The court sentenced Yang Gongxun to death for intentional homicide and deprived him of his political rights for life; At the same time, he was sentenced to 6 years in prison and fined 20,000 yuan for robbery. The two charges were combined, and it was decided to carry out the death penalty, deprive him of his political rights for life, and impose a fine of 20,000 yuan.
During the trial, the court found out that Yang Gongxun was resentful of a dispute over the boundary of the vegetable garden with the father of the victim Yang Mouyan, and later blamed the dispute for his father's hospitalization and surgery, and repented of the previous settlement. Although Bai Mou, the secretary of the community, and others have tried to mediate many times, Yang Gongxun still has no remorse after receiving part of the mediation money, and the conflict between the two parties has not been completely resolved. Coupled with his personal marriage and financial difficulties, Yang Gongxun decided to take revenge.
On January 19, 2023, Yang Gongxun used machetes and driving rammings in Pingyang County, resulting in the death of 6 people, including Bai Mouji, Chen Moulu, Yang Mouying, Chen Moulian, Yang Mouyan and Wang Mouyu, and 1 person was slightly injured. In the process of committing the crime, he also robbed Chen's car. Subsequently, Yang Gongxun surrendered to **.
The Wenzhou Intermediate People's Court held that Yang Gongxun deliberately and unlawfully deprived others of their lives, causing six deaths and one injury, and that his actions constituted the crime of intentional homicide; At the same time, he used threats of violence to snatch the vehicle, which constituted the crime of robbery. Although Yang Gongxun voluntarily surrendered, his criminal methods were extremely cruel, the circumstances were heinous, and his crimes were serious, and he should be severely punished in accordance with the law. Taking into account the facts, nature, circumstances and degree of harm to society of his crime, the court decided not to give him a lighter punishment.
The trial process of the case was open and transparent, and the defendant's relatives, the victim's relatives, deputies to the people's congress, members of the Chinese People's Political Consultative Conference, and journalists attended the hearing.
In addition, after the case occurred, the discipline inspection and supervision organs at the city and county levels seriously held accountable 16 party members and cadres who were untruthful and ineffective in performing their duties in the resolution of contradictions.
