I don't know what I've done wrong. Recalling the scene of being "unboxed", Jin Meng still felt afraid.

Jin Meng, who is enthusiastic about public welfare, often rescues stray cats and dogs. In April this year, she and a group of friends who also care about stray small animals found that someone was peddling cat abuse on the Internet. They immediately reported to the Cyberspace Administration of China and the public security department, after which the other party's account was blocked and punished by the local public security organs.

Because of this incident, a group of cat abuse "lovers" lurking in the corners of the network began to mobilize various forces, "unboxing" small animal protection volunteers, including Jin Meng, Internet bloggers who supported public security actions, and even some celebrities who posted Weibo to support their actions, their ID numbers, home addresses, etc. were all on the Internet.

Many insults and insults with dirty words flocked in: if they didn't give the "ransom", they would abuse the cat live again, and even threatened to go downstairs to Jin Meng's house**.

Why are these people able to get my personal information and hide in a dark corner without any worries so presumptuous?Jin Meng did not compromise, she decided to fight back. Dig deep into the "black industry chain" behind the "unboxing".

'Unboxing' is one ring after another. Chuan Lie said that in the hands of criminals, a large number of citizens' personal information is stored in a number of databases that can be queried at any time, and these databases are commonly known as "social worker databases": as long as you have the social account of the person who is "opened", you can correspond to their mobile phone number, and then query their ID number, see the ** on their ID card, and even learn about their family relationship, "there is no technical content".

In a number of "social worker database" groups, you can see a variety of information available for query, "50 yuan can check a single account, 400 yuan can check the whole family, 500 yuan can check the takeaway address, opening records, 2000 yuan can check the location ...... through the mobile phone number."”

Where does this information come from?At a press conference held by the Ministry of Public Security on August 10, Huang Xiaosu, second-level director of police technology of the Cyber Security Bureau of the Ministry of Public Security, said that criminals mainly obtain personal information data by "defrauding information, stealing information, leaking internal ghosts, illegally collecting, reselling information, and altering information".

Huang Xiaosu said that "internal ghost leakage" refers to the illegal disclosure of citizens' personal information by using the convenience of their positions, such as the leakage of citizens' personal information by internal staff of enterprises and institutions such as operators, express delivery, automobile 4S stores, and real estate.

A "social worker database" operator who claimed to have worked as a customer service in an operator said that although he was only a grassroots employee at that time, he had a high background system authority and "could find anything". Some operators of the "social work database" said that the "inner ghosts" have become the main force of their "supply", and "as long as there are people in each system, this information will not be found."

In many "social work database" groups, there is a peculiar phenomenon: some criminals shout that they are "the most complete database on the whole network", and at the same time recruit "relevant professionals" for "long-term cooperation", and write grandly: "In order to upgrade the customer inquiry experience, we are now looking for the following channels to inquire personnel: express insiders, bank insiders, and people with public security inquiry authority." In the group, such job advertisements abound, and many of them are marked with the words "cooperation is safe, worry-free to make money".

In August this year, the Ministry of Public Security released the top ten typical cases of cracking down on the crime of infringing on citizens' personal information, and the figure of "inner ghosts" can be seen.

In March this year, the Shanghai Minhang Public Security Bureau found that the suspect had accurate control of the victim's online shopping records, logistics information and other citizens' personal information during the investigation of an online fraud case. After investigation, Peng and others found that someone was asking for shopping flow information for a fee overseas, and immediately contacted the person to obtain a Trojan horse program, and applied for an employee of the express company, using the convenience of their position to implant a Trojan horse program in the business computer of the express company, and their upline personnel obtained a large amount of express delivery information through the Trojan horse program, and used the above information to further carry out telecommunications network fraud. In May this year, the Shanghai public security organs carried out a centralized network collection and arrested eight criminal suspects who used similar methods to steal citizens' personal information.

"Human flesh unboxing" hides many legal risks.

In the few months that Chuan Lie was lurking in the group, he not only collected evidence of criminals intimidating him, but also located the true identity of the mastermind behind the scenes through information such as mobile phone numbers, collection codes, and network IP addresses. After that, he submitted evidence to the relevant authorities.

Han Xiao, a partner at Beijing Kangda Law Firm, analyzed that the act of "opening the box of human flesh" involves civil, administrative and criminal legal responsibilities. The Civil Code of the People's Republic of China stipulates that the personal information of natural persons is protected by law. Where any organization or individual needs to obtain the personal information of others, it shall obtain it in accordance with law and ensure the security of the information, and must not illegally collect, use, process, or transmit the personal information of others, and must not illegally buy, sell, provide, or disclose the personal information of others. Where personality rights are violated, the victim has the right to request that the perpetrator bear civil liability in accordance with the provisions of this Law and other laws.

'Arbitrarily and publicly disclosing other people's private information is an act of violating the right to privacy and requires certain civil liability." Han Xiao pointed out that according to the provisions of the Public Security Administration Punishment Law, those who openly insult others or fabricate facts to slander others, send **, insult, intimidate or other information repeatedly, interfere with the normal life of others, and spread the privacy of others, etc., will face administrative penalties such as fines and administrative detention. In September this year, the Supreme People's Court, the Supreme People's Procuratorate, and the Ministry of Public Security jointly issued a guiding opinion on the lawful punishment of violations and crimes of online violence, which stipulates that organizing "doxing" to illegally collect and publish citizens' personal information to an unspecified number of people, where the circumstances are serious and meet the requirements of Article 253-1 of the Criminal Law, is to be convicted and punished as the crime of infringing on citizens' personal information.

Han Xiao said that online abuse attacks on citizens may also constitute the crime of insult, picking quarrels and provoking trouble, and if further money is obtained, it may constitute property crimes such as extortion.

On November 17, ** platform Bilibili reported the "human flesh unboxing" incident involving many up masters such as Chuan Lie, saying that it received a report in August this year that some groups organized users on overseas platforms to "unpack human flesh" for up owners on the site. This group not only discloses the personal information of the UP owner, but also conducts a series of illegal acts such as private message harassment, cyber violence attacks, and false and malicious reports. According to the report, due to the wide geographical scope of this case, the large number of people involved in the case and the bad nature of the acts, the relevant departments have notified more than 40 suspects to 18 provinces and cities.

Rectifying and rejecting 'human flesh unboxing' requires the common attention and participation of the whole society. Han Xiao stressed that it is very important to educate and transform those who "open the box", and the regulatory and judicial organs should strengthen supervision, establish and improve the supervision mechanism and punishment system, and take timely measures to crack down on malicious attacks, harassment and other behaviors to form a deterrent effect. In addition to using judicial means to pursue legal responsibility, it is also necessary to rely on social organizations and other forces to carry out education and reform, as a citizen, we should also actively participate in network governance, "improve our own legal quality and network security awareness, reject malicious attacks and harassment, and jointly create a safe, civilized and harmonious network environment."
