Hu Xijin supported the cancellation of the rule that you must brush your face when staying in a hotel, and netizens posted a long article against it
Dai Bin, member of the National Committee of the Chinese People's Political Consultative Conference and president of the China Tourism Academy, was interviewed. He suggested that the application of face recognition technology in tourism scenarios should not be too much, and it should be based on the law.
In this regard, Hu Xijin issued an article expressing support, as shown below:
And Weibo blogger @天中蜀黍 posted a long article pointing out the legitimacy and necessity of "you must brush your face when you check into the hotel", the full text is as follows:
I have read several posts about his views on hotel face scanning check-in, including Lao Hu's view that "face recognition technology is obviously overused in some areas of our society", and that face recognition exists in various places to "imitate" and "compare with each other". As a staff member who has been engaged in public security management for a long time, I will talk to you about the legality and necessity of "you must brush your face when staying in a hotel" from two aspects.
The first is the legal aspect
1. To understand this problem, we must first understand why we need to show our ID card and register personal information when staying in the hotel. According to Article 6 of the Measures for the Administration of Public Security in the Hotel Industry, hotels must register when receiving tourists for accommodation, and check the identity documents of the occupants during registration. According to Article 56 of the Law on Administrative Penalties for Public Security, hotel workers who fail to register their names, identity documents and numbers in accordance with regulations shall be punished by the public security organs. What is the purpose of check-in person information? It's very easy to understand, in a word, overview, for safety.
2. The identity information of the hotel verification and check-in person needs to be "four real", that is, the actual certificate registration, the actual name registration, the actual number of people registration, and the actual time registration. How can hotel staff quickly and accurately register occupant information? How can you tell if the documents provided by the occupants are indeed his/her own? In the past, it relied on the naked eye, experience, and the identification training of the former police force in this position. Obviously, there are loopholes and flaws in the judgment of the naked eye and experience, once the inspection finds that the registration of the hotel check-in personnel has not done the "four realities", it will be punished, and it will be punished many times, and the hotel's "special industry license" will be revoked, without the license, the hotel will be finished;
3. In the past, when science and technology were not developed, check-in and registration depended on human judgment. But technology changes life, and now that there is face recognition technology, isn't all this solved? The ability of technology to identify and judge people and documents is definitely much higher than that of manual work, and the speed will be faster. When we check into the hotel and brush our faces, what are our faces? When we check into the hotel, the "face" we swipe is the "biometric information" mentioned in Article 1034 of the Civil Code, which is part of personal information.
4. Can the police use the processing of faces as personal information (including collection, use, storage, etc.) in the management of the hotel industry? Of course! Is there a legal basis? Of course! Article 37 of the Personal Information Protection Act stipulates that the provisions of this Law on the processing of personal information by state organs shall apply to the processing of personal information by organizations authorized by laws and regulations to manage public affairs in order to perform their statutory duties. The Force's management of the hotel industry is in the performance of public affairs (and it is clear that public safety is part of public affairs). Article 13, Paragraph 1, Item 3 of the Personal Information Protection ** clearly states that personal information processors may process personal information when it is necessary for the performance of statutory duties or obligations. The management of the hotel industry is the statutory duty of the Force, and it is the legal obligation of the hotel to cooperate with the Force in registering the information of the occupants.
5. Someone said that the processing of personal information does not require the consent of the individual? Yes, but the individual's consent is not required to perform a statutory duty or obligation. This is clearly stated in Article 13, Paragraph 2 of the Personal Information Protection**. So what does it mean to "process" personal information? Collection and use is a way of processing personal information. In order to maintain social order, the use of citizens' personal information by state organs is for the purpose of fulfilling the law, which is legitimate and just.
The above five points are the legal basis for checking in to the hotel. I'll talk about the practical significance of brushing your face in a hotel (I'm not comprehensive, friends are welcome to add).
1. It avoids the cumbersomeness and errors of manual registration and manual verification when checking in to the hotel, improves the work efficiency of hotel staff, saves the time cost of registering personal information of guests, and improves the consumption experience of guests;
2. Blocking the hiding channels of lawbreakers (fugitives, drug-related personnel, and people who use the closed environment of the hotel to engage in pornography and gambling), providing a safe check-in environment for other occupants, and purifying the business environment for hotel operators;
3. A retrospective mechanism for the activities of residents has been constructed, especially for the vulnerable groups of illegal crimes (women and minors) to build an invisible but tangible protection mechanism.
A few more points to discuss with Comrade Lao Hu
1. Checking in to the hotel and brushing your face is the proper meaning of the strategy of strengthening the police with science and technology. The number of police officers per 100,000 people in China is less than half of that of the United States, and the reality of the shortage of police force is very cruel.
2. Judging from the laws and regulations I listed above, it is not difficult to draw a conclusion that the use of the so-called face brushing technology for public safety is based on the law. The dialectical relationship between development and security is also very well understood, security is the guarantee of development, and the results of development (the results of scientific and technological development) will in turn promote the improvement of security.
3. As Comrade Lao Hu said, "our society is already quite safe", but Lao Hu seems to have confused the logic, it is precisely because of the hard work of the vast number of people's auxiliary police with the blessing of science and technology that our society is "quite safe", not already "quite safe" There is no need to live in such science and technology as brushing face, continue to vigorously promote the strategy of strengthening the police with science and technology, our society will be safer, a safer society, and better "comprehensively promote tourism and consumption". It's good to be safer, but we want to make society safer and safer, because there is no end to the exploration and efforts to protect social tranquility and ensure that the people live and work in peace and contentment.
4. It is normal for some people to have concerns about the security of personal information, but please believe that our legislation has fully considered the possible information security issues, everything has laws to follow, and the collection and application of personal information are within a moderate range and are based on the principle of necessity. Safety is the most basic need of people, and only by improving safety can we "enhance the confidence of the whole society";
5. Comrade Hu, I don't know if I made it clear? There are some laws and regulations that may not be the focus of your area of expertise, so you are not to blame for the limitations of your views. However, many people have this point of view: good people are not afraid of brushing their faces and not afraid of cameras. I couldn't agree more, but what about you?
Netizens have something to say
Netizens said: For the sake of public safety and for the interests of most people, I support the face brushing in the store.
Netizens said: Agree, there must be a lot of darkness in the hearts of those who take out Western privacy at every turn. Go to the library and look through the previous judicial magazines to see how high the incidence rate of **, theft, and ** cases that occurred in hotel guest houses when technology was not developed in the past. Not to mention pornography, gambling and drugs.
Netizens said: I haven't understood where is the controversy over face brushing? Whether you are on a plane or international, you have to brush your face, you have to take a photo of your face when you go to the bank, and you have to brush your face to match your passport information when you enter and exit (any country), and you have to record your fingerprints for comparison .......If newborns begin to record fingerprints from birth and retain biometrics, any fingerprint recognition scene will greatly improve the recovery rate and recovery time of missing children.
Netizens said: Of course, law-abiding people are not afraid at all, and some people are in a hurry because they are afraid that it will be inconvenient to open a house and prostitute themselves.
Zhang Songwen worked as a tour guide in Shenzhen in the early days
Netizens have something to say
Netizens said: Then he is even more powerful, he made a ceiling in an industry, and he was full of confidence to change a track and hit a wall everywhere, he actually did not collapse his mentality, he was willing to precipitate for so long, improve his professionalism instead of taking a shortcut with his mentality, this perseverance mentality is quite admirable.
Netizens said: 2w. in 1999Was it possible to buy a house at that time?
Netizens said: This tells us that we can eat enough first, and then chase our dreams. Confident.
Netizens said: The experience of the tour guide has allowed him to travel all over the motherland, coupled with the accumulation of knowledge and the precipitation of life experience, so that he can be pampered and humiliated, and integrate into every role more naturally.
France has enshrined the right to abortion in its constitution: an induction ceremony will be held on Women's Day
On March 4, the French parliament held a special session of both houses and decided to write the right to abortion into the constitution, making France the first country in the world to include the right to abortion in the constitution. France's Macron said it was "the pride of France". France will hold a "constitutional ceremony" for abortion rights on March 8. The amendment was supported by a majority of parties in the country and passed by a vote of 780 to 72. Abortion has been legal in France since 1975. In 2022, the U.S. Supreme Court overturned Roe v. Wade, which had a great repercussion in Europe. According to a French poll, more than 80 per cent of the population supports amending the Constitution to protect the right to terminate pregnancy. After the vote passed, the Eiffel Tower was lit up to celebrate, with the words "My Body, My Choice". (Integrated BBC, Reuters, Associated Press).
Netizens have something to say
Netizens said: Abortion and childbirth are the basic human rights of women, and the fetus is part of the mother and not an independent individual.
Netizens said: My body, my choice.
Netizens said: France has not been born much since the Revolution, the population of World War I lagged behind Germany a lot, and now it is gradually Islamized, and it will not face the problem of abortion but the problem of overpopulation in the future.
Netizens said: Today, I also lamented that French workers take one month of paid leave every year, far ahead.
