In order to thoroughly implement the spirit of the 20th National Congress of the Communist Party of China, solidly promote the high-quality development of the construction industry, effectively ensure the quality and safety of projects and the safety of people's lives and property, standardize market order, and stimulate the vitality of enterprises, the following notice is hereby issued on further strengthening the examination and approval management of construction engineering enterprise qualifications.
1. Improve the efficiency of qualification approval. The competent departments of housing and urban-rural construction and relevant professional departments should actively improve the examination and approval mechanism for enterprise qualifications, improve the level of informatization of enterprise qualification review, improve the efficiency of examination and approval, and ensure that approval decisions are made on time. The Ministry of Housing and Urban-Rural Development is responsible for the examination and approval of enterprise qualifications, within 2 months to complete the expert review, public review results, enterprises can log in to the Ministry of Housing and Urban-Rural Development government service portal, click on the "application progress inquiry (acceptance and issuance of information inquiry)" column to inquire about the progress and results of the approval.
2. Unify the national qualification examination and approval authority. Since the date of implementation of this notice, the pilot areas with decentralized enterprise qualification approval authority will no longer accept pilot qualification applications, and will be implemented by the Ministry of Housing and Urban-Rural Development. Applications that have been accepted in the pilot areas shall be reviewed and approved within the prescribed time. The qualifications issued during the pilot period shall continue to be valid before the expiration of the qualification certificate, and the enterprise shall be suspended for rectification, reduce the qualification level, revoke or revoke the qualification certificate in accordance with the law, and shall be implemented by the competent department of housing and urban-rural construction in the pilot area.
3. Strengthen the approval of enterprise reorganization, division and merger qualifications. If an enterprise applies for qualification verification due to reorganization and division, it is necessary to assess the original enterprise and the qualification successor enterprise according to the qualification standards. If an enterprise applies for qualification verification due to a merger, it is necessary to assess the assets, personnel and relevant legal relationships of the enterprise.
Fourth, improve the methods of performance determination. From January 1, 2024, the performance of enterprises applying for qualification shall be entered into the national construction market platform. The application shall be carried out by the relevant professional departments in cooperation with the implementation of the enterprise qualifications, and the relevant professional departments shall be responsible for confirming the relevant performance.
5. Intensify the dynamic verification of enterprise qualifications. The competent departments of housing and urban-rural construction should improve the means of informatizationCarry out dynamic verification of enterprise registration personneland disclose verification information in a timely manner. After verification, if the enterprise does not meet the requirements of the qualification standards, it shall mark the qualification abnormality on the national construction market platform and rectify it within a time limit. If the enterprise meets the requirements of the qualification standards after rectification, the labeling shall be cancelled. During the labeling period, the enterprise shall not apply for the enterprise qualification license.
6. Strengthen the assessment requirements for qualification registration personnel of construction enterprises. Enterprises applying for first-class qualification for general construction contracting and first-class qualification for professional contracting, should be satisfied"Construction Enterprise Qualification Standards" (Jian Shi 2014 No. 159).The number of registered builders required and other indicator requirements.
VII. Strengthen credit management. The competent departments of housing and urban-rural construction shall increase the extent of punishment for enterprises and employees who violate laws, regulations or mandatory standards for engineering construction, such as fraudulent qualification applications, accidents with project quality and safety liability, and arrears of wages for migrant workers, and include them in credit records. When applying for qualifications, enterprises shall make commitments to the authenticity of the application materials such as the legal representative, actual controller, technical person in charge, project leader, and registered personnel, and authorize the competent department of housing and urban-rural development to verify information such as social security and tax payment.
8. Establish a system of correspondence and inquiry. The competent department of housing and urban-rural development may send a letter of inquiry to the enterprise on issues related to the qualification application, such as complaints and reports, application materials, etc., and the enterprise being consulted shall truthfully explain the relevant issues. After inquiry, if the enterprise admits that the content of the qualification application is untrue, it will be handled according to the refusal of permission.
IX. Strengthen responsibility for platform data regulation. The competent departments of housing and urban-rural construction should strengthen the supervision of the national construction market platform data, implement the responsibilities of the platform data entry auditors, and strengthen the verification of project and personnel performance information. The project information and data of the national construction market platform shall not be changed or deleted without authorization, and the data change records shall be permanently kept. The Ministry of Housing and Urban-Rural Development will spot check and review project information by means of on-site verification and remote sensing satellite monitoring, increase the intensity of handling false information, and pursue responsibility in accordance with relevant regulations.
10. Strengthen the building of a clean and honest party style. The competent departments of housing and urban-rural construction should improve the operation and restraint and supervision mechanism of enterprise qualification examination and approval power, strictly examine and approve procedures, strengthen the integrity education and supervision and management of examination and approval staff and qualification review experts, and establish and improve the accountability mechanism. Promote the intelligent examination and approval of enterprise qualifications, realize the traces of the whole process of examination and approval, and effectively prevent the occurrence of violations of laws and disciplines in the examination and approval of enterprise qualifications.
This notice will come into force on September 15, 2023. The Notice of the Ministry of Housing and Urban-Rural Development on Issues Concerning the Qualification Verification of Construction Engineering Enterprises in the Event of Reorganization, Merger, Division, etc. (Jian Shi 2014 No. 79), the Notice of the General Office of the Ministry of Housing and Urban-Rural Development on Carrying out the Pilot Project of Decentralization of Qualification Examination and Approval Authority of Construction Engineering Enterprises (Jian Ban Shi Han No. 2020 No. 654) and the Notice of the General Office of the Ministry of Housing and Urban-Rural Development on Expanding the Pilot Scope of Decentralization of Qualification Examination and Approval Authority of Construction Engineering Enterprises (Jian Ban Shi Han 2021 No. 93) shall be repealed at the same time. If the Notice of the Ministry of Housing and Urban-Rural Development on Simplifying Some Indicators of the Qualification Standards for Construction Enterprises (Jian Shi No. 2016 No. 226) and the Notice of the General Office of the Ministry of Housing and Urban-Rural Development on Doing a Good Job in the Reform and Convergence of the "Separation of Licenses and Licenses" in the Construction Industry (Jian Ban Shi No. 2021 No. 30) are inconsistent with the provisions of this Notice, this Notice shall prevail.
