Scribbling and depicting on urban buildings, facilities and trees shall be punished by the comprehensive law enforcement department of urban management. Paragraph 1 of Article 17 of the Regulations on the Governance of Urban Appearance and Environmental Sanitation (revised in 2017) stipulates that all units and individuals shall not scribble or depict on urban buildings, facilities and trees. Article 34, Paragraph 2 stipulates: in urban buildings, facilities and trees scribble, depicted or without approval to hang, post publicity materials, etc., the city people's ** city appearance and environmental sanitation administrative departments or their entrusted units in addition to ordering them to correct illegal acts, take remedial measures, may be given a warning, fines.
Scribbling or depicting cultural relics shall be punished by the public security organs or the unit where the cultural relics are located. Paragraph 2 of Article 66 of the 2017 Amendment to the Protection of Cultural Relics** stipulates that if the carving, defacement or damage to the cultural relics is not serious, or if the signs of the cultural relics protection units established in accordance with the provisions of Article 15, Paragraph 1 of the Law are damaged, the public security organs or the units where the cultural relics are located shall give a warning and may also impose a fine. Article 63 of the Law on Penalties for Public Security Governance (2012 Amendment) stipulates that anyone who commits any of the following acts shall be given a warning or a fine of not more than 200 yuan; where the circumstances are more serious, they are to be detained for between 5 and 10 days and fined between 200 and 500 RMB: (1) carving, defacement, or otherwise intentionally damaging cultural relics, places of interest, or historic sites protected by the state; (2) Violating state regulations by carrying out activities such as blasting or excavation in the vicinity of sites protected for cultural relics, endangering the safety of cultural relics.
