In order to fight the battle to defend the blue sky and continue to improve the ambient air quality, the province has increased the law enforcement of behaviors such as improper operation of pollution prevention and control facilities and failure to implement emergency measures for heavily polluted weather after entering the special air protection period. Five typical gas-related cases are now announced, and it is hoped that the pollutant discharge units in the province will take this as a warning and consciously abide by the law.
1. A case of a rolling pipe company in Hengyang City failing to implement emergency measures for heavily polluted weather
Brief facts of the case:According to the department's "four noes and two directs" feedback problem, on September 3, 2023, the law enforcement officers of the Hengyang Municipal Ecological Environment Bureau found that the company had not implemented heavy pollution emission reduction measures five times in the past two years during the inspection of a pipe rolling company.
Investigation and Punishment:The above behavior violates the provisions of Article 17, Paragraph 2 of the Regulations on the Administration of Pollutant Discharge Permits. In accordance with Article 35 (2) of the Regulations on the Administration of Pollutant Discharge Permits and the Provisions on the Discretionary Discretion of Administrative Penalties for Ecological and Environmental Protection in Hunan Province (2021 Edition), the Hengyang Municipal Bureau of Ecology and Environment punished 5 violations on a case-by-case basis, with a total fine of 15520,000 yuan.
2. Case of a concrete company in Ningxiang, Changsha City, failing to implement emergency measures for heavily polluted weather
Brief facts of the case:On December 30, 2023, law enforcement officers of the Ningxiang Branch of the Changsha Municipal Bureau of Ecology and Environment found that the production line of a concrete company was still in production during a special law enforcement inspection of heavily polluted weather, and the suspension measures were not implemented in accordance with the requirements of the level of control.
Investigation and Punishment:The behavior may cause serious air pollution, Changsha Municipal Bureau of Ecology and Environment in accordance with the People's Republic of China Air Pollution Prevention and Control Law Article 30 and the environmental protection department to implement the measures for sealing, seizure of the first paragraph of Article 4 (6), the concrete production line to be sealed.
3. Case of failure to implement emergency measures for heavily polluted weather in a factory in Miluo, Yueyang City
Brief facts of the case:On December 29, 2023, the Miluo Branch of the Yueyang Municipal Ecological Environment Bureau found that the molded plate workshop of a door factory was still in production during a special inspection of heavily polluted weather, and the gas-related process shutdown measures were not implemented in accordance with the requirements of the level of control.
Investigation and Punishment:This behavior may cause serious air pollution, and the Yueyang Municipal Bureau of Ecology and Environment has sealed the molding production line (hot press, heat conduction oil furnace, boiler) in accordance with Article 30 of the Law of the People's Republic of China on the Prevention and Control of Air Pollution and Article 4, Paragraph 1 (6) of the Measures for the Implementation of Sealing and Seizure by the Environmental Protection Authorities.
Fourth, a building materials company in Yongzhou City did not implement emergency measures for heavily polluted weather
Brief facts of the case:On December 30, 2023, the law enforcement officers of the Yongzhou Municipal Ecological Environment Bureau found that the brick-making workshop of a building materials company was still in production during a special inspection of heavily polluted weather, and the gas-related process shutdown measures were not implemented in accordance with the control requirements.
Investigation and Punishment:This behavior may cause serious air pollution, and the Yongzhou Municipal Bureau of Ecology and Environment has sealed the production equipment in accordance with Article 30 of the Law of the People's Republic of China on the Prevention and Control of Air Pollution and Article 4, Paragraph 1 (6) of the Measures for the Implementation of Sealing and Seizure by the Environmental Protection Authorities.
5. Case of a forestry company in Zhijiang, Huaihua City, not operating pollution prevention and control facilities normally
Brief facts of the case:On November 7, 2023, when the law enforcement officers of the Zhijiang Branch of the Huaihua Ecological Environment Bureau inspected a forestry company, they found that the exhaust gas from the coal-fired boiler in use was directly discharged through the exhaust cylinder without installation of treatment facilities (other pollution prevention and control facilities were operating normally).
Investigation and Punishment:The act violated the provisions of Article 20, Paragraph 2 of the Law of the People's Republic of China on the Prevention and Control of Air Pollution, and the Huaihua Municipal Bureau of Ecology and Environment imposed a fine of 100,000 yuan on the company in accordance with Article 99 (3) of the Law of the People's Republic of China on the Prevention and Control of Air Pollution, and transferred the relevant responsible persons to the public security in accordance with the provisions of Article 63 (3) of the Environmental Protection Law of the People's Republic of China, and the public security department made a decision to detain the public security for 5 days on January 10, 2024.
