On November 14, 2023, the Pinghu Civil and Commercial Financial Mediation Center of Nanning High-tech Industrial Development Zone successfully mediated a labor contract dispute at a construction site, which not only protected the legitimate rights and interests of migrant workers in the city, but also maintained the stable development of society.
In January 2021, 19 construction site workers, including the applicant Lu Moumou, Wu Moumou, and Huang Moumou, were hired by Ban Moumou to carry out putty scraping work in a third-phase project in Nanning City, and the wages were not settled after completion. In mid-August 2023, 19 construction site workers including Lu Moumou found that their employer Zhang Moumou was missing, and then went to the construction site involved in the case to ask the superior subcontracting team Zhou, Luo and a construction project labor *** in Guangxi to pay the wages of Lu Moumou and other 19 people in the dispute, totaling 82,740 yuan. After the two sides could not negotiate, Lu Moumou and 19 others requested the labor inspection squadron of Liangqing District, Nanning City and our center to intervene and coordinate the handling.
On November 14, 2023, after receiving the mediation application, our center immediately appointed a mediator and jointly convened the labor inspection squadron of Liangqing District, Nanning City, to convene all parties to hold a mediation meeting in the site office of the original phase III project department. The mediator learned by asking about the demands of both parties and the opinions of the person in charge of a construction project labor service in Guangxi: 1. The wages of 19 people including Lu Moumou, a construction worker of the project involved in the case, totaled 82,740 yuan, which had been paid and settled by a construction project labor service in Guangxi to the on-site claimant, and Lu Moumou and other 19 people should no longer require the subcontracting team Zhou and Luo and the original labor service company Guangxi construction project labor *** to pay the money. 2. Due to the loss of contact with the class owner of 19 people including Lu Moumou, the amount of work orders and wages of the project involved in the case cannot be determined. The mediator stood on a fair standpoint and patiently persuaded the two parties to understand each other, and the applicant Lu Moumou and other 19 migrant workers should solve the problem and get their wages back in accordance with legal and compliant ways; The respondents, Zhou, Luo, and the labor service company are also responsible, and should consider the lack of wages and bitterness for migrant workers. After more than two hours of mediation, the two parties negotiated and reached a settlement agreement: 1. In order to maintain stability, the respondents of the subcontracting team, Zhou and Luo, voluntarily agreed to advance funds and pay 50% of the wages of 19 migrant workers including the applicant Lu Moumou before November 22, 2023. 2. If the class claims that XX is unable to pay the remaining 50% of the wages of the migrant workers, but is willing to bear legal responsibility, the respondents of the subcontracted team, Zhou and Luo, are willing to advance the remaining 50% of the wages of 19 migrant workers including the applicant Lu again. 3. The applicant Lu Moumou and other 19 migrant workers signed a letter of guarantee, and after receiving 50% of the wages advanced by the respondent Zhou and Luo of the subcontracted team in the early stage, they shall not publish false information related to this case in any place and online platform for any reason, and shall not petition and go to the construction site for any reason, promising that the wage list provided is true and valid, and if there is any fraud, the party himself is willing to bear all legal consequences. As of press time, 19 migrant workers including the applicant Lu have received the wages advanced by the respondents Zhou and Luo of the subcontracting team.
Through this mediation, 19 workers including the applicant Lu Moumou got the "hard-earned money" before the Spring Festival, and the respondent Zhou, Luo and a construction engineering labor service in Guangxi can also celebrate the New Year with peace of mind and stability. In the future, Pinghu Mediation Center will keep in mind that "I do practical things for the community and the masses", continue to mediate all kinds of civil and commercial disputes in a neutral, fair and just manner, and contribute to the construction of a harmonious society.
