What is a criminal record?

Illegal and criminal records refer to the following information on citizens' violations and crimes recorded and stored by public security organs:

1.Administrative decisions such as public security administrative fines, administrative detention, custody and education, custody and reeducation, compulsory isolation for drug rehabilitation, and orders for community drug rehabilitation;

2.Criminal punishment decisions such as public surveillance, short-term detention, fixed-term imprisonment, life imprisonment, death penalty, fines, confiscation of property, and deprivation of political rights;A crime has been constituted, and because the circumstances of the crime are minor, the procuratorate makes a decision not to prosecute, or the court makes an effective judgment to waive criminal punishment.

The Police Clearance Certificate is valid for 6 months. It is counted from the deadline for no crime stated on the notarial deed.

Article 4 of the Provisions on the Handling of Criminal Record Checks by Public Security Organs: Individuals may check their own criminal records, or they may entrust others to do the checks on their behalf, and the trustee shall have full capacity for civil conduct. Units may make inquiries into the criminal records of their incumbents or persons to be recruited, but shall comply with the provisions of laws and administrative regulations on prohibitions of employment. When administrative organs carry out administrative permits and grant professional qualifications, and notary offices handle criminal record notarization, they may check the criminal records of relevant persons in accordance with law. The relevant provisions on the inquiry procedure shall refer to the relevant provisions of the unit inquiry.

Criminal detention is a compulsory method adopted by the public security organs and people's procuratorates to temporarily deprive the current offender or major suspect of his or her personal liberty in the course of investigation of a case directly accepted by the public security organs or people's procuratorates when they encounter a statutory emergency.

The result of criminal detention does not necessarily constitute a crime, and if a major suspect is excluded from suspicion of a crime during the investigation during the detention period and does not constitute a crime, he shall be released and a certificate of release shall be issued. However, if the arrest is investigated by the public security organs, the arrest is approved by the people's procuratorate, and the people's court finally finds him guilty, a certificate of no crime cannot be issued.
