"Every case we handle is someone else's life. We must use 'reasonableness' to say 'legal reason' and be the transmitter of judicial temperature. This is Cui Miao, deputy director of the First Procuratorial Department of the Minhang District People's Procuratorate and second-level prosecutor, who has been in the procuratorate for 10 years.
Recently, Cui Miao won the title of "National Excellent Public Prosecutor" in the 8th National Procuratorate Top Ten Public Prosecutors and Outstanding Public Prosecutors Business Competition. From the millions of pension fraud cases to the shocking vicious cases, she has handled one difficult and complex case after another with the spirit of "nailing", let's take a look at the story of this post-80s prosecutor.
Behind the seemingly "caring" is fraud
The amount involved amounted to more than 400 yuan
Since entering the Minhang District Procuratorate in 2013, Cui Miao has passed her tenth year of probation, and she has to approve and handle 150 to 200 cases every year, including a pension fraud case that impressed her.

In July 2022, Uncle Ding, who lives in Minhang, went to the police station to report that he was defrauded of nearly 3 million yuan by his godson Pan to buy a house, "It turned out that Uncle Ding met Pan during a certain trip, and Pan gradually entered the life of Uncle Ding and his family through regular visits, door-to-door visits during the New Year's holidays, and greeting the elderly when they were hospitalized, and became the godson of the second elder." Cui Miao told reporters about the case.
But the good times did not last long, as the second elder's trust in Pan deepened, Pan began to borrow money from them under the pretext of business capital turnover, and Uncle Ding transferred more than 30 yuan to him. It happened that Uncle Ding's family wanted to buy a house, and Pan proposed that a new house with a market value of more than 2 million yuan under his name could be transferred to Uncle Ding at a low price, and the forged real estate certificate was shown to Uncle Ding: "I can sell this house to my godfather and godmother for 1.5 million yuan, and the money I underpaid should be repaid for the loan and interest lent to me before." ”
His sincerity touched the hearts of the old couple, and they quickly paid 1.5 million yuan and signed a contract for the sale and purchase of the house. Half a year later, Pan did the same and defrauded Uncle Ding of 1.29 million yuan for the purchase of the house. What they didn't know was that the real estate property certificates in their hands were all forged by Pan.
Later, when we sorted out the case, we found that in addition to Uncle Ding and his wife, the victims also included Aunt Xu, Ms. Gao, etc., and Pan used high-interest **, marriage fraud and other means to defraud 5 victims of a total of more than 400 yuan", Cui Miao said, "But Pan has a strong sense of anti-investigation, and refused to admit guilt after arriving at the case, which caused difficulties in the review of the case." ”
The suspect refused to admit guilt
It took months to sort out the facts of the case
It turned out that after realizing that these victims might report the case, Pan took away the forged real estate certificates and purchase contracts in advance, and deleted all the WeChat chat records after stealing the mobile phones of many victims. Not only that, on the condition of repaying the money, Pan tricked the victims into signing loan contracts with them for the purchase of the house, trying to cover up the fact of fraud with civil disputes.
Cui Miao, as the prosecutor in charge of the case, spent several months reviewing the data recovered from Pan's mobile phone, checking bank statements, reviewing witness testimony, forged real estate certificates, copies of the purchase contract, loan contracts signed between the victim and Pan, and other evidence, and repeatedly checked every fact and data, and since then the evidence chain has been perfected. Cui Miao said, "Each clue is like a piece of a puzzle, and only by collecting it can we further 'spell out' a complete chain of evidence." ”
In the end, Pan was sentenced to 14 years and 10 months in prison and fined RMB 404,000 for the crimes of theft and fraud, and the illegal gains were recovered in accordance with the law.
Cui Miao told reporters, "Nowadays, with the convenience of payment methods, we use contactless fraud, faster asset transfer, and more means of confrontation and investigation." "This also means that the period of evidence collection has become longer, and the trial of fraud cases has become more difficult.
This is both a challenge and a "new topic" for prosecutors. "Learning Xi is a lifelong thing, we must update our knowledge in a timely manner, our understanding is changing, and what remains unchanged is the responsibility of 'handling every case with high quality and efficiency'. Cui Miao said.
In response to pension fraud, she also reminded that the majority of the elderly should keep their eyes open, and never be blinded by small favors, and at the same time, family members should give more care to the elderly group to help them enhance their awareness of prevention.
The cold case file in our hands
Behind it is the vivid life of the person concerned
In recent years, in addition to fraud cases, Cui Miao has also participated in a number of key cases. For example, in 2020, in the case of Xia Moumou's malign force criminal group assigned by the Municipal People's Court, which she participated in, the criminal group took advantage of the dominant position of market management to dominate one party and oppress merchants, causing a very bad social impact.
It is this experience that makes her deeply realize the responsibility on the shoulders of the prosecutor, "Behind the cold case file in our hands is the vivid life of the client, and only by organically unifying the 'legal reason' in the trial of the case, can we become the prosecuter of the crime, the innocent protector and the defender of justice." Cui Miao said.
