Recently, the Executive Bureau of the Yushu Municipal People's Court concluded a case of motor vehicle traffic accident liability dispute, and the judge successfully prompted the person subject to enforcement to fulfill his statutory obligations through a combination of rigidity and softness, and successfully completed the execution of the case.
When the defendant Li was driving a three-wheeled motorcycle from south to north, he collided with a two-wheeled motorcycle driven by the plaintiff Wang, and the traffic police brigade determined that the defendant Li was primarily responsible for the accident and the plaintiff Wang was secondarily liable. Later, the Yushu Court ruled that the defendant Li should compensate the plaintiff Wang for losses totaling more than 60,000 yuan, but the defendant Li had not paid the compensation, and in desperation, Wang applied for compulsory enforcement and requested the Yushu Court to protect his legitimate rights and interests.
After the case entered the enforcement procedure, the enforcement judge Gong Yanhua summoned both parties to conduct pre-execution mediation in accordance with the law, but the wife of the applicant Wang and the wife of the person subject to enforcement, Li, were emotional and even fought. Reasonable and legal, the two sides are at a stalemate.
According to the property clues provided by the applicant, the enforcement judge and the clerk drove to the home of the person subject to enforcement, the animal husbandry bureau, and the insurance company to conduct an investigation. After investigation, it was found that Li did have beef cattle breeding insurance registration under his name, but no live beef cattle were seized. Later, the enforcement judge communicated with the person subject to enforcement several times, but the person subject to enforcement refused to report the property situation and made it clear that he would not perform the obligations determined by the effective legal documents.
In order to effectively protect the lawful rights and interests of the applicant, the enforcement judge decided to take compulsory detention measures against the person subject to enforcement. A few days later, the daughter of the person subject to execution, Li, saw that the judge had such a tough attitude, and offered to settle and was willing to pay compensation in a lump sum.
