Located at the foot of Dabie Mountain, Hubei Paradise Lake National Wetland Park is a "Gaoxia Pinghu" type reservoir pond wetland, with a wide lake surface, clear water quality and rich aquatic germplasm resources, and was recognized as a national aquatic germplasm resources protection area for Paradise Lake by the former Ministry of Agriculture in 2014.
In July 2017, the General Office of Hubei Province issued the "Notice on the Implementation of the Comprehensive Ban on Fishing in the Aquatic Life Reserve in the Yangtze River Basin of Hubei Province", clarifying that the waters of Tiantian Lake in Jiuzihe Town, Luotian County are prohibited from fishing. In July 2020, the Hubei Provincial Procuratorate and the Hubei Provincial Department of Agriculture and Rural Affairs jointly issued the "Notice on Severely Cracking Down on Illegal Fishing", pointing out that it is strictly forbidden to use prohibited fishing gear, nets and fishing methods for fishingIllegal fishing in the Aquatic Life Reserve is strictly prohibited.
Accept a series of illegal fishing cases
From June to October this year, the Luotian County Procuratorate accepted six cases of illegal fishing in Paradise Lake using prohibited tools such as nesting boats and real bait and double-hook fishing tackle (with 7 or more hooks).
On the one hand, all six cases are suspected of constituting the crime of illegal fishing of aquatic products. On the other hand, the criminal suspect has a good attitude of confessing and repenting after being brought to the case, and the amount of fishing is small, and the degree of damage to the ecological environment is relatively light.
In order to improve the quality and efficiency of case handling, the Luotian County Procuratorate plans to deal with 6 criminal suspects including Wang for relative non-prosecution. Through internal coordination, the administrative procuratorial department intervened in advance, participated in the review, and did a good job of the "second half of the article" of non-prosecution with the reverse connection of execution. At the same time, in order to expand the legal effect of case handling and the social effect of legal popularization education, and enhance the public's awareness of the rule of law and the concept of ecological and environmental protection, the Luotian County Procuratorate decided to hold a centralized procuratorial public hearing on this series of cases.
Carry out public procuratorial hearings
On December 1, the first day of the "Constitution Publicity Week", the public hearing of the series of cases was held in the Hubei Paradise Lake National Wetland Park Ecological and Environmental Judicial Protection Base established by the Luotian County Procuratorate and the Luotian County Court.
Paradise Lake Wetland Park is not only the common wealth of all our Luotian people, but also an important resource for our future generations to recuperate. During the hearing, the prosecutor in charge explained the law with a case, explained the "ten-year fishing ban" policy in the Yangtze River basin to the people participating in the hearing, interpreted the meaning, constituent elements, identification and sentencing standards of the crime of illegal fishing of aquatic products, and guided the masses to deeply understand the damage of illegal fishing to the ecological environment, and shoulder the responsibility and obligation to protect the green mountains and clear waters.
We agreed not to prosecute the series of cases, and hope that Wang and the other six people will learn a lesson, fulfill their commitments, and abide by the law in their future life and work. "After the three people's supervisors learned the details of the case, they issued their hearing opinions.
After the hearing, the Luotian County Procuratorate made a relative decision not to prosecute Wang and the other six people in accordance with the law based on the facts and evidence of the case, combined with the hearing opinions.
Executions are reversed
Non-prosecution is not the same as non-punishment. At the same time, according to the review of the case, the administrative inspection department of the Luotian County Procuratorate issued a procuratorial opinion to the County Agriculture and Rural Bureau, believing that Wang and other 6 people engaged in fishing activities in the aquatic germplasm resources protection area, in violation of the "Fishery Law of the People's Republic of China", and recommended that they be given administrative punishment, and the results of the handling should be reported to the procuratorate in a timely manner.
The Agriculture and Rural Bureau accepted and adopted the procuratorial opinions, made a penalty decision in accordance with the law, and Wang and other 6 people paid the fine in full on the spot.
I accepted the handling of me by the procuratorate and the Agriculture and Rural Bureau, and through this publicity and education, I learned that fishing in Paradise Lake is illegal, and the fishing gear I use is a prohibited tool, and I will take the initiative to learn relevant legal knowledge in the future and promote this knowledge to fishing friends. Combined with the requirements of the 'Constitution Publicity Week', the school led the students to the scene to experience the procuratorial case, understand the possible consequences of illegal acts, and hoped that the students would seriously study the law and abide by the law in the future, care for the ecological environment, protect wild animals, and be defenders, practitioners and propagandists of the law.
