Recently, the Jiutai District People's Court of Changchun City heard a case of disputes over the right to life, the right to body, and the right to health.
Mr. Zhao is an employee of a company, and the two parties signed a labor contract. At the end of work, the ice and snow on the road in front of the company were not cleaned up in time, causing Zhao to fall and fracture. Zhao and the company did not reach an agreement on the issue of compensation, so Zhao sued the company to the Jiutai District People's Court of Changchun City.
The court held that Zhao was injured when he slipped and fell on the company's road when he got off work, and that the company had the obligation to clean up the ice and snow on the company's road in a timely manner to ensure the safe passage of employees, and that the evidence submitted by the company to the court was insufficient to prove that it had fulfilled its obligation to clean up the ice and snow in a timely manner, and that it could not prove that it was not at fault, so it should bear the main tort liability for the accident in which Zhao was injured. At the same time, Zhao, as a sane and sound adult, should fulfill the obligation to pay attention to and protect his own safety when passing on icy roads, so Zhao should also bear some responsibility for his own injuries.
Based on the above reasons, the court decided that a company should bear 60% of the compensation liability for the losses caused by the accident, and Zhao should bear 40% of the liability.
The People's Court of Jiutai District, Changchun City, warmly reminds that the road is icy and easy to fall, so you must be cautious when traveling in snowy days. While individuals should be vigilant, units should also strengthen preventive measures and clear snow in a timely manner to ensure the safety and health of employees.
