Requirements for the labeling of chemicals registered and certified by the SGR countries of the Customs Union
29.The identification of chemical products should include the following information:
a) the name of the chemical identified by its identification (the name of the chemical may additionally include the name of ** (company));
b) the name of the manufacturer, the place (address of the legal entity), including the country, the manufacturer's ** number (authorized by this manufacturer), the importer of the chemical product;
c) the names of chemicals and mixtures of chemicals and mixtures of chemical products whose quantities exceed the concentrations specified in the standards listed in the list of international and regional (interstate) standards and, in the absence of national (state) standards, thus ensuring compliance with the requirements of this technical regulation;
d) storage conditions and the manufacturer's warranty obligations (shelf life, shelf life, etc.);
e) Documentation specifying the manufacture of chemical products under them, if any;
e) Information on the hazardous nature of chemical products, including warning labels.
30.The marking of chemical products issued on the customs territory of the Union must be applied in the Russian manner and in the legislation of the Member States in accordance with the corresponding requirements in the official language of the Member State in which the chemicals are sold.
31.The marking must be legible, resistant to mechanical stress, chemical agents, climatic factors, and should be kept until the chemical product is fully used and/or utilized (processed).
32.The marking of chemical products may contain additional information.
33.The marking of chemical products is applied directly to the packaging of the product or the label to which it is attached. The precautionary labeling elements should be distinguished from other information contained in the chemical product label and in accordance with GOST 31340-2013.
34.If there is not enough space on the package for marking, the chemical product shall be accompanied by a label or insert, and the information specified in paragraph 29 of these Technical Regulations has been issued in full.
8. Requirements for precautionary marking
35.Warning markings shall take the form of hazard signs, hazard signs, signal words, and shall describe the hazard precautions in accordance with the instructions of GOST 31340-2013.
9. Safety Data Sheet Requirements
36.The manufacturer (a person authorized by the manufacturer), the importer of chemical products who produce chemical products in the customs territory of the Union constitute a security passport.
Information on the properties of chemicals and mixtures contained in the Register of Chemicals and Mixtures may be used in the preparation of Safety Data Sheets.
37.Chemical Products**Safety Data Sheets must be included in the documentation accompanying the chemical product.
38.Security passports are issued before the release of chemical products in the customs field of the Union.
39.The information requirements that must be included in the Safety Data Sheet are specified in GOST 30333-2007.
40.The original of the Safety Data Sheet is kept by the manufacturer (authorized by the person's manufacturer), the importer of the chemical product.
41.There is no limit to the validity of the Safety Data Sheet.
42.SDS must be updated and republished when:
a) change the name and (or) address of the manufacturer (a person authorized by the manufacturer), the importer of chemical products;
b) change the composition of chemical products, reclassify them in accordance with paragraph 27 of this Technical Regulation;
c) Receive additional or new information that increases the integrity and reliability of the data.
43.At the request of the consumer (purchaser) of the chemical product, any interested registered legal person or individual as an individual entrepreneur as well as an individual, must have a copy of the Safety Data Sheet provided free of charge by the manufacturer (person authorized by the manufacturer) the importer of this product.
10. Ensure that chemical products meet the requirements of technical regulations
44.Chemical products that comply with the provisions of this technology meet its requirements.
45.Methods of research (testing) of chemical products are established in the standards listed in the list of international and regional (interstate) standards and, in the absence of national standards containing rules and methods for research (testing) and measurement, including the sampling rules necessary for the application and implementation of the requirements of this Technical Regulation and the implementation of conformity assessment of chemical products.
Ten.
1. New chemical notification.
46.By entering information from the Chemicals and Mixtures Register into new chemicals.
47.In accordance with the procedure established by the Eurasian Economic Commission, after the entry into force of this Agreement, the authorized bodies of the Member States (hereinafter referred to as the authorized bodies) notify new chemicals issued on the customs territory of the Union.
48.The information sent to the authorized body to notify the new chemical shall include:
a) Chemical safety reporting in accordance with the structure of Annex 3;
b) the name of the chemical named in accordance with the IUPAC, including in English;
c) the structural formula of the chemical;
d) CAS number;
e) Instrumental analysis of chemicals;
e) Purity of chemicals;
g) the intended use of the chemical;
h) the method of utilization (treatment) of the proposed chemical substance;
i) the mode of transport of chemicals and the measures taken to prevent and eliminate emergencies;
j) Analytical control methods;
l Chemical, physical, chemical data;
m) Chemical toxicity data;
n) Ecotoxicity data of chemicals;
o) A copy of the data (test) of the chemical tests (tests) carried out by the competent authorities in accordance with the laboratories (centers) confirmed by the legislation of the Member States (trials) for the determination of bioaccumulation, carcinogenicity, mutagenicity, toxicity. Research (testing) in other laboratories (centers) within 2 years from the date of entry into force of these Technical Regulations).
12. The chemical products meet the evaluation requirements of the technical regulations
49.Chemical products issued in the customs field of the Union are subject to conformity assessment.
50.The conformity assessment of chemicals that meet the requirements of this technical regulation shall be carried out in the following form:
a) Notice of State Registration;
b) State registration is permitted.
51.When notifying the State for registration and allowing the State to register chemical products, the applicant may register a legal person or an individual as an individual entrepreneur of the manufacturer (manufacturer's authorization) in accordance with the laws of the Member State in its territory, the importer of these products.
52.The notifying state registration and the state registration of permitted chemical products are carried out by the authorized body.
53.A notification of a national registration of a chemical is made if the chemical information is included in the Register of Chemicals and Union Mixtures and meets one of the following requirements:
a)Chemical products do not include banned and/or restricted chemicals and mixtures contained in the Register of Chemicals and Mixtures of the Union;
b) Chemical products containing chemicals and mixtures that are restricted to use, the information of which is included in the register of chemicals and mixtures of the Union, at concentrations below the limits specified in Annex 4.
54.For the notification of state registration of a chemical product for which a notification of state registration of a chemical product is issued, the applicant shall submit the following documents to the authorized body:
a) Notification of national registration of chemical products in accordance with the requirements of Appendix 5;
b) Safety Data Sheets issued in accordance with paragraphs 36-43 of these Technical Regulations;
c) studies (tests) carried out in testing (research) laboratories (centers) and (or) documentation containing information obtained from official information**. The Protocol for Research (Testing) of Chemical Products Included in the Union's Register of Chemicals and Mixtures and chemical products that can be classified using the calculation method are not submitted.
55.Notification of state registration of chemical products can be made electronically.
56.In order to carry out the notification of state registration of chemical products in accordance with the provisions of paragraph 55 of these Technical Regulations, the applicant shall submit the documents specified in paragraph 54 of these Technical Regulations to this authorized body in electronic form.
57.Consideration of documents submitted by the applicant in electronic form and on paper, adoption of a decision on the notification or rejection of state registration of chemical products, transfer of chemical products to an individual registration number, issuance of a notification of state registration of chemical products in accordance with ** N6, as well as notes on registration in electronic form shall be carried out by the authorized body within 10 working days from the date of receipt of the documents specified in paragraph 54 of this Technical Regulations.
There is no limit to the validity period of the chemical product notification state registration certificate and the registered trademark in electronic form
59.Licensed state registrations are made for:
a) New chemical products;
b)information in the Register of Chemicals and Mixtures of Chemicals containing restricted chemicals and mixtures in concentrations exceeding the limits specified in Annex 4 to these Technical Regulations.
