After watching several live broadcasts made by Wu Danhong and Xiong Da, I finally understood that although they must call it the rule of law, the rule of law they pursue is neither the rule of law that conforms to China's historical tradition and the reality of national conditions, nor even the Western-style rule of law that they advertise, but a rule of law in which everything is up to them. In their view, as long as they do not approve all the rulings of the judicial organs, they are "flawed" and "questionable", and they are unjust, false and wrongly decided cases.
They preach procedural justice and avoid substantive justice. Procedural justice is only the process requirement of litigation activities, and substantive justice is the ultimate requirement of litigation activities. Wu Danhong, Xiong Da and the like, however, oppose procedural justice and substantive justice, absolutize and dogmatize procedural justice, formalize and nihilize substantive justice, and put procedure above substance, in an attempt to turn serious legal proceedings into a play on words.
Wu Danhong and Xiong Da completely ignored that the core purpose of litigation activities was to "ascertain the facts and distinguish responsibilities", and instead regarded "protecting the defendants" as the core of all litigation activities. They regarded the bloody corpse of the victim as a mere number, and did not even admit that it had evidentiary value, otherwise they would not have said that the Lao Rongzhi case only had a confession and no physical evidence. They do not recognize the rights enjoyed by the victims and their families, and demand that the public procuratorate and the law cannot serve the people, but can only serve the defendants and lawyers, and that as long as they make a request, they must unconditionally meet it, otherwise it is a "violation of procedure." They completely disregarded the independent litigation status of the defender and the first person, and substituted themselves into the role of the parties, lost their objective and rational position, and even said extremely emotional remarks such as "willing to accompany Lao Rongzhi to death", and did not have the basic professional qualities that a lawyer should have. It is a person of this level who still thinks of himself as the emperor of the judicial circle, and wants to use his own standards as the standard for judging everything.
The rule of law that Wu Danhong and Xiong Da want is not the rule of law that the people need. What they demand is that all cases handled by the public procuratorate and the law must first be reported to them for instructions and handled in accordance with their opinions. They can insult, attack, and accuse with impunity. Should they have this privilege? What do netizens think?List of high-quality authors
