Musk, it's really here this time.
Musk angrily sued OpenAI for treachery and betrayal of its mission.
On March 1, Musk filed a 46-page lawsuit report with a San Francisco court, formally taking OpenAI and its CEO Sam Altman, as well as OpenAI's co-founder and president Greg Brockman to court. This is tantamount to a "depth charge" for OpenAI, which is in the limelight.
In Musk's complaint, he focused on the founding agreement signed with OpenAI that year. According to the agreement, OpenAI will be a non-profit organization that develops AGI for the benefit of mankind and is not suitable for for-profit companies that pursue the maximization of shareholder profits. At the same time, it will be open source, balancing only offsetting security considerations, and its technology will not be closed and kept secret for proprietary commercial reasons.
But judging from the current development of OpenAI, it has not only changed from open-source AI to closed-source AI, but also from a non-profit organization to a company with a valuation of tens of billions, and has been helping Microsoft expand its revenues, such as Microsoft's Copilot technology is supported by GPT. According to a report, just 10% of existing Office users using Copilot can generate about $14 billion in revenue for Microsoft.
According to Musk, they have carefully designed a non-profit structure, but after the storm of Ultraman Sam, the board of directors was replaced by people who are heavy on profits but lack professional knowledge, and even Musk directly singled out that they are the fan group of Ultraman Sam.
Judging from the complaint, Musk wants the court to rule that OpenAI's open-source technology and disclose the research results to the public, and he asks the court to issue an injunction prohibiting OpenAI, Sam Ultraman and Microsoft from profiting from the company's AGI technology; At the same time, financial accounting was carried out to find out the amount of funds injected by Musk and other investors into OpenAI, as well as how much benefit it brought to OpenAI, and how much went into the personal pockets of shareholders and Ultraman; Finally, it enforces OpenAI's promise to investors, and if it can't be done, compensation must be given.
Some analysts say the lawsuit may be the biggest threat to Sam Altman after the OpenAI palace fight.
The details of the mysterious Q* have been revealed, and AGI will be realized in 2027
And this round of storms, as many expected, is further fermenting and intensifying.
A few days after the indictment, a 53-page PDF went viral, in** with OpenAI's latest plans and progress, including OpenAI's AGI timeline.
According to the documents, OpenAI began training a 125 trillion parameter multimodal transport model in August 2022, with the first phase being Arrakis, also known as Q*. The model was trained in December 2023, but the release was canceled due to the high cost of inference, that is, GPT-5, which was originally planned to be released in 2025, because the original GPT-5 has been canceled, GPT-45 renamed GPT-5.
Q*The next phase of GPT-6, which was originally scheduled to be released in 2026, was renamed GPT-7 and is now on hold due to Musk's lawsuit. GPT-8 is scheduled to be released in 2027 and will enable full artificial intelligence (AGI).
In other words, GPT-5, which will be released in the near future, is the original GPT-45, the real GPT-5 is postponed to GPT-6, and GPT-6 is postponed to GPT-7.
It is not yet certain how credible the content in this document is, and if this is the case, then Musk is equivalent to slowing down the pace of the entire OpenAI by himself.
However, if we rewind the timeline to the indictment, we will find that in fact, the dark mines have already been laid.
In November 2023, the day before Altman Sam was fired, one of his remarks at an APEC meeting caused an uproar. He hinted that OpenAI has developed more powerful and unimaginable technology than GPT-4, far exceeding expectations. Immediately on the second day, there was a palace fight storm within OpenAI, and Sam Ultraman was forced to **. Soon after, OpenAI's secret AI model Q was also **.
It is reported that Jakub Pachocki and Symon Sidor, researchers at OpenAI, successfully created Q based on the results of Ilya's work. Before Ultraman Sam was fired, OpenAI's researchers sent a letter to the board of directors warning that this brand-new AI discovery could pose a threat to humanity, becoming one of the triggers for the eventual removal of Ultraman Sam.
And in February 2024, Musk officially sued OpenAI, and this boomerang once again hit the center of the eyebrows.
Musk believes that OpenAI has implemented AGI and GPT-4 is an AGI algorithm, so it is beyond the scope of the agreement with Microsoft, which only applies to the technology before the emergence of AGI. At the same time, the indictment also argues that Q* is likely to be developed by OpenAI into an AGI that is clearer and more eye-catching.
It can be seen that Musk has gone to such great lengths to sue, in addition to the purpose of open source and claims, is Q*.
Litigation in the Century of Artificial Intelligence, Who Loses and Who Wins?
In the face of this lawsuit, Sam Altman tweeted two meaningfully in succession: "The hurricane has become more and more intense, but the center of the storm remains calm. "It's all happened, and it's going to happen again. "It seems that Sam Altman is ready for a protracted battle with Musk.
Up to now, OpenAI has also stated that it will never agree to Musk's lawsuit. They feel that the lawsuit is purely a personal matter for Musk, as he regrets not being able to continue to participate in the development of OpenAI.
According to OpenAI, back in late 2017, Musk tried to fight for control of OpenAI and planned to merge it with Tesla. However, Sam Altman firmly rejected the offer, which led Musk to announce his withdrawal from OpenAI the following year.
It is worth noting that in 2019, Altman Sam spoke out for Musk and Tesla on X (Twitter), saying that "it must be a mistake to bet on Elon, and the best product usually wins". At that time, Musk expressed his gratitude.
After Musk sued, Sam Altman replied to this tweet again, saying that "it is like this at any time", or he is also expressing his attitude towards being sued by Musk.
There are mixed opinions on the lawsuit of the century, such as Indian-American billionaire Vinod Khosla who said that Musk's lawsuit against OpenAI feels like saying that grapes are sour because the Tesla billionaire did not enter the field of artificial intelligence early.
Some people also think that Musk is really for all mankind, because he has always adhered to the spirit of open source and opened all his car patents to prevent monopoly. Once OpenAI makes all its technologies public, it will be a huge benefit to the development of artificial intelligence.
However, in any case, this lawsuit proves that although Sam Altman retained his position as CEO and reshuffled the board of directors, the mission and original intention of OpenAI, as well as the controversy caused by the current closed source, are far from giving a satisfactory answer to the market.
