Measures for the management of safe construction sites of highway and water transportation projects
Chapter I: General Provisions.
First in order to strengthen the construction of highway and water transport projects safe construction sites, guide and encourage practitioners to strengthen work safety, the implementation of safety production responsibility, improve the level of safety management, in accordance with the People's Republic of China production safety law, construction project safety production management regulations, highway and water transport engineering safety production supervision and management measures and other laws, regulations and rules, these measures are formulated.
Article by law for approval, approval or filing of highway and water transport infrastructure of new construction, reconstruction, expansion projects during the construction period to carry out safe site construction activities, these measures shall apply.
Article 3 The term "safe construction site" in these measures refers to the project practitioner to implement the main responsibility of production safety as the core, and the construction process is aimed at risk prevention and control without dead ends, zero tolerance for accident hazards, and all-round safety protection, so as to promote the organic unity of safety and civilization on the construction site and the standardization and orderliness of construction operations, which is an important carrier for continuously deepening the development of safe transportation.
The term "practitioner" in these measures refers to the units engaged in the construction, construction and supervision of highway and water transport projects.
Article 4 The construction management of safe construction site mainly includes the audit of safety production conditions before the start of the project, the construction of safe construction site in the construction process, assessment and evaluation, etc.
Article 5 The Ministry of Transport guides the supervision and management of the construction of safe construction sites of highway and water transport projects nationwide, and is responsible for organizing the formulation of the guiding standards for the assessment and evaluation of safe construction sites of highway and water transport projects (hereinafter referred to as the "standards", see annex).
The Yangtze River Navigation Administration of the Ministry of Transport is specifically responsible for the supervision and management of the construction of safe construction sites of the Yangtze River Trunk Waterway Project.
The provincial-level competent department of transportation shall guide the supervision and management of the construction of safe construction sites of highway and water transport projects in the region, and organize the formulation of the supervision and management system and assessment and evaluation standards for the construction of safe construction sites of highway and water transport projects within their respective administrative areas.
The competent department of transportation (hereinafter referred to as the competent department of transportation under direct supervision) responsible for the supervision and management of production safety shall be specifically responsible for the supervision and management of the construction of safe construction sites of highway and water transportation projects within its jurisdiction according to the division of responsibilities.
Chapter II Construction Content.
Article 6 Highway and water transport engineering construction projects shall ensure safe production conditions, implement safety production responsibilities, establish a project safety production management system, realize safety management procedures, on-site protection standardization, scientific risk management and control, normalization of hidden danger management, standardization of emergency rescue, and continuous improvement.
Seventh highway and water transport projects shall have laws, regulations, rules and mandatory standards for engineering construction of the safety production conditions, and in the project bidding (bidding) documents, contract text, as well as construction organization design and special construction plans to be clear. Employing units shall ensure the necessary capital investment for the safe production conditions that the unit should have, and no unit or individual shall reduce the safety production conditions.
Eighth highway and water transport engineering project practitioners shall, in accordance with laws and regulations, formulate and improve the responsibility system for all employees in production safety, clarify the responsible personnel, scope of responsibility and assessment standards for each post, and publicize it. The results of the assessment of the safety production responsibility of the project leader of the construction and supervision unit shall be used as the content of the contract performance assessment and shall be submitted to the construction unit on a regular basis every year.
Nineth highway and water transport engineering project practitioners shall implement the laws, regulations and standards of production safety, focusing on the construction site and construction teams, strengthen the construction site layout, on-site safety protection, construction methods and processes, emergency response measures, construction safety management activities and other aspects of the standardization of production safety.
Article 10 Highway and waterway transport projects shall be subject to hierarchical management and control of safety risks. The project practitioner shall comprehensively carry out risk identification, carry out design and construction safety risk assessment in accordance with regulations, and improve the design plan, construction organization design, special construction plan and emergency plan based on the assessment conclusions.
The construction operation area shall, according to the results of construction safety risk identification and assessment, determine the management requirements of different risk levels, and reasonably lay them out. In areas with higher risks, safety warnings and risk notice boards should be set up, and risk warnings should be done or isolation measures should be taken. During the construction process, a dynamic risk monitoring mechanism shall be established to monitor, evaluate and warn as required, and timely grasp the status and change trend of the risk. Major risks shall be promptly registered and recorded, special management and control and emergency response measures shall be formulated, and strictly implemented.
Article 11 The investigation and management of hidden dangers of production safety accidents shall be normalized and closed. The project practitioner shall establish and improve the system for the investigation and management of potential accidents, clarify the contents of accident hazard investigation, notification (early warning), rectification, assessment and acceptance, reporting, reward and punishment assessment, and filing, and clarify the responsibility for the management of accident hazards step by step, and implement it to specific positions and personnel. In accordance with the regulations, the whole process of hidden danger investigation, registration, management, and cancellation shall be recorded, and the employees shall be notified.
Major accident hazards shall be reported to the competent department of transportation directly supervised within 5 working days after being determined, and if major accident hazards such as civil explosives, hazardous chemicals and special equipment are involved, they shall also be reported to the corresponding competent department.
Special plans shall be formulated for the rectification of major accident hazards to ensure that responsibilities, measures, funds, time limits, and contingency plans are in place. After the rectification is completed, the construction unit shall set up a rectification and acceptance team for accident hazards to carry out special acceptance, and experts may be organized to evaluate the treatment of major accident hazards. If the rectification and acceptance are passed, the construction unit shall report the acceptance conclusion to the competent department of transportation under direct supervision and apply for a cancellation number.
12th highway and water transport engineering practitioners shall, as required, develop the corresponding project comprehensive emergency plan, construction contract section of the special emergency plan and on-site disposal plan, and regularly organize drills. Establish a project emergency rescue organization in accordance with the law or designate emergency rescue personnel with certain professional ability to work part-time at the project site, and carry out professional training on a regular basis. Compile a list of emergency resources in combination with the actual project, equip the necessary emergency rescue equipment, equipment and materials, and carry out regular maintenance, maintenance and updating.
Chapter III: Assessment and Evaluation.
Article 13 The construction unit is the main body of the implementation of the construction of a safe site, and shall ensure that the safety production conditions of the project meet the requirements of the Standards, and when the safety production conditions of the project change, an application for review shall be submitted to the supervision unit in a timely manner.
After the start of the contract section and before the delivery and acceptance, the construction unit shall, in accordance with the requirements of the "Standards", carry out self-inspection and self-correction of the construction of the safe construction site at least once a month, and improve the weak links in safety management in a timely manner; Carry out self-evaluation at least once a quarter, and take targeted measures to improve indicators with a large number of deductions and recurring outstanding problems. The self-assessment report of the construction unit shall be submitted to the supervision unit.
14th supervision unit shall be safe site construction as the main content of safety supervision, the greater risk of sub-project before the start of the project in accordance with the requirements of the standard to carry out the audit of safety production conditions in a timely manner, and the audit results reported to the construction unit.
During the construction process, the supervision unit shall, in accordance with the requirements of the "Standards", supervise and inspect the construction management of the contract section of the contract section on a quarterly basis, and promptly supervise and rectify the problems found, and the contract section that still does not meet the requirements after rectification shall be ordered to stop work and report to the construction unit; If the circumstances are serious, a written report shall also be made to the competent department of transportation that directly supervises them.
Article 15 The construction unit is the main body of the assessment and evaluation of the construction and supervision of the contract section of the safe construction site, and shall establish a system of safe construction site construction, assessment, rewards and punishments, etc., and incorporate the construction of the safe construction site into the contract performance management, strengthen the process of supervision and inspection, and take overall responsibility for the construction of the safe construction site of the project.
The construction unit shall, in accordance with the requirements of the "Standards", organize a review of safety production conditions before the start of the project, organize a safe site construction assessment and evaluation of all construction and supervision contract sections of the project every six months, conduct a self-assessment of its own safety management behavior, establish corresponding assessment and evaluation records and archive them in a timely manner; The results of the audit of safety production conditions before the start of construction and the assessment and evaluation results of the construction of the safe construction site during the construction process shall be submitted to the competent department of transportation directly supervised by the construction management system of the safe construction site in a timely manner.
16th provincial-level competent departments of transportation shall clarify the main body responsible for the supervision and management of the construction of safe construction sites of highways and water transport projects at all levels in the region; Combined with the actual situation of the region, formulate the corresponding assessment and evaluation standard system.
17th local transport authorities at all levels shall, in accordance with the division of responsibilities, in the formulation of the annual safety supervision plan, should be the regional highway and water transport project safety site construction as a key content, each year within the jurisdiction of the highway and water transport project construction unit of the safe site construction management organization at least once supervision and spot checks, at the same time according to the construction unit submitted by the construction site construction assessment and evaluation, spot check a certain proportion of the construction, supervision contract section. The specific proportion of random inspections shall be determined by the provincial-level transportation authorities, but the minimum shall not be less than 10%. For projects with a construction period of less than one year, the competent department of transportation under direct supervision shall conduct random inspections at least once during the construction period. The frequency of spot checks should be increased for projects that are found to have potential dangers of major accidents. The focus of supervision and spot checks shall include the standardization of the assessment and evaluation of the project construction unit, the implementation of safety risk prevention and control and the investigation and management of potential accidents.
Article 18 The assessment and evaluation of safe construction site shall be calculated according to the 100-point system, and the assessment results shall be assessed as qualified if the assessment is 70 points or above, and the assessment shall be unqualified if the score is less than 70 points. The annual assessment results of the project shall be calculated according to the average value of the cumulative assessment results of the construction unit in the current year's assessment cycle.
The construction and supervision contract section shall be rectified in a timely manner if the first assessment is unqualified, and the construction unit shall organize a re-evaluation, and the re-evaluation of the construction and supervision contract section that is still unqualified shall be suspended for rectification, and shall be reported to the competent department of transportation under direct supervision in a timely manner. The contract section that has already occurred a major production safety liability accident, has been verified to have major potential accidents, and has been included in the safety production blacklist is directly assessed as unqualified.
The results of the annual assessment shall be uniformly publicized by the provincial-level transportation authorities.
19th directly supervised by the competent departments of transportation shall increase the supervision of the construction management of safe construction sites, for the existence of safe construction site construction in the form, assessment fraud, evaluation results are unqualified, etc., shall require the project construction unit to organize rectification, re-assessment, and in the information system to record, if the circumstances are serious, shall be circulated for criticism, interview the person in charge of the construction unit, the legal representative of the construction and supervision enterprise; For construction operations where there are major safety risks that are not effectively controlled and the hidden dangers of major accidents are not rectified in a timely manner, they shall be ordered to stop work for rectification and be listed for supervision; Units and personnel with violations of laws and regulations shall be given a negative credit record for production safety, and administrative punishments shall be imposed in accordance with law.
Article 20 The provincial-level competent departments of transportation shall regularly summarize and analyze the construction and management of safe construction sites in their respective regions, and take the projects with remarkable results in the construction of safe construction sites as typical examples, promote experience in a timely manner, increase publicity, and encourage them through credit points and other means.
Chapter IV: Supplementary Provisions.
Article 21 The Ministry of Transport shall establish a unified construction management system for safe construction sites of highway and water transport projects. The competent departments of transportation at all levels shall operate through this system for the results of supervision and random inspection of the construction site of the highway and water transportation engineering construction projects, the assessment and evaluation of the project construction units, and the public announcement. At the end of the first quarter of each year, the provincial-level transportation department shall fill in the supervision and random inspection of the construction of the highway and large-scale water transport projects in the region in the previous year and the assessment results through the safe construction site construction management system.
In the second quarter of each year, the Ministry of Transport announced the supervision and random inspection of the construction of safe construction sites of highway and large-scale water transport engineering construction projects in the previous year.
Article 22: These Measures shall come into force on May 1, 2018, and shall be valid for 5 years. The original notice of the Ministry of Transport on carrying out the assessment and evaluation of the "safe construction site" of highway and water transport projects (Jiao Jian Fa 2012 No. 679) shall be repealed at the same time.

Guiding Standards.
1. General Provisions.
1) In order to strengthen the safety production management of highway and water transportation projects, standardize professional behavior, implement safety responsibilities, further promote the construction and management of safe construction sites, and ensure the orderly development of the assessment and evaluation of safe construction sites, this standard is formulated.
2) This standard is mainly applicable to the assessment, evaluation and supervision and inspection of the construction of safe construction sites of highways and large-scale water transport projects. The provincial transportation authorities can formulate the corresponding assessment and evaluation standard system on the basis of this standard according to the characteristics of the project and the key points of supervision in the region, and on the premise of not changing the relative weight, the assessment content without "*" can be appropriately increased or decreased or refined.
3) The provincial transportation authorities may refer to the standard style, combined with the division of responsibilities and assessment requirements of the region, and formulate other technical levels of highway and water transport engineering safety site construction assessment and evaluation standards.
4) Highway and water transport engineering construction, supervision and construction units should refer to this standard to organize and carry out safe site construction and self-inspection, self-assessment, assessment and evaluation. Highway engineering traffic safety, mechanical and electrical, greening, housing construction and other contract sections and water transport projects in the road, yard, housing construction and other contract sections can refer to this standard, by the provincial transportation authorities to determine the corresponding assessment content.
2. Assessment and evaluation procedures.
1) The project construction unit is responsible for organizing the construction of a safe construction site, and after the start of the contract section and before the delivery and acceptance, it shall carry out self-inspection and self-correction at least once a month in accordance with this standard, and carry out self-evaluation at least once a quarter, and the self-assessment results shall be reported to the construction unit after being reviewed by the supervision unit.
Before the commencement of the project and the commencement of the sub-project with greater risk, the construction unit shall report the implementation of the safety production conditions agreed in the contract to the supervision and construction unit.
2) The project construction unit is responsible for the assessment and evaluation of the construction and supervision of the construction of the safe construction site of the contract section, and shall assess and evaluate the construction of all the construction and supervision contract sections of the project every six months in accordance with this standard, and conduct self-evaluation of its own safety management behavior.
Before the start of the project, the construction unit shall organize and carry out the audit of safety production conditions in accordance with the requirements of this standard, be responsible for the audit records and conclusions, and report the audit results to the competent department of transportation under direct supervision.
Before the start of the sub-project with greater risk, the supervision unit shall carry out the audit of safety production conditions in a timely manner in accordance with the requirements of this standard, and report the audit results to the construction unit.
C) the direct supervision of the competent department of transportation in accordance with this standard, combined with the annual safety supervision plan, every year within the jurisdiction of the highway and large-scale water transport project safety site construction management organization at least one supervision and spot check, at the same time according to the construction unit submitted by the construction site construction assessment and evaluation, spot check a certain proportion of the construction, supervision contract section. The specific proportion of random inspections shall be determined by the provincial-level transportation authorities, but the minimum shall not be less than 10%.
3. Assessment and evaluation methods.
1) The assessment and evaluation of safe construction site construction includes the verification of safety production conditions (Appendix 1), the assessment and evaluation of construction, supervision, construction and other practitioners (Appendix 2 to Appendix 5).
Verification of safety production conditions, including the checklist of safety production conditions before the commencement of the project (Appendix 1.)1) Checklist of safety production conditions before the construction of the sub-project with greater risk (Appendix 1.)2) Two parts.
The assessment and evaluation of the construction unit includes two parts: the basic management assessment and evaluation form of the construction unit (Appendix 2) and the construction site assessment and evaluation form of the construction unit (Appendix 3). Among them, the construction site assessment and evaluation shall be carried out by the general part (Appendix 3.).1) Professional part (highway engineering is Schedule 32. The water transport project is Schedule 33) Composed of two parts.
2) The assessment and evaluation adopts a point deduction system, and the upper limit of the deduction is the total score assigned to each assessment item. Among them, the assessment items marked with "*" are the index items that must be assessed.
3) Compliance rate of safety production conditions = compliance (compliance + basic compliance).
The safety production conditions are that the commencement of highway and water transportation projects shall meet the provisions of laws, regulations and technical standards, and meet the basic conditions agreed in the contract, and there shall be no non-conformities. Compliance with safety production conditions refers to the safety production conditions that meet the requirements of the contract and meet the requirements of laws, regulations and technical standards; The basic compliance refers to the overall satisfaction of the safety production conditions, but the degree of satisfaction needs to be improved.
The safety production conditions are composed of two parts: the safety production conditions before the start of the project and the safety production conditions before the construction of the sub-project with greater risk, among which, the safety production conditions before the construction of the sub-project with greater risk shall be reviewed by the supervision unit and confirmed by the construction unit in stages according to the construction progress; This part of the safety production conditions is dynamic, in the calculation of this part of the safety production conditions, to be combined with the construction unit to enter the inspection form to confirm the statistics one by one, in the supervision, the construction unit in the approval of the clear requirements of modification, improvement, should be regarded as the basic compliance of the item.
According to the degree of compliance with the safety production conditions during the assessment period, the corresponding score (interpolation method) will be deducted on the basis of the total score of the assessment and evaluation of the construction unit in the current period. When the compliance rate of safety production conditions is less than 60%, 10-30 points will be deducted depending on the circumstances; When the compliance rate of safety production conditions is between 60% (inclusive) and 85%, 5-10 points will be deducted depending on the circumstances; When the compliance rate of safety production conditions exceeds 85% (inclusive), no points will be deducted.

Fourth, the results of assessment and evaluation.
1) The assessment and evaluation of safe construction site construction shall be calculated according to the 100-point system, and the calculated score shall be accurate to 1 decimal place. The assessment results are divided into two categories: qualified and unqualified. Those with an assessment score of 70 points or more are qualified, and those with a score of less than 70 are unqualified.
B) the construction unit assessment and evaluation results are the assessment and evaluation results of the construction contract section, and the assessment and evaluation results of the supervision unit are the assessment and evaluation results of the supervision contract section.
If the project construction, construction and supervision work are organized by means of general construction contracting, PPP mode, etc., the assessment and evaluation of safe construction site construction management shall be carried out in accordance with the internal position positioning and division of labor of the project management agency.
3) All the construction and supervision contract section assessment and evaluation results are qualified, and the overall assessment and evaluation results of the project are qualified.
D) the construction and supervision of the contract section assessment and evaluation results are not qualified, the construction, supervision of the contract section shall be immediately rectified, after the completion of the rectification by the construction unit to organize a re-evaluation, re-evaluation is still unqualified construction, supervision of the contract section shall be all suspended for rectification, and timely report to the direct supervision of the competent department of transportation.
The contract sections that have occurred major production safety liability accidents, have major accident hazards that have not been rectified in time, and have been included in the safety production blacklist shall be directly assessed as unqualified.
5) In the event of a general or above production safety liability accident, the construction contract section with the main responsibility is directly assessed as unqualified, and the supervision contract section with direct responsibility is directly deducted 10 points on the basis of the assessment and evaluation score;
In the event of 2 general or 1 large production safety liability accidents, the supervision contract section with direct responsibility will be directly deducted 15 points on the basis of the assessment and evaluation score, and the construction unit will be directly deducted 15 points on the basis of the assessment and evaluation score.
6) The project has been suspended for rectification more than 2 times due to safety production problems, and has been criticized by the competent department, listed for supervision, administrative punishment, interviewed project legal person and enterprise legal person, or overdue implementation of written rectification requirements, or in the process of assessment and evaluation, it is found that there are obvious safety management loopholes, and the management of potential accidents is not effective and recurring, 5-15 points can be deducted according to the actual situation on the basis of the calculation score of the project.
