Whether it's taking out a bank loan or trying to start a business, once it is found out that I am a 'bad guy' and being turned away is commonplace, 'taking off my hat' is very important for me and my family. "Lin Song in a district of Tianjin was included in the list of dishonest judgment defaulters by the court four years ago because he gave birth to a second child and was unable to fulfill the obligation to pay social maintenance fees within the statutory time limit.

According to China News Weekly, Lin Song was exempted from more than 60,000 yuan in the special supervision of "compulsory enforcement of social maintenance fees" carried out by the Tianjin Municipal People's Procuratorate, and the four-year "old lai" hat was finally taken off. This case was selected as the fifth batch of typical cases of procuratorial hearings recently released by the Supreme People's Procuratorate.

In fact, with the issuance of the "Decision on Optimizing the Birth Policy and Promoting the Long-term Balanced Development of the Population" issued by the Communist Party of China in 2021, requiring "the abolition of social maintenance fees, cleaning up and abolishing relevant punishment regulations", social maintenance fees have become a historical issue.

Therefore, it is obviously inappropriate to continue to collect social maintenance fees. However, due to the fact that some people have not yet paid off their previous social maintenance fees, they have been included in the list of dishonest judgment defaulters, that is, "old men", and they are still facing problems such as loan rejection and inability to buy high-speed rail tickets. The Tianjin procuratorial organs' active involvement in supervision is to take off the hat of some of the "old lai" who paid social support.

The Tianjin procuratorate carried out a special supervision of "enforcement of social maintenance fees", resolved more than 4,100 related enforcement cases, and exempted 1 for the partiesMore than 100 million yuan of administrative levy. This not only shows that there are quite a few cases of "old lai" people who are involved in social maintenance fees, but also shows that the procuratorial organs have actively performed their supervisory function -- to let the "old lai" in arrears return to normal life as soon as possible.

It is very necessary for the procuratorial organs to carry out special supervision over this, which is a move to protect the rights and interests of the parties concerned and adapt to the new situation. However, relying solely on the procuratorial organs to solve problems one by one is inefficient.

The main reason why some people who are in arrears of social maintenance fees still wear the hat of "old men" is that there is no legal basis for the handling of "cases that have not been completed in the course of enforcement". The Decision on Optimizing the Fertility Policy and Promoting the Long-term Balanced Development of the Population and the revised Population and Family Planning Law have proposed and deleted the penalties related to social maintenance fees, but do not stipulate how to deal with "cases that have entered the enforcement procedure and have not yet been completed".

This requires the relevant departments of the state to introduce a unified policy on this issue as soon as possible, so as to facilitate all localities to take off their hats for the "old men" of social maintenance fees.

Moreover, an early solution to the historical problem of social maintenance fees will also help better implement the comprehensive "three-child" policy, build a childbirth-friendly society, and create favorable conditions for the long-term balanced development of China's population.
