On the evening of July 3, 2023, when the defendant Song was driving an electric two-wheeled bicycle in the reverse direction to the accident section, he collided with an ordinary two-wheeled motorcycle driven by the plaintiff Fu, causing injuries to Fu and damage to the vehicle. The accident was determined by the Traffic Police Brigade of the Dangyang Municipal Public Security Bureau that the defendant Song was fully responsible for the accident, and the plaintiff Fu was not responsible. The plaintiff was hospitalized in the hospital for **7 days after his injuries. Later, because the two parties could not reach an agreement on the amount of compensation, the plaintiff sued the Dangyang Municipal People's Court to demand that the defendant Song and his guardian Song Jia compensate him for medical expenses, nursing expenses, lost work expenses and other losses totaling more than 30,000 yuan.
The focus of the dispute in this case is who should ultimately bear the tort liability for the accident. Defendant Song was injured in a traffic accident driving an electric bicycle, and he was fully responsible for the accident, so he should be liable for compensation to the plaintiff. However, because Song was under the age of 18 at the time of the accident, he was a person with limited civil capacity, so his legal guardian Song Jia should bear the ultimate liability for compensation. Accordingly, after the court's approval, Song Jia was ordered to compensate the plaintiff for economic losses of 26,30008 yuan.
