The ranking of the validity of laws in China is the Constitution, laws, administrative regulations, departmental rules and local rules.
Among them, the status of the constitution is the supreme, and the formulation of any laws, administrative regulations, departmental rules, and local rules cannot contradict the constitution in any way.
Any law, administrative regulation, departmental rule and local regulation that contradicts the Constitution is invalid or needs to be amended to conform to the Constitution.
Laws must be made on the premise of complying with the principles of the Constitution. If any of the laws contradict the Constitution, the law is considered null and void or needs to be amended to conform to the Constitution.
The formulation of administrative rules and regulations must follow the principles of the Constitution and laws. The formulation of departmental rules must conform to the principles of the Constitution, laws, and administrative regulations, and must not contradict the Constitution, laws, and administrative regulations in any way. If there is any inconsistency, then it may be deemed invalid, or it needs to be amended again to comply with the provisions of the Constitution, laws and administrative regulations.
The formulation of local regulations must be in accordance with the principles of the Constitution, laws, and administrative regulations, and must not contradict the Constitution, laws, and administrative regulations.
