Handled the "first case" of criminal trial in absentia
The case of Cheng Sanchang ** has been hailed as China's "first criminal trial in absentia". The "Zhengjian" case-handling team of the Zhengzhou Municipal Procuratorate successfully completed the case and ushered in a "highlight moment".
On December 9, 2021, the case of Cheng Sanchang ** was in the Zhengzhou Intermediate Court**, and three public prosecutors from the Zhengzhou Municipal Procuratorate appeared in court to support the prosecution.
Cheng Sanchang has successively served as secretary of the Luohe Municipal Party Committee of Henan Province and chairman of Yugang Company, with more than 3.08 million yuan. In February 2001, Cheng Sanchang absconded abroad. According to the provisions of the Criminal Law and the Criminal Procedure Law, the "trial in absentia procedure" shall be applied to the handling of the case.
Under the unified deployment and command of the ** Fugitive Pursuit Office and the specific guidance of the Supreme People's Procuratorate and the Henan Provincial Procuratorate, the "Zhengjian" case-handling team intervened in advance, and in the face of many difficulties such as the death of individual witnesses, the emigration of some witnesses, and the incomplete collection of relevant financial information, the prosecutor who undertook the case peeled off the cocoon, and put forward hundreds of review opinions around the determination of facts, the characterization of the law, the improvement of evidence, and the conditions for the application of the trial procedure in absentia, etc., and finally made the elements of the case evidence system complete and the jurisdiction clear. In the process of handling cases, the "Zhengjian" case-handling team actively carried out exploration and practice around the specific application rules of criminal trial in absentia procedures, the evidence standards for criminal trial in absentia, the service of documents, the setting of court hearings, and the presentation and cross-examination of evidence, providing a "procuratorial sample" for the handling of similar cases.
On January 17, 2022, the Zhengzhou Intermediate People's Court publicly pronounced its verdict in Cheng Sanchang's case. The court fully adopted the prosecution opinion of the procuratorate, sentenced Cheng Sanchang to 12 years in prison for the crime of **, fined him 500,000 yuan, and recovered more than 3.08 million yuan of Cheng Sanchang's criminal proceeds. The case was selected as one of the top ten legal supervision cases in 2021.
Taking the opportunity of handling this case, the Zhengzhou Municipal Procuratorate took the spirit of "Zhengjian" culture and brand as the guide, and actively built a high-quality and efficient procuratorial work mechanism for job-related crimes. On the basis of lawfully intervening in major, difficult, and complex cases investigated and handled by the supervision organs, the procuratorate took the lead in establishing and improving mechanisms and measures such as the normalization of the connection between supervision and inspection, the reporting and filing of cases of crimes abusing public office, and the workflow of trial procedures in absentia.
