A month after the two met, Lin took the initiative to add Dong's WeChat, expressing his willingness to continue dating. But after a period of time, Dong got tired and wanted to get back the money he had swiped before, so he began to borrow money from Lin on the grounds that he had just come out of a pyramid scheme and needed to go home for travel expenses, and then asked Lin for money many times on the grounds of "car accident", "credit card repayment", "going to northern Myanmar to earn money but being controlled by a criminal gang, and if he didn't give money, his fingers would be cut off", and Lin lent the money to Dong out of fear and sympathy.
After Dong received the money, he blocked Lin's WeChat, and contacted Lin through another identity, threatening her to find someone to ask for money in Beijing, and claiming that he had Lin's mobile phone location and Internet IP address and intimidated him, and Lin transferred money to him again out of fear. During the communication between the two, the two did not meet each other, but just stayed on the Internet to communicate, and then Lin reported the case.
After trial, the court held that the defendant Dong X fabricated facts for the purpose of illegal possession, defrauded others of property, the amount was relatively large, and infringed on the property rights of others, the facts of the crime were clear, the evidence was credible and sufficient, and he should be investigated for criminal responsibility for the crime of fraud. In view of the mitigating and lenient circumstances of the defendant Dong, such as confession, voluntary admission of guilt and acceptance of punishment, compensation and obtaining forgiveness, it was decided that the defendant Dong X committed the crime of fraud and was sentenced to six months imprisonment and a fine of 5,000 yuan.
