"Tadalafil" is a prescription drug that is prohibited from being added to food. Recently, the Fuqing court heard a case of selling food containing "tadalafil".
The Fuqing Court found out that the man Zhang learned through social software that Lin was selling a "brown sugar", which was advertised as a pure Chinese medicine ingredient and had an "aphrodisiac" effect.
Zhang bought 14 boxes of "brown sugar" from Lin, spending a total of 9,800 yuan. After taking "brown sugar", Zhang had an adverse reaction, and after being reminded by a friend, he commissioned a special agency to identify the "brown sugar", and the test results showed that the product contained "tadalafil", which would cause harm to human health.
After that, Zhang communicated with Lin many times to negotiate the issue of compensation, but to no avail, so he sued Lin to the court, demanding that Lin return the purchase price and pay ten times the amount of compensation.
During the trial, the Fuqing court found that "tadalafil" was in the list of illegally added substances issued by the State Food and Drug Administration, and it was a substance prohibited for use in food. According to the law, because Lin sold food containing "tadalafil" and may be suspected of a criminal offense, the Fuqing Court has transferred the relevant clue materials to the public security organs for investigation.
