On April 2, 2022, law enforcement officers from the Jurong Ecological Environment Bureau of Zhenjiang City inspected a photovoltaic technology located in Guozhuang Industrial Park. At the time of the inspection, the company was in production, the equipment was operating normally, and during the on-site inspection of the hazardous waste warehouse (the company's hazardous waste mainly includes rubber residue, waste activated carbon, waste lubricating oil, waste mineral oil, and waste organic solvent).It was found that the company did not establish a hazardous waste management ledger in accordance with relevant national regulations and truthfully record relevant information.
The company's actions violated the provisions of Article 78, Paragraph 1 of the Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste. How to formulate hazardous waste management plans and ledgers
1. Requirements for the formulation of hazardous waste management plans
1. Formulating unit
Units belonging to the same legal entity or other organizations but located in different production and business sites shall, with each production and business operation site as a unit, formulate a hazardous waste management plan separately, and file it with the competent department of ecology and environment where the production and business operation site is located through the national hazardous waste information management system.
2. Formulate form and time limit requirements
1) Units that produce hazardous wastes shall formulate hazardous waste management plans on an annual basis.
2) The unit that produces hazardous waste shall fill in and submit the hazardous waste management plan of the current year through the national hazardous waste information management system before March 31 of each year, and the national hazardous waste information management system will automatically generate the record number and receipt to complete the filing.
3) If the content of the hazardous waste management plan needs to be adjusted, the unit that produces the hazardous waste shall be changed in a timely manner.
3. General principles
1) The content of the management plan of the key environmental supervision unit of hazardous waste shall include the basic information of the unit, facility information, information on the generation of hazardous waste, information on the storage of hazardous waste, information on the self-utilization and disposal of hazardous waste, hazardous waste reduction plans and measures, and information on the transfer of hazardous waste.
2) The content of the management plan of the hazardous waste simplified management unit shall include the basic information of the unit, the information on the production of hazardous waste, the information on the storage of hazardous waste, the reduction plan and measures of hazardous waste, and the information on the transfer of hazardous waste.
3) The content of the management plan of the hazardous waste registration management unit shall include the basic information of the unit, the information on the production of hazardous waste, and the information on the transfer of hazardous waste.
4. Fill in the requirements for the basic information of the unit
1) Basic information of the unit.
Please refer to Appendix A1. The filling should meet the following requirements.
a) Industry category: fill in according to the corresponding category and ** in GB T 4754.
b) Management category: refers to the key environmental supervision unit of hazardous waste, the simplified management unit of hazardous waste or the registration and management unit of hazardous waste.
2) Facility information.
Please refer to Table A. for details of facility information2. The filling should meet the following requirements.
a) The main production unit, main process, production facilities and facility parameters, product name, production capacity, raw and auxiliary materials: consistent with the content stated in the copy of the pollutant discharge permit.
b) Facility code: fill in the code specified in the copy of the pollutant discharge permit. If there is no code, it should be coded according to HJ 608 and filled in. For hazardous wastes with unfixed production links, select one of the facility codes that produce this type of hazardous waste.
c) Parameters of pollution prevention and control facilities: refer to the parameters of self-utilization facilities, self-disposal facilities and storage facilities for hazardous waste.
5. Fill in the requirements for the basic information of hazardous waste
1) Hazardous waste generation.
Please refer to Table A. for the content of hazardous waste generation3. The filling should meet the following requirements.
a) Hazardous waste name, category, ** and hazard characteristics: according to the National Hazardous Waste Inventory or according to GB 50851 7 and HJ 298 are determined and filled. If there is a common name of the industry or the internal name of the unit, fill in the common name of the industry or the internal name of the unit at the same time.
b) Name of hazardous constituent: the name of the main pollutants harmful to the environment in hazardous waste, such as benzene, cyanide, arsenic, etc.
c) The name and code of the facility that produces hazardous waste: the name of the production facility and the code of the production facility filled in according to the "facility information" part can be automatically generated by the national hazardous waste information management system.
d) Estimated amount of hazardous waste generated in the current year: The amount of hazardous waste expected to be generated in the current year.
e) Unit of measurement: fill in the ton. If it is measured in liters, cubic meters, etc., it should be converted into weight tons; If the number is used as the unit of measurement, in addition to filling in the number, it should also be converted into weight tons.
f) Internal governance methods and destinations: self-use facility code, self-disposal facility code and storage facility code according to the "facility information" part of the pollution prevention and control facility code to fill in, can be automatically generated by the national hazardous waste information management system.
2) Hazardous waste storage.
Please refer to Table A. for the contents of the hazardous waste storage4. The filling should meet the following requirements.
a) Hazardous waste name, category, ** name of hazardous components, form, hazard characteristics: fill in the relevant information according to the "hazardous waste generation" section, which can be automatically generated by the national hazardous waste information management system.
b) Storage facility code: fill in the pollution prevention and control facility code according to the "facility information" section, which can be automatically generated by the national hazardous waste information management system.
c) Storage facility type: fill in according to the storage facility type in GB 18597.
d) Packaging form: including packaging container, material, specification, etc.
e) Projected Remaining Stocks for the Year: The amount of hazardous waste stockpiled in storage facilities that is expected to be held by the end of the year.
f) Unit of measurement: fill in tons. If it is measured in liters, cubic meters, etc., it should be converted into weight tons; If the number is used as the unit of measurement, in addition to filling in the number, it should also be converted into weight tons.
The storage capacity of hazardous waste shall be consistent with that stated in the copy of the pollutant discharge permit, or determined according to the environmental impact assessment documents and approval opinions of the unit that produces the hazardous waste.
3) Hazardous waste is used and disposed of by itself.
Please refer to Table A. for the content of the disposal of hazardous waste self-utilization5. The filling should meet the following requirements.
a) Type of facility: refers to self-use facilities and self-disposal facilities.
b) Hazardous waste name, category, hazardous component name, form, hazard characteristics: fill in the relevant information according to the "hazardous waste generation" section, which can be automatically generated by the national hazardous waste information management system.
c) Self-use disposal facility code: fill in the pollution prevention and control facility code according to the "facility information" part, which can be automatically generated by the national hazardous waste information management system.
d) Self-use Disposal method**: Fill in according to Appendix F of HJ 1033.
e) Estimated self-utilization and disposal volume in the current year: The estimated amount of hazardous waste disposed of by self-utilization in this year.
f) Unit of measurement: fill in tons. If it is measured in liters, cubic meters, etc., it should be converted into weight tons; If the number is used as the unit of measurement, in addition to filling in the number, it should also be converted into weight tons.
The disposal capacity of hazardous waste for self-utilization shall be consistent with that stated in the copy of the pollutant discharge permit, or determined according to the environmental impact assessment documents and approval opinions of the unit that produces hazardous waste.
4) Hazardous waste reduction.
Please refer to Table A. for the contents of the hazardous waste reduction plan and measures6。
According to the production of its own products and the production of hazardous waste, on the basis of learning from the development level and experience of the same industry, put forward a plan to reduce the amount of hazardous waste generated and reduce the hazard of hazardous waste, and clearly improve raw materials, processes, technology, management, etc.
6.Hazardous waste transfer
Please refer to Appendix A7. The filling should meet the following requirements.
a) Type of transfer: refers to intra-provincial transfer, inter-provincial transfer and overseas transfer.
b) Hazardous waste name, category, hazardous component name, form, hazard characteristics: fill in the relevant information according to the "hazardous waste generation" section, which can be automatically generated by the national hazardous waste information management system.
c) Estimated amount to be transferred in the current year: The amount of hazardous waste that is expected to be transferred in the current year.
d) Unit of measurement: fill in tons. If it is measured in liters, cubic meters, etc., it should be converted into weight tons; If the number is used as the unit of measurement, in addition to filling in the number, it should also be converted into weight tons.
e) Disposal method**: Completed in accordance with Appendix F of HJ 1033.
f) The type of unit to be received: hazardous waste business license holding unit, hazardous waste utilization and disposal link exemption management unit, hazardous waste utilization and disposal unit outside the People's Republic of China, etc.
g) the name and business license number of the hazardous waste business license holder to be received: shall be associated with the relevant information of the hazardous waste business license holder registered in the national hazardous waste information management system and consistent, and can be automatically generated by the national hazardous waste information management system.
h) The relevant information of the exempt management unit in the utilization and disposal of hazardous waste shall be registered in the national hazardous waste information management system.
i) If hazardous waste is exported abroad, the information of the hazardous waste utilization and disposal unit outside the territory of the People's Republic of China shall be filled in the national hazardous waste information management system.
2. Requirements for the formulation of hazardous waste management ledgers
1. General principles
1) The unit that produces hazardous waste shall establish a hazardous waste management account, implement the person responsible for the record of the hazardous waste management account, clarify the job responsibilities, and be legally responsible for the authenticity, accuracy and completeness of the hazardous waste management account.
2) The unit that produces hazardous waste shall truthfully establish a hazardous waste management ledger for each link according to the dynamic flow direction of hazardous waste generation, storage, utilization, disposal and other links, and the record content is shown in Appendix B.
Appendix B Reference Table of Hazardous Waste Management Ledger.
3) Hazardous waste management ledger is divided into two forms: electronic management ledger and paper management ledger. Units that produce hazardous waste may record electronic management ledgers through the national hazardous waste information management system, the enterprise's self-built information management system or a third-party platform.
2. Frequency requirements
If it is contained in containers and packages after it is generated, it shall be recorded according to each container and packaging; If it is transported to the storage site by means such as pipelines after it is generated, it shall be recorded on a daily basis; In other special circumstances, the frequency of recording shall be determined according to the law of hazardous waste generation.
3. Record the content
1) In the process of generating hazardous waste, the batch code, production time, name of hazardous waste, hazardous waste category, hazardous waste**, amount generated, unit of measurement, container packaging code, container packaging type, container packaging quantity, hazardous waste generation facility code, generation department manager, whereabouts, etc.
2) Hazardous waste warehousing link, should record the storage batch code, storage time, container packaging code, container packaging type, container packaging quantity, hazardous waste name, hazardous waste category, hazardous waste **, storage volume, unit of measurement, storage facility code, storage facility type, transportation department manager, storage department manager, generation batch code, etc.
3) Hazardous waste out of the library, should record the outbound batch code, out of the warehouse time, container packaging code, container packaging type, container packaging quantity, hazardous waste name, hazardous waste category, hazardous waste **, outbound volume, unit of measurement, storage facility code, storage facility type, out of the warehouse department manager, transportation department manager, storage batch code, whereabouts, etc.
4) Hazardous waste self-utilization disposal link, should record self-use disposal batch code, self-use disposal time, container packaging code, container packaging type, container packaging quantity, hazardous waste name, hazardous waste category, hazardous waste**, self-use disposal volume, unit of measurement, self-use disposal facility code, self-use disposal method, self-use disposal completion time, self-use disposal department manager, generation batch code, outbound batch code, etc.
5) Hazardous waste outsourcing disposal link, should record the outsourcing disposal batch code, factory time, container packaging code, container packaging type, container packaging quantity, hazardous waste name, hazardous waste category, hazardous waste**, outsourcing disposal volume, unit of measurement, utilization disposal method, type of receiving unit, use of disposal unit name, license code, export approval notice number, generation batch code, outbound batch code, etc.
4. Record keeping
In principle, the retention period should be archived for more than 5 years.
3. Hazardous waste declaration requirements
1. General principles
1) Units that produce hazardous wastes shall regularly report the types, amounts, flows, storage, utilization, disposal and other relevant information of hazardous wastes to the local ecological and environmental authorities through the national hazardous waste information management system.
2) The unit that produces hazardous waste shall summarize the relevant situation of hazardous waste during the declaration period according to the hazardous waste management ledger records, ensure the authenticity, accuracy and completeness of the declaration content, and submit it to the local ecological and environmental department on time, and the ledger records shall be retained for future reference.
3) Units that produce hazardous wastes can declare on their own, or they can entrust the hazardous waste business license holder or a third-party unit approved by the local ecological and environmental authorities to declare on their behalf.
2. Declaration cycle
1) The key environmental supervision unit of hazardous waste shall declare the relevant information of hazardous waste on a monthly and annual basis, and complete the declaration of the previous month and the previous year before the 15th of each month and March 31 of each year respectively.
2) The hazardous waste simplified management unit shall declare the relevant information of hazardous waste on a quarterly and annual basis, and complete the declaration of the previous quarter and the previous year before the 15th of the first month of each quarter and before March 31 of each year.
3) The hazardous waste registration management unit shall declare the relevant information of hazardous waste on an annual basis, and complete the declaration of the previous year before March 31 of each year.
3. The content of the declaration
1) The content of the declaration includes the production of hazardous waste, the disposal of hazardous waste, the use and disposal of hazardous waste, and the storage of hazardous waste.
Appendix C Reference Table for Hazardous Waste Audit Report.
2) Through the national hazardous waste information management system to establish the hazardous waste electronic management ledger of the unit, the national hazardous waste information management system automatically generates a hazardous waste declaration report, after its confirmation and submission, complete the declaration.
Relevant laws and regulations
Article 78 of the Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes
Units that produce hazardous wastes shall formulate hazardous waste management plans in accordance with relevant national regulations;Establish a hazardous waste management account, truthfully record relevant information, and declare the type, amount, flow, storage, disposal and other relevant information of hazardous waste to the local ecological and environmental department through the national hazardous waste information management system. The hazardous waste management plan referred to in the preceding paragraph shall include measures to reduce the amount of hazardous waste generated and reduce the hazard of hazardous waste, as well as measures for the storage, utilization and disposal of hazardous waste. The hazardous waste management plan shall be reported to the competent department of ecology and environment at the location of the unit that produces the hazardous waste for the record. If the unit that produces hazardous waste has obtained a pollutant discharge permit, the provisions of the pollutant discharge permit management system shall be implemented.
Article 85 of the Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste
Units that generate, collect, store, transport, utilize, and dispose of hazardous wastes shall formulate preventive measures and emergency response plans for accidents in accordance with law, and file them with the local competent departments of ecology and environment and other departments responsible for the supervision and management of the prevention and control of environmental pollution by solid wastes; The competent departments of ecology and environment and other departments responsible for the supervision and management of the prevention and control of environmental pollution by solid wastes shall conduct inspections.
Article 112 of the Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes
Anyone who violates the provisions of this Law and commits any of the following acts shall be ordered to make corrections, impose a fine, and confiscate illegal gains; If the circumstances are serious, it may be ordered to suspend business or close down upon approval by the people** who have the right to approve
A) not in accordance with the provisions of the hazardous waste identification mark;
2) Failure to formulate a hazardous waste management plan or declare relevant information on hazardous waste in accordance with the relevant provisions of the State;
3) Dumping or stacking hazardous wastes without authorization;
4) Hazardous wastes are provided or entrusted to unlicensed units or other producers and operators to engage in business activities;
5) Failure to fill out and run the hazardous waste transfer form in accordance with the relevant provisions of the State or transfer hazardous waste without approval;
6) Failure to store, utilize, or dispose of hazardous wastes in accordance with national environmental protection standards, or mixing hazardous wastes with non-hazardous wastes for storage;
7) Mixed collection, storage, transportation, and disposal of hazardous wastes with incompatible properties without safe disposal;
8) Hazardous wastes are carried on the same means of transport as passengers;
9) Transferring the places, facilities, equipment and containers, packaging and other items for the collection, storage, transportation and disposal of hazardous wastes for other purposes without decontamination;
10) Failure to take corresponding preventive measures, resulting in the dispersion, loss, leakage or other environmental pollution of hazardous wastes;
11) discarding or scattering hazardous wastes along the way during transportation;
12) Failure to formulate hazardous waste accident prevention measures and emergency plans;
13) Failure to establish a hazardous waste management ledger in accordance with the relevant provisions of the State and record it truthfully.
Where there is any of the conduct in items 1, 2, 5, 6, 7, 8, 9, 12, or 13 of the preceding paragraph, a fine of between 100,000 and 1,000,000 RMB is to be given; Where there is any of the conduct in items (3), (4), (10), or 11 of the preceding paragraph, a fine of between three and five times the required disposal costs is to be given, and where the required disposal costs are less than 200,000 RMB, it is to be calculated as 200,000 RMB.
