Preferential policies for small, medium and micro enterprises in the field of government procurement

In the procurement activities, the goods, projects or services provided by the first business meet the following conditions, enjoy the support policies for small and medium-sized enterprises:

1) In the procurement of goods, the goods are manufactured by small and medium-sized enterprises, that is, the goods are produced by small and medium-sized enterprises and the trade name or registered trademark of the small and medium-sized enterprises is used; (2) In the project procurement project, the project is undertaken by small and medium-sized enterprises, that is, the construction unit of the project is a small and medium-sized enterprise; (3) In the service procurement project, the service shall be undertaken by the small and medium-sized enterprise, that is, the personnel who provide the service shall be the employees of the small and medium-sized enterprise who have concluded labor contracts in accordance with the Labor Contract Law of the People's Republic of China. In the goods procurement project, the goods provided by the first business are both small and medium-sized enterprises manufacturing goods, as well as large enterprises manufacturing goods, do not enjoy the provisions of the small and medium-sized enterprise support policies. If all parties to the consortium participate in the procurement activities in the form of a consortium, and all parties to the consortium are small and medium-sized enterprises, the consortium shall be regarded as small and medium-sized enterprises. Among them, if all parties to the consortium are small and micro enterprises, the consortium is regarded as small and micro enterprises. The purchaser shall reasonably determine the procurement needs of the procurement project in the procurement activitiesThe registered capital, total assets, operating income, employees, profits, tax payments and other scale conditions and financial indicators of the enterprise shall not be used as the qualification requirements or evaluation factors of the first business, and shall not be usedenterpriseDifferential or discriminatory treatment shall be given to small and medium-sized enterprises in terms of ownership structure and years of operation.

In any of the following circumstances, it is not necessary to reserve procurement shares for small and medium-sized enterprises:

(1) Where laws, regulations, and relevant national policies clearly provide that priority is given to or shall be procured from public institutions, social organizations, and other non-enterprise entities; (2) Due to the need to use irreplaceable patents, proprietary technologies, infrastructure restrictions, or the provision of specific public services, it can only be purchased from ** businesses other than small and medium-sized enterprises; (C) in accordance with the provisions of these measures reserved procurement share can not ensure full competition, or there are circumstances that may affect the realization of the procurement objectives; (4) Framework agreement procurement projects; (E) other circumstances stipulated by the people's finance departments at or above the provincial level. In addition to the above-mentioned circumstances, all other situations are suitable for small and medium-sized enterprises. Percentage reserved for small and medium-sized enterprises:If the procurement quota is above the standard, the procurement of goods and services below 2 million yuan and the engineering procurement project below 4 million yuan are suitable for small and medium-sized enterprises, and the purchaser shall specifically purchase for small and medium-sized enterprises. If the procurement of goods and services exceeding 2 million yuan is suitable for small and medium-sized enterprises, more than 30% of the total budget of this part of the procurement project shall be reserved for small and medium-sized enterprises, of which the proportion reserved for small and micro enterprises shall not be less than 60%. For engineering procurement projects of more than 4 million yuan suitable for small and medium-sized enterprises, under the premise of adhering to the principle of openness and fair competition and unified quality standards, the reserved share is more than 40%, of which the proportion reserved for small and micro enterprises is not less than 60%. Deduction ratio for small and micro enterprises in procurement projects that have not reserved the share of small and medium-sized enterprises:For procurement projects that are not reserved for small and medium-sized enterprises after the overall planning of the competent budget unit, as well as the non-reserved part of the procurement package in the reserved share project, the purchaser and the procurement agency shall give 10%-20% (3% to 5% for the project) to small and micro enterprises that meet the provisions of these measures, and participate in the review with the deduction. If the bidding and bidding method is applied to the procurement engineering construction project, the comprehensive evaluation method is used but the low price priority method is not used to calculate the first score, and the bid evaluation shall be based on the original score of 3% to 5% of the score as its first score. Accepting a consortium between large and medium-sized enterprises and small and micro enterprises or allowing large and medium-sized enterprises to subcontract to one or more small and micro enterprises, and the contract share of small and micro enterprises stipulated in the joint agreement or subcontracting intention agreement accounts for more than 30% of the total contract amount, the purchaser and the procurement agency shall give a deduction of 4%-6% (1% to 2% for the project) of the consortium or large and medium-sized enterprises, and participate in the review with the deducted **. If the bidding and bidding method is applied to the procurement engineering construction project, the comprehensive evaluation method is used but the low price priority method is not used to calculate the first score, and the bid evaluation shall be based on the original score of 1% to 2% of the score as its first score. If there is a direct holding or management relationship between the small and micro enterprises that form a consortium or accept subcontracting and other enterprises and subcontracting enterprises in the consortium, they do not enjoy the preferential policy of **deduction. The proportion of deductions or points for specific procurement items shall be determined by the purchaser within the range specified in these Measures according to the average profit margin of the relevant industry and market competition of the subject matter of the procurement. Issuance of the "Small and Medium-sized Enterprise Declaration Letter".Small and medium-sized enterprises to participate in the procurement activities, should issue the provisions of the "small and medium-sized enterprise declaration letter", otherwise shall not enjoy the relevant small and medium-sized enterprise support policies. No unit or individual shall require the first business to provide the identity documents of small and medium-sized enterprises other than the "Declaration Letter for Small and Medium-sized Enterprises". Small and medium-sized enterprises introduce credit guaranteesEncourage all regions and departments to allow small and medium-sized enterprises to introduce credit guarantee means in procurement activities, and provide professional services for small and medium-sized enterprises in bidding (response) guarantees, performance guarantees, etc. Encourage small and medium-sized enterprises to finance through procurement contracts in accordance with laws and regulations.
