On November 29, the Tianjin Municipal Market Supervision Commission, the Beijing Municipal Market Supervision Bureau, and the Hebei Provincial Market Supervision Bureau jointly issued the "Implementation Measures for the Management of Beijing-Tianjin-Hebei Food Business Licenses and Filings" to standardize the food business licensing and filing activities in the three places.
According to the relevant person in charge of the Hebei Provincial Market Supervision Bureau, in recent years, the food business field has developed rapidly, new formats have been emerging, and the original licensing measures have been difficult to meet the requirements of economic and social development. The market supervision departments of the three places jointly issued the implementation measures to achieve "colleagues with the same standard" in terms of unifying approval standards, simplifying the approval process, and optimizing approval services, which will help further optimize the business environment in the Beijing-Tianjin-Hebei region and stimulate market vitality, which is a beneficial practice for deepening regional coordinated development in the field of market supervision.
In terms of implementing the spirit of the reform of "delegating power, delegating power, delegating power, and improving services" and optimizing the business environment, the implementation measures make it clear that only the sale of pre-packaged food does not require a food business license. Where documents such as business licenses or other entity qualification certificates can be verified online, the applicant is no longer required to provide a copy. The statutory time limit stipulated in the Administrative Measures for Food Business Licensing and Filing of the State Administration for Market Regulation is 10 working days (from the date of acceptance of the application to the decision on whether to grant the administrative license), and the Measures compress the processing time limit to 5 working days. At the same time, the time limit from the decision to the issuance of the license has also been directly shortened from the statutory time limit of 5 working days to the on-the-spot issuance of the license.
In terms of overall development and safety, and optimization of food business licensing matters, the implementation measures clarify that only edible agricultural products are sold, pre-packaged food is sold, and small canteens with less than 30 diners (except schools, childcare institutions, childcare institutions, elderly care institutions, medical institutions, and construction sites) do not need to obtain a food business license. The food business project is divided into three categories: food sales, catering services, and food business management. In the category of catering services, the production and sale of semi-finished products is added, the production and sale of pastry food is deleted, and it is clarified that if food business operators engage in simple production and sales with low food safety risks such as thawing, simple heating, preparation, combination, plating, washing and cutting, the review requirements may be appropriately simplified on the premise of ensuring food safety. It is clarified that food operation and management includes food sales chain management, catering service chain management, catering service management, etc.
In order to help the sustainable and healthy development of new formats, new models and new technologies, the implementation measures stipulate that if you engage in food business activities through automatic equipment or only engage in food business management activities, you can carry out business activities within the scope of the license or filing in other business premises within the provincial administrative area after obtaining a food business license or filing for the record.
