Recently, Wang Ming (pseudonym), a consumer in Beijing, complained to Taishan Finance and Black Cat that his wife drove the Zhiji LS6 standard version of the car not long after purchase, and the intelligent driving system of the vehicle could not be exited during driving, and then triggered the AEB automatic emergency braking, resulting in being rear-ended by the rear car, and the car was seriously damaged.
At around 7 a.m. on January 5, my wife was driving in the rightmost lane of Beijing's 5th Ring Road, when the elevated NOA driving, which is the intelligent driving system of Zhiji Automobile, was activated. Wang Ming told reporters that during the drive, the driver observed a truck parked on the right parking strip, and the car's cargo box was partially pressed into the line, so manual braking was carried out.
What Wang Ming didn't expect was that after the manual braking, the vehicle's intelligent driving system did not exit. Just as the car slowly passed through the line of the cargo box of the truck, the car called the alarm and activated the AEB automatic emergency brake. Subsequently, the car came to a stop, causing a rear-end collision with the rear car, causing serious damage to the vehicle and minor injuries to the driver.
Of course, the car accident is solely responsible for the rear-end collision of the vehicle, but the intelligent driving system failed to exit after the driver applied the brakes, and the AEB automatic emergency brake was activated only after the vehicle was about to pass the truck. In Wang Ming's view, this is obviously a problem with the intelligent driving logic of Zhiji Automobile.
For this reason, Wang Ming contacted the headquarters of Zhiji Automobile several times to find out the cause of this technical problem, but did not receive a clear reply. In desperation, he could only choose to complain and defend his rights, hoping that Zhiji Auto would apologize officially, give a clear cause of the accident, unconditionally replace the same vehicle and pay in full for lost work and transportation expenses during vehicle maintenance.
After I started complaining, the Zhiji 4S shop that repaired the car contacted me, meaning that I should stop complaining, and if I complained again, the vehicle could not be determined as a total loss, but only as a car repair. Mr. Wang said.
Regarding whether Mr. Wang's statement is accurate, as well as the reasons why the intelligent driving system cannot be withdrawn, and whether there are potential safety hazards in the intelligent driving system of Zhiji Automobile, Taishan Financial Reporter interviewed Zhiji Automobile on February 20. A staff member who claimed to be the head of the customer service team said that the relevant problems have been recorded and will be fed back as soon as possible, but have not received a reply as of press time.
Ma Sicheng, a lawyer at Shanghai Duan and Duan (Jinan) Law Firm, told reporters that according to articles 1202 and 1203 of the Civil Code, if the car has product defects and causes personal or property damage, the manufacturer should bear tort liability.
If there is a logic or algorithm problem in the car's intelligent driving system, which causes the AEB emergency automatic braking system to be triggered incorrectly, resulting in a traffic accident, then the car manufacturer may need to bear the corresponding responsibility. Ma Sicheng said that under normal circumstances, the rear-end party should be fully responsible for violating traffic regulations, and after the rear-end party compensates, if the consumer believes that the auxiliary function of the vehicle is defective, he can claim recourse from the car manufacturer.
On February 23, Zhiji Auto publicly responded to the incident, saying that through multiple communications with the user and the retrieval of the background vehicle EDR data, the user used the NOA function to drive before the incident, and the system recognized that the vehicle on the right had encroached on the driving lane of the car, so it slowed down, and then the user pressed the brake pedal, and the system withdrew from the intelligent driving, and then was rear-ended by the rear vehicle. There is no fault such as "inability to exit the system such as intelligent driving" as stated by the user.
