A drunk man in Guizhou molested a woman while drunk and beat others to death, and the defender was found not guilty.
In the early morning of December 13, 2017, next to the East Railway Station in Xiaobi Township, Guiyang City, Guizhou Province, Ding Xiaoping, a drunken man, molested and beat women on the street. At about 9 a.m. that day, he did not wake up and was determined to have died of severe head injury.
Two months later, Tang Yinhua and Yang Chengxiang, who had fought with Ding Xiaoping, were criminally detained on suspicion of intentional injury. After the Guizhou Provincial High Court remanded for retrial, the Guiyang Intermediate People's Court still upheld the same judgment as the original first instance.
After the trial, the Guizhou Provincial High Court held that Tang Yinhua and Yang Chengxiang's actions were justified defense, and changed the verdict to not guilty. This incident has attracted widespread attention and has also sparked discussions about legitimate defense.
Some netizens believe that legitimate defense is a right granted to citizens by law, but in practice, there are some difficulties. If we can take legitimate defensive measures in a timely and accurate manner in the face of unlawful infringement, we can effectively protect ourselves and others.
However, if we exceed the necessary limit when taking measures of legitimate defence, we may be guilty of intentional injury. Therefore, how to accurately grasp the scale of legitimate defense in practice is an important issue before us.
At present, Tang Yinhua and Yang Chengxiang have been released, but the follow-up of this case is still ongoing, and we also expect the relevant departments to follow up in time and give a more just verdict.
