xiang, a professor at China University of Political Science and Law, wrote a Tibetan poem on his personal social platform to recall Jiang Ping, meaning "Jiang Ping has ruled the world through the ages".

In the eyes of Yan Jun, a doctoral student in Jiang Ping and a 2022 doctoral student at China University of Political Science and Law, his mentor Jiang Ping is a person who absolutely listens to his heart and only bows to the truth and not to the powerful. Yan Jun, who had previously taken the Ph.D. exam in Jiang Ping for three years, said that just like mountaineering, if you want to climb the top mountain, you must climb the top mountain.

He was in charge of the compilation of the Civil Code

He wrote an epitaph for Hugjiltu

Jiang Weilian is known as Jiang Weilian, and his ancestral home is Ningbo City, Zhejiang Province. Jiang Ping was born in Dalian on December 28, 1930, to a family of bank clerks, and his family moved to Shanghai in 1937 and to Peking a year later. Jiangping studied in Beiping Art and Culture Middle School in junior high school, and Chongde Middle School (now Beijing No. 31 Middle School) in high school. From 1948 to 1949, he studied Xi journalism at Yenching University. From 1951 to 1956, he was one of the first students to study in the Soviet Union at the Faculty of Law of Kazan University and Moscow State University. In 1956, he joined the Beijing University of Political Science and Law (the predecessor of China University of Political Science and Law) as a teacher.

From 1983 to 1990, Jiang Ping successively served as Vice President and President of China University of Political Science and Law, member of the Standing Committee of the Seventh National People's Congress, and Vice Chairman of the National People's Law Committee. His inscription "Rule of Law in the World" stands in large characters on the Jimen Bridge campus, which is Jiang Ping's lifelong ideal and has become the pursuit of Chinese legal scholars.

From 1988 to 1992, Jiang Ping served as Vice President of the China Law Society. On October 12, 2001, he was awarded the title of "Tenured Professor" of China University of Political Science and Law, and enjoyed the special allowance of ***.

Jiang Ping participated in the formulation of the General Principles of the Civil Law, served as the head of the drafting group of the Trust Law and the Contract Law, the person in charge of the compilation of the Civil Code of the National People's Congress, and the head of the expert drafting group of the Property Law, and also played an important role in the formulation of the Company Law, the Partnership Enterprise Law and other laws.

Jiang Ping has been crying out for "the sanctity of private rights" all his life. He once said, "There are two core issues in the 40 years of reform and opening up, one is the market, and the other is the rule of law, and the two complement each other." In Jiang Ping's view, as far as the rule of law is concerned, there are two tasks, one is to improve the legal system of the market economy, and the other is to restrain power. China's reforms need to constrain public power, otherwise it will not be possible to establish a market economy and protect private rights.

In September 2014, Jiang Ping pointed out in an exclusive interview with the Journal of the National Academy of Administration that the phenomenon of public power infringing on private rights is still quite common. How to keep public power in the cage of the system is one of the most pressing issues at present. Moreover, putting power in the cage of the system is not only an urgent need for the rule of law, but also a prerequisite for integrity. Only by keeping power in the cage of the system and restricting power can we solve the problem of corruption.

After the Hugejiltu case was rehabilitated, Jiang Ping wrote an epitaph for Hugejiltu, which reads: "A good judiciary is the blessing of the people. Huge's life is short, and his life is sad. It's a pity that there is no such blessing. However, those who hold judicial authority should be warned with their lives that they should weigh evidence and not make assumptions. Respect human rights, do not abuse power, and do not abandon the rule of law and justice for the sake of temporary political rights. ”

In December 2015, Jiang Ping pointed out in a lecture at Nankai University's law school: "The premise of governing the country according to law is to reverse the situation in which public law is too heavy and private law is too light. ”

After learning of Jiang Ping's death, Liu Guiming, deputy director of the editorial board and executive editor-in-chief of the "Rule of Law Era" magazine of the China Democracy and Legal Publishing House, who had been friends with Jiang Ping for many years, described Jiang Ping's life as "a life of preaching". He told the Red Star News reporter that whether he is a professor or a principal, whether it is in school or in the National People's Congress, whether it is in the classroom or in the forum, he is always calling and making suggestions. As he himself said, always shouting.

Yes, whether it is shouting, speaking, suggesting, or giving advice, they are all preaching for the rule of law. Therefore, what Mr. Jiang advocates is to preach, to impart legal knowledge, to disseminate legal theories, to convey legal thoughts, to convey the concept of the rule of law, and to inherit legal culture. ”

Jiang Ping, who has been "preaching" all his life, made such a self-evaluation when he was interviewed by Caixin at the age of 90. I did not say anything against my heart, but only bowed to the truth. He considers himself not a jurist in the true sense of the word, but a legal educator who cultivates a modern concept of the rule of law.

Doctoral students are admitted in full accordance with academic standards

It's useless for anyone to say hello

Jiang Ping wrote in 2010 that he reviewed his experience of teaching doctoral students in the past 20 years since he obtained his doctoral supervisor qualification in 1991. He said he obtained his qualification as a doctoral supervisor in 1991. By 2010, when I had recruited another class of Ph.D. students, I would have completed 20 Ph.D. classes. After serving as a tenured professor at China University of Political Science and Law, his main job is actually to take doctoral students. Looking back, there is an obvious feature of the doctoral students in the belt, there is no high-level ** in them.

Jiang Ping also mentioned in an article many years ago that among the 20 doctoral students he led, there were really diplomas mixed in it, or those who did not Xi study hard at the doctoral stage, and I dare not say that there are absolutely none, but they are indeed very, very few. Every time I think about this, I feel that my conscience is still very calm. "At least from the perspective of my major in civil and commercial law, the entrance examination for doctoral students, whether it is the original examination proposition, the revision of the paper, or the admission, is completely in accordance with the academic standards. From this point of view, I also have a clear conscience. ”

Yan Jun, Jiang Ping's doctoral student and a 2022 doctoral student at China University of Political Science and Law, told the Red Star News reporter that it is useless for Jiang Ping to recruit doctoral students and greet anyone. His personality and character are definitely commendable. "Mr. Jiang Ping recruits doctoral students, and what he values is whether you have the spirit of the rule of law and the ability to think independently. I took his Ph.D. exam completely because of his personality charm, I took the exam for three years, like mountaineering, if you want to climb the top mountain. ”

**Remembrance:

If he can not trouble others, he will not trouble others

When he was dying, he also proposed not to overdo medical treatment

Yan Jun was one of the last doctors Jiang Ping took during his lifetime. In Yan Jun's memory, Jiang Ping has always been so approachable. He still remembers that at 9 p.m. on April 19 this year, after attending the "Jiang Minmin Commercial Law Scholarship Award Ceremony" in the auditorium of the Changping Campus of China University of Political Science and Law, he and his senior brother sent the teacher home. It was about 10 o'clock in the evening, and they walked downstairs to Teacher Jiang Ping, but Jiang Ping insisted on not letting their brothers send him upstairs, saying that if they sent him again, he would not leave. "At that time, my brother and I stood where we were, watching the nanny push the teacher into the building in a wheelchair, and when we arrived at the gate, the teacher waved goodbye to us. ”

On another occasion, Yan Jun compiled a speech by his teacher entitled "Jiang Ping: Two Issues in Civil Law Translation". Yan Jun remembered very clearly that after Jiang Ping got the manuscript, he sat on the rattan chair and struggled to move to the sofa, Yan Jun hurriedly pushed the chair to the side of the sofa so that the teacher could revise the manuscript, but Jiang Ping waved his hand gesturefully, meaning that he could move over by himself.

Mr. Jiang is a person who can not trouble others, so he does not trouble others. Yan Jun said that Jiang Ping also adhered to this idea when he was hospitalized, and told his son not to overtreat when he was dying. "The leaders of the school all said that they would do their best to save the people. But what he meant was not to over-heal. ”

Yan Jun and his mentor Mr. Jiang Ping took a group photo on July 27, 2023.

The goodbye to the teacher seemed so sudden. This summer, Yan Jun also talked to Jiang Ping ** his own doctor ** "private rights are sacred" related topics. Subsequently, he went to a court in Jiangxi Province to take up a temporary post, on December 3 this year, Yan Jun returned to Beijing to visit Jiang Ping in the hospital, when Jiang Ping was still in a good mental state, in the ward, the two also ** the harvest of the temporary post and some academic problems. At that time, Yan Jun could not have imagined that this short meeting and exchange was the last meeting.

Lawyer Yi Jiangping:

After listening to the lecture, he was "treated" by Jiang Ping and took a taxi

He made up his mind to take the teacher's doctorate six times

Chen Bo, director of Beijing Pingshang Law Firm, spent 6 years studying for a doctorate and finally became Jiang Ping's doctorate.

Chen Bo has 10 years of work experience in grassroots police stations, patrol police teams, county public security bureaus, county party committees, and municipal political and legal committees, during which he obtained a master's degree in civil and commercial law from Guizhou University. And in 2004, he became the deputy director of the stability maintenance department of the Political and Legal Committee of the Municipal Party Committee. But the experience of listening to a lecture at the China University of Political Science and Law changed the trajectory of Chen Bo's life.

Chen Bo recalled that he had read a lot of Mr. Jiang Ping's works and his conversations before, and many words spoke to his heart, and he was full of yearning for Mr. Jiang Ping. In 2004, on a business trip to Beijing, Chen Bo saw the announcement of China University of Political Science and Law that Jiang Ping was going to speak at an academic newcomer competition award ceremony. He went to the auditorium of China University of Political Science and Law. "This was a very wonderful speech, the venue was crowded, and everyone had heartfelt respect and respect for Mr. Jiang Ping, which made me very moved. And the issue of the rule of law mentioned in Jiang Ping's speech at that time also made Chen Bo engrave it in his heart.

Recalling 19 years ago, it still feels like yesterday for Chen Bo. He still remembers that after the meeting, Mr. Jiang Ping went to the bathroom alone with his briefcase, and when he didn't find it, he asked his classmates where the bathroom was. I went up to help Mr. Jiang Ping carry the briefcase. When Jiang Ping came out of the bathroom, Chen Bo stepped forward and chatted with Jiang Ping familiarly. Chen Bo told Jiang Ping that he was either a student here, or had come to listen to his lectures. After chatting, when they were about to leave at the school gate, what surprised Chen Bo was that Jiang Ping actually took a taxi to take him, a stranger, back. In this way, they took a taxi together, one in the front and one in the back, and continued to chat about the rule of law and people's livelihood.

In this way, 19 years ago, because he was "treated" by Jiang Ping and took a taxi, Chen Bo got acquainted with Jiang Ping and left Jiang Ping's ** number. And this little episode changed Chen Bo's life path after that. This meeting with Jiang Ping made him decide to apply for Jiang Ping's graduate school. "My first impression of Mr. Jiang Ping had a great impact on me, and I set this goal in my heart. It's an unrealistic, unattainable goal, but I feel like it's a goal in my life, and if I become Dr. Jiang, I feel that I have no regrets in my life. ”

In 2005, Chen Bo bought a large number of Jiang Ping's books, and began to study Jiang Ping's articles. In order to have time to take the PhD, he even applied to work in the countryside. When the registration was approaching, Chen Bo was "weak-hearted" and still applied for other tutors with lower scores. But in the end, he was determined to take the exam for Jiang Ping's doctoral students. In 2006, Chen Bo quit his job and came to Beijing to join a law firm. From 2006 to 2011, Chen Bo continued to apply for Jiang Ping's Ph.D.

In 2008, Chen Bo resigned again and took the exam full-time, during which he also communicated with Jiang Ping many times to exchange legal issues. Every time, Jiang Ping always received him warmly.

Chen Bo and Mr. Jiang Ping took a group photo.

In 2011, Chen Bo Kaobo entered the interview stage. During the interview, Jiang Ping asked Chen Bo if he didn't pass the exam this time. Chen Bo said that he would not take the test and would support his family. At the end of the interview, Chen Bo felt that he was not playing well, and he was discouraged, thinking that there was no hope again. But the next day, he received a doctoral admission letter, and the name of his supervisor on the notice was Jiang Ping.

When I was taking the Ph.D. exam, Mr. Jiang Ping didn't dislike me because I had no power, no achievements, and no acquaintances. Every time I made an appointment to meet with Mr. Jiang, he basically agreed. Chen Bo has a deep sense of gratitude to his teacher, and in his opinion, his teacher Jiang Ping cares about him very much, and sometimes lets himself eat at home. I basically didn't bring gifts to my teachers, and occasionally I brought special products.

Chen Bo, who said that he "didn't want to die for Kaobo", said that he lived in very poor life at that time, when he was out of work, his wife had no job, and he was still with children. However, he received the meticulous care of his teacher Jiang Ping and his wife. At a birthday party in Jiang Ping, Chen Bo and the other students' sincerest hope was that "if there is an afterlife, we will be your students." ”

And Jiang Ping is obviously everyone's eternal teacher.
