1. According to Article 11 of the Administrative Measures for the Identification of High-tech Enterprises: the following application materials need to be submitted:
1) Application for recognition of high-tech enterprises;
2) A copy of the business license and tax registration certificate (copy);
3) Intellectual property certificate (exclusive license contract), production approval, new product or new technology certificate (novelty) materials, product quality inspection report, provincial science and technology plan project certificate, and other relevant certification materials;
4) The number of employees, the educational structure and the proportion of R&D personnel in the number of employees in the enterprise;
5) A statement of the R&D expenses of the enterprise in the past three fiscal years verified by a qualified intermediary agency (if the actual life is less than three years, the actual operating period shall be followed), and the explanatory materials of the R&D activities shall be attached;
6) The financial statements (including balance sheet, profit and loss statement, cash flow statement, and the actual operating years if the actual life is less than three years) and the technical income statement of the enterprise for the past three fiscal years certified by a qualified intermediary agency.
2. According to Article 10 of the Administrative Measures for the Identification of High-tech Enterprises, the following conditions must be met at the same time for the identification of high-tech enterprises:
1) Enterprises registered in China (excluding Hong Kong, Macao and Taiwan) have independent intellectual property rights for the core technologies of their main products (services) in the past three years through independent research and development, transfer, donation, mergers and acquisitions, etc., or through exclusive licensing for more than 5 years;
2) The products (services) belong to the scope of the provisions of the "High-tech Fields Supported by the State";
3) Scientific and technological personnel with college degree or above account for more than 30% of the total number of employees of the enterprise in the current year, of which R&D personnel account for more than 10% of the total number of employees in the current year;
4) The total R&D expenses incurred by the enterprise in China shall not be less than 60% of the total R&D expenses. If the enterprise has been incorporated for less than three years, it shall be calculated according to the actual number of years of operation;
5) The income of high-tech products (services) accounts for more than 60% of the total income of the enterprise in the current year;
6) The level of enterprise research and development organization and management, the ability to transform scientific and technological achievements, the number of independent intellectual property rights, sales and total asset growth and other indicators meet the requirements of the "Guidelines for the Management of High-tech Enterprise Identification" (formulated separately). Additional Information:
1. If a recognized high-tech enterprise has one of the following circumstances, its qualification shall be cancelled:
1) Providing false information during the course of applying for designation;
2) Acts such as stealing or cheating taxes;
3) The occurrence of major safety and quality accidents;
4) There are environmental and other violations of laws and regulations, and they are punished by the relevant departments.
2. For an enterprise that has been disqualified as a high-tech enterprise, the accreditation agency will no longer accept the application for recognition of the enterprise within 5 years. All kinds of institutions and personnel involved in the identification of high-tech enterprises shall have the obligation of integrity and compliance for the identification work they undertake, and shall have the obligation to keep confidential the relevant information of the declared and recognized enterprises. Those who violate the relevant requirements and disciplines for the identification of high-tech enterprises shall be dealt with accordingly.
