According to the Beijing News, on February 8, the Regulations on the Administration of Off-campus Training (Draft for Comments) (hereinafter referred to as the "Regulations") were released. There are a total of 20 articles, focusing on hot and difficult issues in the field of off-campus training management, summarizing the experience of off-campus training management, and elevating mature practices to administrative regulations in accordance with the law.

For the first time, the "Regulations" intend to raise the overall management of off-campus training to the level of administrative regulations. In accordance with the Education Law, the Compulsory Education Law, the Law on the Promotion of Private Education and other higher-level laws, on the basis of centralized management of off-campus training practices and in-depth research in recent years, it condenses good experience and practices into legal provisions, so as to improve its legal effect and promote the standardized and healthy development of off-campus training.

On the one hand, the "Regulations" "elevate" the regulations that have been recognized by practice into law, such as the concept of off-campus training has been uniformly defined, off-campus training is divided into academic training and non-academic training, and it is clearly required that national statutory holidays, rest days and winter and summer vacations shall not be occupied to organize academic training in the compulsory education stage.

On the other hand, the clear management of off-campus training institutions is to standardize off-campus training activities and meet diverse cultural and educational needs. Off-campus training is not prohibited, but focuses on guidance and standardization, giving full play to the role of legislation in stabilizing expectations, consolidating fundamentals, and benefiting the long-term. In other words, the development of off-campus training is to bring the development of off-campus training into the track of rule of law.

It should be clarified that the promulgation of the "Regulations" does not mean that the "Double Reduction" Opinions have become invalid, on the contrary, the spirit of the "Regulations" is in the same vein as the "Double Reduction" Opinions.

In July 2021, the Ministry of Education has clarified the scope of disciplines and non-disciplines of off-campus training in the compulsory education stage, and classified the two in the "Double Reduction" Opinions.

In some details, the "Regulations" issued this time have further improved the relevant management measures.

For example, in addition to requiring in-service teachers in kindergartens, primary and secondary schools not to engage in off-site training activities, "teaching and research personnel" have also been added, which means that all in-service teachers and teaching and research personnel are not allowed to participate in off-campus subject training and non-subject training, which has drawn a clearer bottom line.

In addition, the Regulations stipulate that the name of an off-campus training institution shall contain the word "training", which further clarifies its positioning as "training".

The Regulations also clarify the licensing procedures and regulatory responsibilities for non-academic training, which were previously relatively vague, and clarify that "the license to run a school for non-academic off-campus training shall be reported to the competent department of the industry at the same level for review and approval before applying for a license from the administrative department of education." Where multiple departments are involved, they shall be separately reported to the relevant industry regulatory departments for review and approval. ”

The above-mentioned provisions provide a legal basis and guarantee for relevant supervision, and will also promote the standardized development of off-campus training institutions.

Of course, the key to the implementation of the "Regulations" is to bring all off-campus training into supervision, so as to avoid illegal and illegal off-campus training from being outside the supervision.

In accordance with the provisions of the "Regulations", the administrative department of education shall establish a unified national platform for the supervision and management of off-campus training in conjunction with relevant departments, and off-campus training institutions shall promptly fill in and update relevant information to ensure that the information is true and accurate. This is an important measure to integrate all off-campus training into a unified regulatory service platform.

However, what is solved is the supervision of legal off-campus institutions, the supervision of off-campus training institutions that violate regulations, and the governance of illegal training, which is still long-term, complex and arduous.

This requires a reasonable and legal approach to encourage standardized and quality-assured extracurricular training, channel the training needs of students and parents, and guide parents to legal institutions for training and stay away from illegal training. This is also of great practical significance for the discipline training of governance and variation.

At present, the "Regulations on the Administration of Off-campus Training" is soliciting comments, and relevant training institutions, parents, and schools may wish to respond positively, with a view to further improving the off-campus training management system and helping the off-campus training industry to standardize and develop healthily.
