Patent intensive product identification

The State Intellectual Property Office has decided to start and carry out the identification of patent-intensive products year by year from 2023. The relevant identification matters for 2023 are hereby notified as follows:

1. Identification conditions.

1) Scope of Objects. The 2023 patent-intensive product recognition object is all patented products that have been reviewed and approved by the national patent-intensive product filing and identification pilot platform (hereinafter referred to as the pilot platform) before August 31, 2023, and are not restricted by the industrial field.

2) Data requirements. The filing information of the products participating in this certification should be the data information of 2022.

3) Evaluation benchmarks. The patent-intensive products identified this time should be products with high economic benefits and outstanding contribution to patent value with reference to the "Evaluation Method for Enterprise Patent-Intensive Products" (T PPAC402-2022), which meet the classification and evaluation standards of the products to which they belong.

II. Identification Procedures.

1) Filing and declaration. Enterprises participating in this patent-intensive product identification should submit a patent product filing application through the pilot platform before August 15, 2023. For products that have completed the filing but the information is in 2021 or before, the enterprise must update the product information to 2022 and resubmit the filing declaration.

2) Filing review. The State Intellectual Property Office instructs the pilot platform to review the product information for filing as required, and record it after the review is passed. The review will be closed on August 31, 2023, and products that have not completed the filing within the time limit will not participate in this identification.

3) Product identification. The State Intellectual Property Office will identify the patented products that have passed the review through the pilot platform, and if the conditions are met, they will be identified as patent-intensive products in 2023.

3. Support and guarantee.

1) Strengthen policy support. Implement the cultivation and promotion project of patent-intensive products, strengthen departmental coordination, promote the comprehensive development of patent product filing by demonstration enterprises with intellectual property advantages, specialized, special and new small and medium-sized enterprises, high-tech enterprises, and state-owned science and technology backbone enterprises, and give full play to the supporting and guiding role of procurement, finance, industry and other policies on patent-intensive products, and effectively promote the industrialization of patent products.

2) Encourage pilot exploration. Support qualified localities to actively carry out pilot explorations for the cultivation and promotion of patent-intensive products in combination with regional industrial characteristics, introduce supporting policies, promote the construction of a gradient cultivation system for patented products and patent-intensive products, and improve the support efficiency of patents for the high-quality development of the real economy.

3) Optimize tool support. Focusing on the objective evaluation of the actual contribution of patents in enhancing product competitiveness and added value, research and formulate national standards for the identification of patent-intensive products, and improve the standardization and scientificity of work. Accelerate the construction and upgrading of pilot platforms, strengthen the data base function of patent-intensive industry cultivation and monitoring and the improvement of patent industrialization, and provide a basic basis for optimizing various policies and evaluations for the creation, application and protection of intellectual property rights. Comprehensively use big data, artificial intelligence and other means to give play to the role of patent-intensive product filing and identification as an indicator tool to measure the contribution of patent value, enterprise innovation ability, industrial intellectual property autonomy, etc., and promote the inclusion in the national industry, science and technology and other related policy systems.

Fourth, the work requirements.

1) All local intellectual property management departments should increase the intensity of work organization, do a good job in guiding and mobilizing enterprises, strengthen departmental coordination, and promote key market entities such as intellectual property advantage demonstration enterprises and specialized, special and new small and medium-sized enterprises to achieve the filing of patented products as soon as possible, so as to ensure that enterprises normally participate in the identification of patent-intensive products and obtain relevant policy support. The State Intellectual Property Office will comprehensively evaluate and regularly report on the implementation of local patent transformation on the basis of the filing of patented products and the identification of patent-intensive products, combined with the data of patent ownership and invention patent ownership in various places.

2) Enterprises participating in the filing and identification of patent-intensive products shall ensure that the product filing information is true and accurate in accordance with the principle of honesty and trustworthiness. The State Intellectual Property Office will intensify the review of information through the pilot platform, and will notify the enterprises once they are found to have violated the rules such as fraud, and at the same time cancel the qualifications of enterprises to participate in the filing and identification of patent-intensive products and enjoy other policies.
