"Electronic scalpers" are infested, and how to cure the stubborn disease of ticket scalping.
The public security organs took real measures to rectify the chaos of scalping for profit
Editor's note. The cultural tourism market has recovered, the consumption potential has been released, and the "short supply" ticketing situation has given "scalpers" the opportunity to take advantage of the void to make profits. In addition to performance ticketing, "scalping" behaviors in the fields of public medical care and commodity trading have also had a negative impact on the market environment and public interests.
For a period of time, political and legal organs at all levels have continuously intensified their rectification efforts, taking multiple measures to carry out precise crackdowns on "scalpers", further compressing their living space, and better safeguarding public interests.
Do you have a front row ticket? All good location! On the evening of October 20th, the concert of a well-known singer was about to start, and the front of the Olympic Sports Center in Changzhou, Jiangsu Province was crowded, and the "scalpers" who scalped tickets were also active.
Don't move! The police. Two plainclothes policemen stepped forward, showed their IDs, and controlled the "scalpers" who were shouting and selling tickets. That night, the Changzhou Municipal Public Security Organ's multi-departmental and multi-police joint action continued to strengthen patrol prevention and control around the Olympic Sports Center and along the route, and dispatched a number of police forces to form a rectification "scalper" action team to severely crack down on the illegal acts of reselling tickets found on the spot, and arrested 26 suspects of ticket reselling, effectively maintaining the normal order of the ticketing market for performing arts activities.
The problem of "scalping" has always been a stubborn problem in the ticketing market. Since the beginning of this year, with the large increase in large-scale performance activities, the problem of "scalpers" scalping for profit has become more prominent, seriously infringing on the rights and interests of consumers and disrupting the order of the performance market. Based on this, local public security organs have intensified their efforts to crack down on relevant illegal and criminal acts, and strengthened law enforcement linkage with relevant departments, building a "firewall" of the ticketing system through means such as real-name system and technical crackdown, squeezing the space for illegal profit-making by "scalpers", and protecting the legitimate rights and interests of consumers and consumer experience.
Intensify the crackdown to eliminate hidden dangers.
Recently, the Cyber Security Brigade of the Changsha County Public Security Bureau of Hunan Province and the Xianglong Police Station found in their daily work that there are "scalpers" in the jurisdiction who illegally use network information to organize a large number of "sought-after" and "customer service" to buy popular performance tickets from second-hand **, and then resell them for profit.
The Cyber Security Brigade of the Changsha County Public Security Bureau and the Xianglong Police Station immediately organized police forces to carry out investigations, arrested 6 suspects in a community in Changsha County, seized 6 mobile phones and 2 computers involved in the case, and recovered more than 100,000 yuan of illegal profits.
According to the confession, the suspects Zhou and Zhou Mouyang saw the "business opportunity", and in order to make huge profits, they hired Peng, Shen Mouzhi, Shan, and Xia Mouchen to resell concert tickets from September this year, and their gang members bought popular concert tickets on major second-hand platforms, and then resold them on other platforms, with a total of more than 1,300 tickets sold and illegal profits of more than 100,000 yuan. At present, the suspect Zhou and other 6 people have been administratively detained and fined in accordance with the law.
In view of the prominent problems of "scalping" in commercial performances, events, and popular scenic spots in various places, the Ministry of Public Security organized a special crackdown this year to investigate 190,000 articles, more than 900 suspects were arrested, and 1 ticket of various types was seized20,000 tickets, interviewed and rectified a number of ticketing platforms, removed more than 300 illegal tickets, and intercepted more than 50,000 "scalper" accounts.
Article 52 of the Public Security Administration Punishment Law stipulates that anyone who forges, alters, or resells tickets, ferry tickets, airline tickets, theatrical performance tickets, sports competition tickets, or other valuable tickets or vouchers shall be detained for not less than 10 days but not more than 15 days, and may also be fined not more than 1,000 yuan;where the circumstances are more minor, they are to be detained for between 5 and 10 days, and may be concurrently fined up to 500 RMB.
Zhao Hua, an instructor of the patrol special police detachment of the Changzhou Municipal Public Security Bureau, said in an interview with the reporter of "Rule of Law" that some "technical scalpers" exploited loopholes and hoarded tickets by developing new ticket-grabbing plug-in softwareThe "scalpers" at the offline performance site are often mixed in the crowd, with strong mobility and high concealment. Such "scalping" behaviors have caused the current situation that it is difficult to identify, collect evidence, and punish illegal acts, which has brought harm to consumers and society that cannot be ignored, not only disrupting the market order of fair competition and open and transparent, but also bringing a greater economic burden to consumers due to inflated fares. In addition, "scalping" activities may also involve fraud, tax evasion and other criminal acts, which bring great security risks to the society.
According to Zhao Hua's analysis, if "scalpers" use software to help customers grab tickets and obtain illegal benefits, disrupting the normal order of ticket purchase, it may also constitute the crime of providing programs and tools for intrusion and illegal control of computer information systems as provided for in Article 285 of the Criminal Law. Consumers often provide their personal information to "scalpers" when seeking to rob on their behalf, and if "scalpers" illegally use their personal information or provide their information to others, it may constitute the crime of infringing on citizens' personal information.
Promote the implementation of real-name ticket purchase.
On December 13, the reporter logged in to an official ticketing platform, clicked on the ticket purchase link for a concert held in Beijing on December 30, and immediately popped up a prompt of "real-name viewing", which was marked in a conspicuous position "Please bring the ticket to fill in the certificate to verify the admission" and "After the ticket purchase is completed, the information of the audience cannot be changed".
The so-called "real-name system", that is, the person, card, face three-in-one, online ticket purchase to bind identity information, when entering the corresponding person to scan the ID card, but also to the camera to brush the face, to ensure that the ticket, card, face information is completely consistent, information mismatch will lead to admission failure.
The Ministry of Culture and Tourism and the Ministry of Public Security jointly issued a document in September this year, clarifying the implementation of a real-name ticket purchase and real-name admission system for large-scale performances with more than 5,000 people. Local public security organs, in conjunction with departments such as for culture and tourism, have organized ticketing companies and other relevant units to further promote the implementation of the real-name system for ticket sales by promoting measures such as the real-name system for ticket sales and the implementation of ID card checks at event sites.
In addition to the ticketing market, medical treatment** was once a key area of "scalpers". Public security organs in Beijing, Jilin, Guizhou and other places have set up fixed police rooms and equipped with fixed police officers in hospitals with a large number of medical visits to promote the advancement of policing, and increase the crackdown on illegal acts of "scalpers" hoarding and reselling, so as to create a safer and more orderly medical environment.
Strengthen technical support and promote standardization.
There is a special person responsible for the guidance on site, which is time-saving, convenient and reassuring. Not long ago, the newly installed access control identification system at the entrance of the vehicle management office of the traffic police detachment of the Changzhi Public Security Bureau of Shanxi Province has been well received by the masses who come to handle business.
In order to further optimize the business environment, the Changzhi public security organs have launched a special campaign to crack down on and rectify problems that undermine the business environment, such as "scalpers" and "black intermediaries". According to the action plan, the Changzhi public security traffic management department has installed an access control identification system in each business place to screen and authenticate the identity of business handling personnel, conduct key verification of suspects who frequently enter and exit business premises, strictly prohibit illegal intermediaries from entering, and set up a report box to collect clues on illegal intermediaries' violations of laws and regulations.
At present, most hospitals in China implement the real-name appointment system for medical treatment, which to a certain extent has improved the situation of "scalpers" grabbing and occupying numbers. Some criminals transferred to the Internet and became "electronic scalpers", hoarding and reselling accounts to make a profit. Recently, the Beijing public security organs, together with the Beijing Municipal Health Commission and other departments, focused on key hospitals, key departments, key sources, and key periods, and carried out a special action to prevent and crack down on "electronic scalpers" in hospitals.
In the special action, all relevant departments relied on network security technology to sort out the "electronic scalper" number grabbing scenarios and number grabbing methods, and used technology to counter technology and create a protective toolbox for "electronic scalpers" automatic tool generation, a large number of number grabbing and then transferringComplete the upgrading and transformation of the 114 appointment platform and the key hospital system, deploy network security protection tools, and make every effort to plug the system vulnerabilitiesComprehensive use of system background monitoring, security protection tool monitoring, security scanning, public opinion monitoring, collection of patient complaints and other means to ensure that the first time to find "electronic scalpers";Establish a "scalper library" shared by hospitals in the city, gather 114 platforms and key hospital scalper accounts, and share them with various ** platforms to form a working mechanism for joint prevention and joint punishment in the city.
Liu Junhai, a professor at the Law School of the Chinese People's University, believes that to cure both the symptoms and the root causes of "scalping" scalping, we need not only technology, but also system. Law enforcement departments and industry market regulation departments shall make good use, adequately, and fully use the authority granted by law for market access, administrative oversight, administrative punishment, and administrative guidance, strengthen supervision during and after the event, and strengthen the fight against and sanction scalping, so as to serve the healthy and sustainable development of the performance market. The organizers and performance units of the ticketing market shall make good use of the current Internet technology, strengthen the real-name system for online ticketing, safeguard the lawful rights and interests of consumers, and ensure the healthy and orderly development of the ticketing market.
