February** Dynamic Incentive Plan Foreign children who inherit domestic real estate need to follow the steps below to go through the relevant procedures:1Verification of kinship: A foreign child who applies to inherit a property in China needs to apply to a notary public in the country of residence for a notarial certificate proving the applicant's occupation, address and kinship with the deceased who has left a property in China. The notarial deed must also be authenticated by the embassy or consulate of the country where we live (except for the mutual exemption of legalization between the two countries according to the consular treaty), if the foreign children handle the notarized documents in a country that has no diplomatic relations with China, in principle, it must be authenticated by the embassy (consulate) of the country and the country and the country of a third country that has diplomatic relations with China.
Handle the notarization of real estate inheritance: The applicant shall apply for the formalities at the notary public where the property is located with the above-mentioned certified notarial certificate, the death certificate of the deceased, the will, etc. After reviewing the relevant documents, the notary public shall issue a certificate of inheritance to the house if it is deemed to be in compliance with the laws and regulations of our country.
Handle the inheritance procedures of the property: The applicant proves that the real estate management department where the property is located to handle specific inheritance matters. If the applicant cannot come to China in person to handle inheritance matters, he or she can entrust another person to handle the inheritance matters on his behalf. * When handling real estate inheritance matters, the person should also submit a power of attorney, which should indicate the name, address, and authority of the person and be signed and sealed by the client. The power of attorney shall also be notarized and authenticated in accordance with the regulations.
It should be noted that according to Article 9 of the Inheritance Law of the People's Republic of China, the right of inheritance is equal between men and women. Article 10, inheritance of the estate shall be in the following order: first order: spouse, children, parents. Second order: siblings, grandparents, maternal grandparents. After the inheritance begins, it is inherited by the first-order heirs, and the second-order heirs do not. If there is no first-order heir, the second-order heir shall inherit. The term "children" in this Act includes legitimate children, illegitimate children, adopted children and dependent stepchildren. The term "parents" in this Act includes biological parents, adoptive parents and dependent stepparents. The term "brothers and sisters" in this Law includes siblings of the same parents, half-siblings or half-siblings, adoptive siblings, and step-siblings who have a dependent relationship.
