Chapter V: Grassroots Organizations

Article 25Enterprises, public institutions, organs, social organizations, and other basic-level units shall establish trade union organizations in accordance with law. Communities and administrative villages may establish trade union organizations. Proceeding from reality, it is necessary to establish regional and industrial trade union federations and promote the building of new economic organizations and trade union organizations in new social organizations.

Where there are 25 or more members, a basic-level trade union committee shall be established;Where there are less than 25 members, a basic-level trade union committee may be established independently, or a basic-level trade union committee may be jointly established by members of two or more units, and an organizer member or chairman of the trade union may also be elected to preside over the work of the basic-level trade union. Grass-roots trade union committees have more than 10 female members, and have female staff members, and less than 10 women have female staff members.

Trade unions in enterprises, public institutions, and social organizations with 200 or more employees shall have a full-time trade union chairman. The number of full-time staff of trade unions shall be determined through consultation between trade unions and enterprises, public institutions, and social organizations.

Where basic-level trade union organizations meet the requirements for legal persons as provided for in the Civil Code, they lawfully obtain the legal person status of a social group, and the chairman of the trade union is the legal representative.

Article 26The general meeting or representative meeting of the basic level trade union shall be held at least once a year. At the suggestion of the basic-level trade union committee or more than one-third of the trade union members, a general meeting or a representative meeting may be convened temporarily. Basic-level trade unions with less than 100 trade union members shall convene a general meeting of members.

The functions and powers of the trade union congress or the congress are:

1) To review and approve the work report of the grassroots trade union committee.

2) To review and approve the report on the income and expenditure of the basic trade union committee and the work report of the fund review committee.

3) Elect the grassroots trade union committee and the fund review committee.

4) Replace or remove the elected representatives or members of the trade union committee.

5) To discuss and decide on major issues concerning the work of trade unions.

The term of office of the grassroots trade union committee and the fund review committee is three or five years, and the specific term of office shall be decided by the general meeting or the member representative congress. At the end of the term of office, a meeting shall be convened as scheduled to conduct a general election. Under special circumstances, with the approval of the trade union at the next higher level, it may be held in advance or postponed.

The representatives of the member congress shall be permanent and shall serve the same term as the trade union committee of the unit.

Article 27The members of the basic-level trade union committees shall be elected on the basis of full deliberation and consultation by the members or their representatives;The chairman and vice-chairman may be directly elected by the general assembly or the member representative congress, or may be elected by the basic level trade union committee. The trade union committees of large enterprises and public institutions may, as needed for their work and with the approval of the trade union committees at higher levels, establish standing committees. The election results of the basic-level trade union committees, standing committees, chairmen, vice-chairmen, and fund review committees shall be submitted to the trade unions at the next higher level for approval.

Article 28The basic tasks of the grassroots trade union committees are:

1) Implement the resolutions of the General Assembly or the General Assembly and the decisions of the higher-level trade unions, and preside over the daily work of the grass-roots trade unions.

2) Represent and organize employees to participate in democratic elections, democratic consultations, democratic decision-making, democratic management and democratic supervision in their units in accordance with the provisions of the law, through the workers' congress, the disclosure of factory affairs and other forms, to protect the employees' rights to know, participate, express and supervise, and to implement the system of employee directors and employee supervisors in company-based enterprises. The trade union committees of enterprises and institutions are the working bodies of the workers' congresses, responsible for the daily work of the workers' congresses, and inspecting and supervising the implementation of the resolutions of the workers' congresses.

3) Participate in the coordination of labor relations and mediation of labor disputes, establish a consultation system with the administrative side of enterprises, institutions and social organizations, and negotiate and resolve issues involving the vital interests of employees. Help and guide employees to sign and perform labor contracts with enterprises, public institutions, and social organizations, sign collective contracts or other special agreements with enterprises, public institutions, and social organizations on behalf of employees, and supervise their implementation.

4) Organize employees to carry out labor and skill competitions, rationalization suggestions, skills training, technological innovation and technical cooperation and other activities, cultivate craftsmen and high-skilled talents, and summarize and promote advanced experience. Do a good job in the selection, commendation, training and management services of model workers and advanced producers (workers).

5) Strengthen political guidance and ideological education for employees, carry out publicity and education on the rule of law, attach importance to humanistic care and psychological counseling, encourage and support employees to learn Xi cultural, scientific, technological and management knowledge, and carry out healthy cultural and sports activities. Promote the construction of enterprise culture and employee culture, and do a good job in trade union culture, education and sports.

6) Supervise the implementation of relevant laws and regulations. Assist and supervise the administration to do a good job in wages, production safety, occupational disease prevention and social insurance, etc., and promote the implementation of employee benefits. We should do a good job in the collective welfare of employees, improve the lives of employees, and help employees in difficulty. Participate in the investigation and handling of production safety accidents and occupational disease hazard accidents in accordance with the law.

7) Safeguard the special rights and interests of female employees, and fight against discrimination, abuse, destruction, and the phenomenon of female employees.

8) Do a good job in the building of trade union organizations and improve the democratic system and democratic life. Establish and develop a contingent of trade union activists. Do a good job in the development, acceptance, education and membership management of members. Strengthen the construction of workers' homes.

9) Collect, manage, and make good use of trade union funds, and manage trade union assets and trade union enterprises and undertakings.

Article 29The trade unions of educational, scientific research, cultural, public health, sports, and other institutions and organs should proceed from the characteristics of the relatively concentrated concentration of intellectual laborers, actively understand and show concern for the ideology, work, and life of the workers, and promote the implementation of the party's policy on intellectuals. Organize staff members to do a good job in democratic election, democratic consultation, democratic decision-making, democratic management, and democratic supervision in their own units, so as to create good conditions for bringing into play the wisdom and talent of staff and workers.

Article 30According to the needs of work, grass-roots trade union committees can establish branch factories and workshops (departments) trade union committees. The trade union committees of branches and workshops (departments) are elected by the general meeting or member congress of the branch and workshop (department), and the term of office is the same as that of the grassroots trade union committee.

Basic-level trade union committees and branch and workshop (section) trade union committees may set up a number of special committees or special groups as needed.

Establish trade union groups in accordance with production (administrative) teams, democratically elect trade union group leaders, and actively carry out trade union group activities.
