In the case, an Alaskan dog raised by Liu Moumou was in the built-up area and belonged to a large dog that was prohibited from being raised. 7-year-old Xu Moumou, who was playing in the community, was scratched by the dog, resulting in Xu Moumou's hospitalization**. The trial court held that, according to the provisions of the Civil Code, when a dangerous animal such as a fierce dog that is prohibited from being bred causes damage to others, the dog owner shall bear the strictest no-fault liability and has no right to defend to reduce or exempt the liability. Although the victim of Liu's dog raising was at fault, he still had to bear tort liability due to the violation of regulations for raising prohibited large dogs, including compensating Xu for his medical expenses.
The release of this typical case means that the legal liability for dog injuries will be clearer. Dog owners should be fully held accountable regardless of whether the victim is at fault or not, and this position is expected to encourage dog owners to be more cautious in the keeping and management of pets to ensure the safety and harmony of society.
