Definition.
Environmental pollution damage: all kinds of damage caused during or after the occurrence of environmental pollution accidents, including the destruction of regional ecological environment functions and natural resources, personal and property damage and the actual value of their reduction directly caused by environmental pollution, as well as the necessary and reasonable measures taken to prevent the expansion of pollution, repair and or restore the damaged ecological environment. Comprehensive and complete environmental pollution accident damage = personal injury + property damage + ecological environment and resource damage + accident impact damage + pollution remediation cost + emergency disposal cost + investigation and assessment cost.
Appraisal and assessment of ecological environmental damage refers to the process in which appraisal and assessment institutions comprehensively use science, technology and professional knowledge to investigate environmental pollution, ecological damage and ecological environment damage, analyze the causal relationship between environmental pollution or ecological damage and ecological environmental damage, assess the scope and extent of ecological environmental damage caused by environmental pollution or ecological damage, determine the restoration measures for ecological environment restoration to the baseline and compensation period, and quantify the amount of ecological environmental damage.
Scope of identification. The business scope of judicial appraisal of environmental pollution damage includes: judicial appraisal of environmental pollution damage (air environmental pollution identification, water environmental pollution identification, acoustic environmental pollution identification, light environment pollution identification, soil environmental pollution identification, marine environmental pollution identification, ecological environment pollution identification), environmental pollution damage assessment and identification, environmental protection or treatment project evaluation and identification.
