In September 2023, a case of fraud and illegal border crossing was transferred by the Hengshan County Public Security Bureau to the Hengshan County People's Procuratorate for review and prosecution. Defendants Huang Mouhuan and Yan Mouwei smuggled to Myanmar many times from February 2019 to June 2021, and defrauded fraud dens in Myanmar such as Meng Bo, Bangkang, and Mu Jie, and defrauded Ma Mouyin, Zhong Mouping, Li Moubo and others totaling hundreds of thousands of yuan, and in June 2021, due to the impact of the new crown pneumonia epidemic, Huang Mouhuan and Yan Mouwei were persuaded to return to China.
In 2023, the Hengyang Municipal Public Security Bureau found that Yan Mouwei was suspected of participating in the case of defrauding Zhong Mouping, a resident of Hengshan County.
On June 14 and 20, 2023, Yan Mouwei and Huang Mouhuan were arrested in Anxi County, Quanzhou City, Fujian Province, and Xinluo District, Longyan City, Fujian Province, respectively. With the approval of the Hengshan County Procuratorate, the arrest was carried out by the Hengshan County Public Security Bureau on July 21.
The procuratorate believes that the defendants Huang Mouhuan and Yan Mouwei clearly knew that they were committing telecommunications fraud, but in order to obtain personal benefits, they still actively participated in it, and the amount of public and private property defrauded was huge;Violating national (border) border management laws and regulations and illegally crossing the national (border) border, the circumstances are serious. The facts of their crimes are clear, the evidence is credible and sufficient, and their criminal responsibility shall be pursued for the crimes of fraud and illegally crossing the national (border) border.
The court ruled in accordance with the law that the defendants Huang Mouhuan and Yan Mouwei were sentenced to hand over the illegal gains, and jointly and severally returned a total of 75,700 yuan to the victims Ma Mouyin, Zhong Mouping, and Li Moubo;Huang Mouhuan was sentenced to one year and eleven months in prison and fined 28,000 yuanYan Mouwei was sentenced to one year and seven months in prison and fined 17,000 yuan.
