Mr. Yang, a 60-year-old native of Yuzhong, Chongqing, was preparing to take a train to Yulin, Shaanxi Province to work. He said that during the Spring Festival, his worker was injured while working in a coal mine, his waist was sprained, and he was relatively old, so the employer let the worker go home to rest and did not pay him wages.

Cai Changxin, the 6th National Outstanding Lawyer for Safeguarding the Rights and Interests of Employees, responded that according to Article 14 of the Regulations on Work-related Injury Insurance, if one of the above circumstances is met if an employee is injured in an accident during working hours and in the workplace due to work-related reasons, or if he is injured in an accident while engaged in work-related preparatory or finishing work in the workplace before or after working hours, or if he is injured by an accident such as violence in the performance of work duties during working hours and in the workplace, etc., if one of the above circumstances is met, it shall be deemed to be a work-related injury.

So what should we do when we encounter this situation? Mr. Yang asked.

Cai Changxin explained that if an employee is injured in an accident or is diagnosed or identified as an occupational disease in accordance with the regulations on the prevention and treatment of occupational diseases, the unit to which he belongs shall submit an application for work-related injury recognition to the social insurance administrative department of the coordinating area within 30 days from the date of the accident injury or the date of diagnosis or appraisal of the occupational disease; If the employer fails to submit an application for recognition of work-related injury in accordance with the provisions of the preceding paragraph, the injured employee or his close relatives or trade union organization may, within one year from the date of occurrence of the accident injury or the date of diagnosis or appraisal of an occupational disease, directly submit an application for recognition of work-related injury to the social insurance administrative department of the coordinating area where the employer is located.

After listening to the lawyer's answer, Mr. Yang finally put his mind at ease, he said that after returning to the unit, he told the workers this information, and at the same time, he also took a stack of trade union publicity materials with him.

This concentrated publicity activity provides legal popularization publicity, legal consultation, anti-fraud and anti-fraud and other legal popularization services for new employment forms of workers and migrant workers who go out to work by setting up trade union legal service points in the waiting hall, sending services into the carriage, and carrying out interactive activities, and publicizes to them the policies and regulations on joining the trade union, helping them in difficulties, mutual assistance and protection, and safeguarding rights and interests, so as to further enhance the awareness of the rule of law among migrant workers and improve their awareness of the service content and service methods of the trade union. Let the trade union organization become a "mother's family" that they can "think of, find and rely on" no matter where they are.

During this year's Spring Festival, the city's trade unions at all levels linked up and down, adapted measures to local conditions, and organized various forms of publicity and service activities with their own characteristics. Up to now, trade unions at all levels have gone into railway stations, long-distance bus stations, front-line municipal key projects and private enterprises, industrial parks and key business districts, township grassroots organizations and other places to carry out activities such as law popularization publicity, legal consultation, and law popularization lectures, and provide various services such as conflict and dispute mediation, free health clinics, and employment consultation for the broad masses of employees, and have gone deep into 54 passenger transport stations, organized more than 200 legal popularization and publicity, distributed 200,000 copies of publicity materials, and provided more than 7,300 free legal consultations. 284 labor disputes were mediated, 106 legal aid cases were accepted, and more than 230,000 employees were benefited.
