The management measures for the two members of maritime affairs have ushered in a major revision!

On January 31, 2024, the State Maritime Safety Administration (MSA) issued a notice on soliciting opinions on the Administrative Measures for Declarants of Dangerous Goods on Ships and On-site Inspectors of Container Packing (Revised Draft for Comments) (hereinafter referred to as the "New Measures") to solicit opinions on the revision of the New Measures from the public.

In this issue, we will briefly sort out the main changes in the New Measures, so as to facilitate the two practitioners to keep abreast of the direction of changes in future regulatory requirements.

1. Registration for the qualification examination

The specific charging standard will be announced by the MSA in the future.

3. Submission of employment information

1. Added to the information submitted by the practitioner"Proof of signing a labor or employment relationship with an employer".

This requirement is mainly to put an end to the phenomenon of "affiliation" of some two-member employees, so as to detach themselves from the management of the employment unit, and guide the occurrence of various hidden dangers in work.

2. Clarify the requirements for changing the information of the two employees in the employment unit.

Fourth, the management of professional scores

1. For a scoring period, the accumulated points are in:10 15 pointsThe following provisions are added between practitioners (Article 26):

If the declarant or inspector achieves or exceeds 10 points in one scoring cycle, and scores again but the cumulative score does not exceed 15 points, the online procedures for declaration, report or issuance of the "Packing Certificate" shall not be suspended. Where the cumulative demerit points reach 15 points after another demerit is scored, it is to be handled in accordance with article 27.

2. For a scoring period, the accumulated points are in:15 20 pointsThe following provisions are added between practitioners (Article 27):

If the declarant or inspector achieves or exceeds 15 points in one scoring cycle, but the cumulative demerit points do not exceed 20 points, the online procedures for declaration, report or issuance of the "Packing Certificate" shall not be suspended. Where the cumulative demerit points reach 20 points after another demerit is scored, it is to be handled in accordance with article 28.

5. Management of employment units

In order to urge the employing units to strengthen the employment management of the two employees hired, Article 32 of the "New Measures" clearly requires the employing units to perform the following two management duties:

6. Supervision and inspection

Chapter VII "Supervision and Inspection" has been added to the New Measures, which clarifies how the maritime safety administration conducts supervision and spot checks on the work of the two personnel in their daily work.

7. Summary

Through a simple combing of the "New Measures", it is believed that a major change in the "New Measures" is to strengthen the professional management of the two individuals and their units, on the one hand, through the design of the management system, to eliminate all kinds of "affiliation" phenomenon, on the other hand, to make full use of the baton of score management, and strengthen the awareness of self-management from the unit. It is hoped that relevant practitioners and their units will pay close attention to the implementation of the "New Measures".
