He suggested that the relevant policies of paid annual leave should be enforced, the provisions on the violation of legal liability by enterprises should be improved, and the constraints on the implementation of annual leave by enterprises should be strengthened. At the same time, he suggested that the provisions on the number of annual leave days in Article 3 of the current "Regulations on Paid Annual Leave for Employees" (hereinafter referred to as the "Regulations") should be amended, and the number of paid annual leave days should be increased according to the length of serviceIf an employee has worked for 1 year but less than 10 years, 5 days per year for the first two years, and 1 day for each subsequent year, increasing to a maximum of 10 days.

Huo Qigang said that due to the imperfect vacation system, China's tourism industry has also been affected. First of all, the travel window of domestic tourists is too concentrated, and the contradiction between supply and demand is prominent. The "tidal effect" of the tourism market is obvious, and the demand for travel is excessively concentrated in the "May Day" and "Eleventh" holidays, which brings huge supply pressure to various departments such as civil aviation, railways, highways, urban construction, commerce, scenic spots, and accommodation, resulting in a decline in service quality and poor tourist experience, which seriously affects the competitiveness of China's tourism industry.

In addition, due to the constraints of holiday length, short- and medium-distance travel dominates, which exacerbates the regional imbalance of industrial development. In 2023, the output and reception volume of domestic tourists in China will be concentrated in the urban agglomerations of 10 provinces in the central and eastern regions, and the passenger flow in short-distance provinces or adjacent provinces will dominate, which is not conducive to changing the current situation of unbalanced regional and urban-rural development of China's tourism industry.

Third, the existing annual leave system inhibits the consumption power of young people, who occupy the main position of the tourism market. In 2023, the group with the largest number of trips per capita in China is the "post-95" with independent tourism consumption decision-making power, but the "post-95" generation generally has less than 10 years of service, and the 5-day annual leave time cannot effectively release their travel consumption potential.

Huo Qigang suggested that the provisions on weekly working hours in the existing labor law should be strictly implemented, the supervision and management of the working hours of enterprises and institutions should be strengthened, and enterprises should be prohibited from agreeing to cancel the "double rest" of employees unless there are special circumstances, and clear provisions should be made on the situation that enterprises really need to extend the working hours of employees due to work. At present, some companies redeem annual leave in cash when implementing the policy. The relevant departments should issue detailed rules to prohibit enterprises from agreeing to cancel employees' annual leave unless there are special circumstances, and make clear provisions on the circumstances in which enterprises are unable to arrange annual leave for employees due to work needs. Relevant departments need to strengthen law enforcement inspections, and make the implementation of the paid annual leave system a key part of labor security supervision. Considering the labor cost of enterprises, the relevant departments should innovate inspection methods, reward and punish in parallel, and take the implementation of paid leave by enterprises as an important basis for enterprise rewards and punishments, credit, and rating evaluation, so as to encourage enterprises to implement the "Regulations".
