The plaintiff Li and the defendant Wang were in free love, went through the marriage registration procedures in 2022, and gave birth to a daughter in 2023 after marriage. With the birth of a new child, the parents have to bear a heavier burden of household chores and financial burdens than before. The two often quarreled over trivial matters, and the plaintiff Li went to the juvenile (family) court of the Lieshan District Court in a fit of anger to file a lawsuit, asking for a divorce from the defendant Wang on the grounds of the breakdown of the relationship between the husband and wife. However, the defendant Wang firmly stated that he did not want to divorce, the child was not yet one year old, and the relationship between the husband and wife was very good, and there was no emotional breakdown.
After the presiding judge understands the facts of the case, he immediately organizes face-to-face mediation between the two parties. During the mediation process, the judge found that the parties still had a relationship between husband and wife, and there was no principled fault, and the intensification of family conflicts was mainly due to improper communication. The judge then understood the reason, moved with emotion, and patiently guided, and the parties finally opened their hearts and told the reasons in the atmosphere created by the judge, relieving the pressure and releasing their emotions. The judge struck while the iron was hot, carefully mediated from the aspects of children's growth, husband and wife relationship and legal relationship, and guided both parties to empathize and understand each other. After some patient persuasion, the husband and wife reconciled, reunited, and the case was successfully resolved.
The Juvenile (Family) Court of Lieshan District Court will always uphold the people-centered judicial concept, with the goal of achieving the conclusion of the case and substantively resolving the dispute, adhere to the principle of "mediation first, mediation and judgment combined", resolve conflicts and disputes through a variety of mediation methods, protect the legitimate rights and interests of the people, and promote social fairness and justice.
